Pregnancy and Parental Leave. (a) Pregnancy/Parenting leave will be granted in accordance with the provisions of the Employment Standards Act, except where amended in this provision. Such payment shall commence following receipt by the Employer of the employee's Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen (17) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employee’s EI benefit. (e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.
(f) Parental leave must begin no later than sixty-three (63) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. Pregnancy and Parental Leave. (a) Pregnancy/Parenting Pregnancy leave and parental leave without pay will be granted in accordance with the provisions of the Employment Standards Act, except where amended in this provision2000.
(b) If possible the employee A Nurse’s seniority shall give written notification at least one (1) month in advance accrue during a period of the date of commencement of such pregnancy and parental leave and such accrual shall be equal to the expected date total number of returnregular hours worked by the Nurse, or paid by the Employer as vacation pay or holiday pay, in the twenty-six weeks before the work week in which the pregnancy or parental leave commenced, divided by one hundred and thirty and multiplied by the number of week days (excluding paid holidays) covered by the pregnancy or parental leave.
(c) The employee service requirement for eligibility for SUB payments shall reconfirm her intention to return to work on the date originally approved in subsection be twenty- six (b26) above by written notification received weeks. Such payment shall commence following completion of the two (2) week Employment Insurance waiting period, and receipt by the Employer of the employeeEmployee's Employment Insurance cheque stub remittance statement as proof that she is in receipt of Employment Insurance pregnancy/ parenting pregnancy benefits, and shall continue while the employee Employee is in receipt of such benefits for a maximum period of seventeen fifteen (1715) weeks. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance unemployment benefits and any other earnings. Such payment shall commence following completion of the two-week unemployment insurance waiting period, and receipt by the Employer of the employee's Employment Insurance unemployment insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting the employment insurance pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen fifteen (1715) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours.
(c) After confirmation by the Unemployment Insurance Commission of the appropriateness of the Employer's Supplemental Unemployment Benefit (SUB) Plan, an employee, who adopts a child, requests parental leave and commences such a leave as set out above who is in receipt of unemployment insurance parental leave benefits pursuant to Section 30 of The Unemployment Insurance Act, 1971, shall be paid a supplemental unemployment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings and the sum of her weekly unemployment benefits and any other earnings. Such payment shall commence following completion of the two-week unemployment insurance waiting period, and receipt by the Employer of the employee's unemployment insurance cheque stub as proof that she is in receipt of the employment insurance parental leave benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of fifteen (15) weeks. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to commencement of the leave times her normal weekly hours for an employee working less than seventy-fivehours.
(d) When persons are hired to replace employees who are on approved pregnancy or parental leave, the period of employment of such persons will not exceed the parental leave. The release or discharge of such persons shall not be the subject of a grievance or arbitration. This clause would not preclude such employees from using the job posting provisions under the Collective Agreement and any successful applicant who has completed his probation period will be credited with the appropriate seniority. The Employer will outline to employees selected to fill such temporary vacancies in the presence of a Union Committee person or Xxxxxxx, the circumstances giving rise to the vacancy, and the special conditions relating to such employment. The Employer will furnish a confirming letter to the employee.

Such Biweekly payment shall commence following completion of the one (1) week Employment Insurance waiting period, and receipt by the Employer Home of the employee's nurse’s Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen fifteen (1715) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employeenurse’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours. The normal weekly hours for an a part-time employee working shall be calculated by using the same time period used for calculation of the Employment Insurance benefit. The SUB benefit is equivalent to the difference between 84% of the gross regular weekly earnings at Dufferin Oaks and the sum of the gross weekly El benefits less any other earnings. The SUB plan provision is for a maximum of (fifteen) 15 weeks. The SUB calculation is based on the El rate of 55%, less any other earnings. If the length of the leave changes, therefore reducing the El rate, the total payable by Dufferin Oaks would remain the same amount (based on the 55% rate) and the provisions for the (fifteen) 15-week maximum for the SUB plan payment would continue to apply. The employee does not have any vested right except to receive payments for the covered unemployment period. The plan provides that payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan.
(e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.
(f) Parental leave must begin no later than seventyfifty-fivetwo (52) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. Parental leave shall be granted per the Employment Standard Leave
(g) The employee shall give the Employer two (2) weeks’ written notice of the date the leave is to begin unless exempt under the Employment Standards Act. The duration and notification period of the Parental leave is as per the Employment Standards Act.
(h) An employee who is on parental leave as provided under this Agreement, who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance parental benefits pursuant to Section 23 of the Employment Insurance Act shall be paid a supplemental employment benefit. That benefit will be equivalent to the difference between eighty-four (84%) percent of the nurse's regular weekly earnings and the sum of her or his weekly Employment Insurance benefits and any other earnings. Biweekly payment shall commence following completion of the one (1) week Employment Insurance waiting period, and receipt by the Home of the employee's Employment Insurance cheque stub as proof that she or he is in receipt of Employment Insurance parental benefits and shall continue while the nurse is in receipt of such benefits for a maximum period of twelve (12) weeks. The nurse's regular weekly earnings shall be determined by multiplying her or his regular hourly rate on her or his last day worked prior to the commencement of the leave times her or his normal weekly hours. The normal weekly hours for a part-time employee shall be calculated by using the same time period used for calculation of the Employment Insurance benefit. The SUB benefit is equivalent to the difference between 84% of the gross regular weekly earnings at the County of Dufferin and the sum of the gross weekly El benefits less any other earnings. The SUB plan provision is for a maximum of (twelve) 12 weeks. The SUB calculation is based on the El rate of 55%, less any other earnings. If the length of the leave changes, therefore reducing the El rate, the total payable by Dufferin Oaks would remain the (twelve) 12-week maximum for the SUB plan payment would continue to apply. The employee does not have any vested right except to receive payments for the covered unemployment period. The plan provides that payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan.
(i) For the purposes of parental leave, the provisions under (a) and (c) shall also apply.
(j) The Employer shall continue to pay its’ share of the premiums to the various employee benefit plans for nurses who are on pregnancy and parental Leave, provided that the nurse arranges to pay the employee's share of the premiums, if any.
(k) Seniority and service continues to accrue while a nurse is off on pregnancy and parental leave.

(e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.

(e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.
(f) Parental leave must begin no later than sixty-three (63) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. Parental leave shall be granted for up to sixty-one (61) weeks in duration if the employee also took pregnancy leave and sixty-three (63) weeks in duration if they did not.
(g) The employee shall give the Employer two (2) weeks’ written notice of the date the leave is to begin unless exempt under the Employment Standards Act. An employee must complete 1875 hours of continuous service prior to the expected date of birth to be paid a supplemental unemployment insurance benefit. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. (h) An employee who is on parenting leave as provided under this Agreement, who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance parental benefits pursuant to the Employment Insurance Act shall be paid a supplemental employment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her/his regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her/his weekly Employment Insurance benefits and any other earnings. Such payment shall commence following receipt by the Employer of initial confirmation of Employment Insurance payment (or more frequently where the payment changes) as proof that she/he is in receipt of Employment Insurance parental benefits and shall continue while the employee is in receipt of such benefits for a maximum period of ten (10) weeks. Pregnancy and Parental Leave. (a) Pregnancy/Parenting Pregnancy and parental leave will be granted in accordance with the provisions of the Employment Standards Act, except where amended in this provision.;
(b) If possible Any absence under this provision is not an illness under the employee interpretation of this Agreement and shall give written notification at least one (1) month in advance not be subject to the provisions of the date of commencement of such sick leave and the expected date of return.plan;
(c) When persons are hired to replace employees who are on approved pregnancy/parental leave, the period of employment of such persons will not exceed the pregnancy/parental leave. The employee release or discharge of such person shall reconfirm her intention to return to work on not be the date originally approved in subsection (b) above by written notification received subject of a grievance or arbitration, and such person shall not be covered by the Employer at least four (4) weeks in advance thereof. The employee shall be reinstated to her former position, unless the position has been discontinued in which case she shall be given a comparable jobprovisions of this Collective Agreement.
(d) An employee who is Accumulation of service and seniority credits, if any, during a pregnancy leave, shall be governed by the provisions of the Employment Standards Act.
(e) Effective on confirmation by the Canada Employment Insurance Commission of the appropriateness of the Employer’s Supplementary Unemployment Benefit (SUB) Plan and effective January 1, 2010, an employee, entitled to pregnancy leave as provided under this Agreementleave, who has completed five (5) months years of continuous service with the Employer, and who has applied for and is in receipt of Employment Insurance pregnancy/ parental employment insurance pregnancy benefits pursuant to the Employment Insurance Act shall be paid a supplemental employment benefitsupplementary unemployment benefit for a period not exceeding fifteen (15) weeks. That benefit will be equivalent to the difference between seventy-five 65 percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) earnings, and the sum of her weekly Employment Insurance rate of employment insurance benefits and any other earnings. Such payment shall commence following completion of the two-week employment insurance waiting period and receipt by the Employer of the employee's Employment Insurance ’s employment insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting employment insurance pregnancy benefits, and an shall continue while the employee is in receipt of such benefits for a maximum period of seventeen (17) 15 weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the full time employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave leave, times her normal weekly hours. (e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.
(f) Parental leave must begin no later than sixty-three (63) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. Parental leave shall be granted for up to sixty-one (61) weeks in duration if the employee also took pregnancy leave and sixty-three (63) weeks in duration if they did not.
(g) The employee shall give the Employer two (2) weeks’ written notice of the date the leave is to begin unless exempt under the Employment Standards Act. Parental leave ends sixty-one (61) weeks after it began if the employee also took pregnancy leave and sixty-three (63) weeks after it began if the employee did not or on an earlier day if the employee gives the Employer at least four (4) weeks’ written notice of that day.
(h) An employee who is on parenting leave as provided under this Agreement, who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance parental benefits pursuant to the Employment Insurance Act, shall be paid a supplemental employment benefit. That benefit will be equivalent to the difference between seventy-fivefive percent (75%) their regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of their weekly Employment Insurance benefits and any other earnings. Such payment shall commence following receipt by the Employer of the employee’s Employment Insurance cheque stub (or more frequently where the payment changes) as proof that they are in receipt of Employment Insurance parental benefits for a maximum period of ten (10) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub (or more frequently where the payment changes) within two (2) weeks of receipt of the employee’s EI benefit. The normal weekly hours for an employee working less than seventy-five (75) hours bi-weekly shall be calculated by using the same period used for calculation of the Employment Insurance benefit. The plan provides that payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan. Where an employee elects to receive parental leave benefits pursuant to Section 12(3)(b)(ii) of the Employment Insurance Act, the amount of any Supplemental Unemployment Benefit payable by the Employer will be no greater than what would have been payable had the employee elected to receive the parental leave benefit pursuant to Section 12(3)(b)(i) of the Employment Insurance Act.
(i) For the purposes of parental leave, the provisions under (a) and (c) shall also apply.
(j) Nurses newly hired to replace nurses who are on approved pregnancy/parental leave may be released and such release shall not be the subject of a grievance or arbitration. If retained by the Employer, in a permanent position, the nurse shall be credited with seniority from date of hire subject to successfully completing their probationary period. The nurse shall be credited with hours worked towards the probationary period to a maximum of two hundred twenty-five (225) hours. The Employer will outline to nurses hired to fill such temporary vacancies the circumstances giving rise to the vacancy and the special conditions relating to such employment.

That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance unemployment benefits and any other earnings. Such payment shall commence following completion of the two-week unemployment insurance waiting period, and receipt by the Employer of the employee's Employment Insurance unemployment insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting the employment insurance pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen fifteen (1715) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours.
(c) After confirmation by the Unemployment Insurance Commission of the appropriateness of the Employer's Supplemental Unemployment Benefit (SUB) Plan, an employee, who adopts a child, requests parental leave and commences such a leave as set out above who is in receipt of unemployment insurance parental leave benefits pursuant to Section 30 of The Unemployment Insurance Act, 1971, shall be paid a supplemental unemployment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings and the sum of her weekly unemployment benefits and any other earnings. Such payment shall commence following completion of the two-week unemployment insurance waiting period, and receipt by the Employer of the employee's unemployment insurance cheque stub as proof that she is in receipt of the employment insurance parental leave benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of fifteen (15) weeks. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to commencement of the leave times her normal weekly hours for an employee working less than seventy-fivehours.
(d) When persons are hired to replace employees who are on approved pregnancy or parental leave, the period of employment of such persons will not exceed the parental leave. The release or discharge of such persons shall not be the subject of a grievance or arbitration.
(e) This clause would not preclude such employees from using the job posting provisions under the Collective Agreement and any successful applicant who has completed his probation period will be credited with the appropriate seniority.
(f) The Employer will outline to employees selected to fill such temporary vacancies in the presence of a Union Committee person or Xxxxxxx, the circumstances giving rise to the vacancy, and the special conditions relating to such employment. The Employer will furnish a confirming letter to the employee.

The pregnancy leave request shall be accompanied by a certificate from a physician stating the expected due date. Benefit coverage during the approved leave shall be in this provisionaccordance with Article 18.06.
(b) If possible the employee shall give written notification at least one (1) month in advance of the date of commencement of such leave and the expected date of return.
(c) The employee shall reconfirm her intention to return to work on the date originally approved in subsection (b) above by written notification received by the Employer at least four (4) weeks in advance thereof. The employee shall be reinstated to her former position, unless the position has been discontinued in which case she shall be given a comparable job.
(d) b. An employee who is on pregnancy leave as provided under this Agreementset out in (a) above, who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance pregnancy/ parental benefits pursuant to Maternity Benefits of the Employment Insurance Act Act, shall be paid a supplemental employment unemployment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance benefits and any other earningsbenefits. An employee must complete 1875 hours of continuous service prior to the expected date of birth to be paid a supplemental unemployment insurance benefit. Such payment shall commence on a monthly basis following completion of the two (2) week Employment Insurance waiting period, and receipt by the Employer of the employee's ’s Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting benefitsMaternity Benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen ten (1710) weeks. The employee Employer will endeavour to provide a copy accept the first EI stub as full and sufficient proof of her eligibility for top-up payments for the duration of the Employment Insurance cheque stub within two (2) weeks of receipt of the employee’s EI benefitmaternity leave period. The employee's ’s regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave leave, times her normal weekly hours. (e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.
(f) Parental leave must begin no later than sixty-three (63) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. Pregnancy and Parental Leave. (a) Pregnancy/Parenting Employees are entitled to receive pregnancy, paternal or adoption leave will be granted in accordance with the provisions of the Employment Standards Act, except where amended .
(a) The objective of the supplementary benefit plan is to supplement Employment Insurance benefits up to 95% of the employeeís normal weekly earnings during pregnancy leave. Up to 17 weeks of pregnancy leave will be granted in this provisionaccordance with the Employment Standards Act.
(b) If possible This plan covers only temporary unemployment due to pregnancy. Employees do not have a right to SUB payments except for supplementation of E.I. benefits during the employee shall give written notification at least one (1) month unemployment period as specified in advance of the date of commencement of such leave and the expected date of returnplan.
(c) An employee must apply for and be in receipt of Employment Insurance benefits before SUB can be paid. The employee must meet the requirements of the E.I. Act concerning the period during which pregnancy benefits can be paid.
(d) The leave may commence at any time during the 11 weeks preceding the estimated date of delivery.
(e) The employee shall reconfirm make written application to the Institute at least two weeks prior to the date she intends to commence her intention leave. The application shall include a certificate from a legally qualified medical practitioner stating the estimated date of delivery.
(f) No employee shall be required to return to work on earlier than six weeks following her actual date of delivery, nor shall she be permitted to do so unless she has the date originally approved in subsection approval of a legally qualified medical practitioner.
(bg) above by written notification received by the Employer at least four (4) weeks in advance thereof. The employee shall be reinstated in her former position provided the leave taken is not longer than the leave provided by the Act and subject to her former position, unless the position has been discontinued in which case she shall be given a comparable jobstill being available.

That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance benefits and any other earnings. Such payment shall commence following receipt by the Employer shall continue to pay the employer's share of the premium billing for the health and welfare benefits in which the employee is registered at the time of the leave, provided the employee pays her share of the premiums, if any.
(j) Benefits payable under the plan are a sum, which combined with xxxxx X.X. benefits, SUB payments and other earnings equal 95% of the employee's normal weekly earnings.
(k) Payments from the SUB plan are not considered as earnings for Employment Insurance cheque stub as Insurance, but are subject to income tax.
(l) The employee must provide the Employer with proof that she is in receipt of Employment Insurance pregnancy/ parenting benefits, and shall continue while the employee is or is not receiving E.I. benefits before SUB can be paid.
(m) The employer will inform the Canada Employment and Immigration Commission of any changes in receipt of such benefits for a maximum period of seventeen (17) weeks. The employee will endeavour to provide a copy the plan within 30 days of the effective date of the change.
(n) An employee on pregnancy leave will also be eligible for SUB payments when she is not receiving Employment Insurance cheque stub within two (2) weeks of receipt of because she is serving the employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior E.I. waiting period or because she has received all the E.I. benefits payable to the commencement of the leave times her normal weekly hours. (e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.
(f) Parental leave must begin no later than sixty-three (63) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. Pregnancy and Parental Leave. (a) Pregnancy/Parenting A pregnancy employee is entitled to up to seventeen (17) weeks leave will of absence without pay and with accumulation of seniority, for the purpose of childbirth and recovery. The leave of absence shall be granted in accordance with the provisions of the Employment Standards Act, except where amended in this provision.
(b) If possible An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately proceeding the date the leave begins, shall be entitled to parental leave, in accordance with the provisions of the Employment Standards Act. Parental leave must begin no later than fifty-two (52) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. (d) An employee On confirmation by the Unemployment Insurance Commission of the appropriateness of the Home's Supplemental Unemployment Benefit (SUB) plan, a nurse who is on pregnancy leave leave, as provided under this Agreement, agreement who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance pregnancy/ parental benefits pursuant to the Employment Insurance Act unemployment insurance pregnancy benefits, shall be paid a supplemental employment benefitUnemployment Benefit. That The benefit will be equivalent to the difference between seventyeighty-five four percent (7584%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance unemployment insurance benefits and any other earnings. Such payment shall commence following completion of the two (2) week unemployment insurance waiting period, and receipt by the Employer Home of the employee's Employment Insurance nurse’s unemployment insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting unemployment insurance pregnancy benefits, and shall continue while the employee nurse is in receipt of such benefits for a maximum period of seventeen (17) weeks. That benefit will be equivalent to the difference between seventy-five percent (75%) of her/his their regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her/his their weekly Employment Insurance benefits and any other earnings. Such Biweekly payment shall commence following completion of the one (1) week Employment Insurance waiting period, and receipt by the Employer Home of the employee's nurse’s Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen fifteen (1715) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employeenurse’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours. The normal weekly hours for an a part-time employee working shall be calculated by using the same time period used for calculation of the Employment Insurance benefit. The SUB benefit is equivalent to the difference between 84% of the gross regular weekly earnings at Dufferin Oaks and the sum of the gross weekly El benefits less any other earnings. The SUB plan provision is for a maximum of (fifteen) 15 weeks. The SUB calculation is based on the El rate of 55%, less any other earnings. If the length of the leave changes, therefore reducing the El rate, the total payable by Dufferin Oaks would remain the same amount (based on the 55% rate) and the provisions for the (fifteen) 15-week maximum for the SUB plan payment would continue to apply. The employee does not have any vested right except to receive payments for the covered unemployment period. The plan provides that payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan.
(e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.

(h) An employee who is on parental leave as provided under this Agreement, who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance parental benefits pursuant to Section 23 of the Employment Insurance Act shall be paid a supplemental employment benefit. That benefit will be equivalent to the difference between eighty-four (84%) percent of the nurse's regular weekly earnings and the sum of her or his weekly Employment Insurance benefits and any other earnings. Biweekly payment shall commence following completion of the one (1) week Employment Insurance waiting period, and receipt by the Home of the employee's Employment Insurance cheque stub as proof that she or he is in receipt of Employment Insurance parental benefits and shall continue while the nurse is in receipt of such benefits for a maximum period of twelve (12) weeks. The nurse's regular weekly earnings shall be determined by multiplying her or his regular hourly rate on her or his last day worked prior to the commencement of the leave times her or his normal weekly hours. The normal weekly hours for a part-time employee shall be calculated by using the same time period used for calculation of the Employment Insurance benefit. The SUB benefit is equivalent to the difference between 84% of the gross regular weekly earnings at the County of Dufferin and the sum of the gross weekly El benefits less any other earnings. The SUB plan provision is for a maximum of (twelve) 12 weeks. The SUB calculation is based on the El rate of 55%, less any other earnings. If the length of the leave changes, therefore reducing the El rate, the total payable by Dufferin Oaks would remain the (twelve) 12- week maximum for the SUB plan payment would continue to apply. The employee does not have any vested right except to receive payments for the covered unemployment period. The plan provides that payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan.
(i) For the purposes of parental leave, the provisions under (a) and (c) shall also apply.
(j) The Employer shall continue to pay its’ share of the premiums to the various employee benefit plans for nurses who are on pregnancy and parental Leave, provided that the nurse arranges to pay the employee's share of the premiums, if any.
(k) Seniority and service continues to accrue while a nurse is off on pregnancy and parental leave.

An employee must complete 1875 hours of continuous service prior to the expected date of birth to be paid a supplemental unemployment insurance benefit. Such payment shall commence on a monthly basis following completion of the two (2) week Employment Insurance waiting period, and receipt by the Employer of the employee's ’s Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting benefitsMaternity Benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen ten (1710) weeks. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance unemployment benefits and any other earnings. Such payment shall commence following completion of the two-week unemployment insurance waiting period, and receipt by the Employer of the employee's Employment Insurance unemployment insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting the employment insurance pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen fifteen (1715) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours. Effective May 1, 2002, Supplemental Unemployment Benefit will be increased to ninety-three percent (93%).
(c) After confirmation by the Unemployment Insurance Commission of the appropriateness of the Employer's Supplemental Unemployment Benefit (SUB) Plan, an employee, who adopts a child, requests parental leave and commences such a leave as set out above who is in receipt of unemployment insurance parental leave benefits pursuant to Section 18 of The Unemployment Insurance Act, 1971, shall be paid a supplemental unemployment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings and the sum of her weekly unemployment benefits and any other earnings. Such payment shall commence following completion of the two-week unemployment insurance waiting period, and receipt by the Employer of the employee's unemployment insurance cheque stub as proof that she is in receipt of the employment insurance parental leave benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of fifteen (15) weeks. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to commencement of the leave times her normal weekly hours hours.
(d) When persons are hired to replace employees who are on approved pregnancy or parental leave, the period of employment of such persons will not exceed the parental leave. The release or discharge of such persons shall not be the subject of a grievance or arbitration. This clause would not preclude such employees from using the job posting provisions under the Collective Agreement and any successful applicant who has completed his/her probation period will be credited with the appropriate seniority. The Employer will outline to employees selected to fill such temporary vacancies in the presence of a Union Committee person or Xxxxxxx, the circumstances giving rise to the vacancy, and the special conditions relating to such employment. The Employer will furnish a confirming letter to the employee.
(e) SUB payments will be financed by the Employer. A separate accounting will be kept on SUB payments.
(f) The Employer will inform the Canada Employment and Immigration Commission of any changes in the plan within thirty (30) days of the effective date of the change.
(g) Employees do not have a right to SUB payments except for an employee working less than seventy-fivesupplementation of the Unemployment Insurance benefits during the unemployment period as specified in the plan.
(h) Payments in respect of guaranteed annual remuneration or severance pay benefits are not reduced or increased by payments received under this plan.

Pregnancy and Parental Leave. (a) Pregnancy/Parenting Employees are entitled to receive pregnancy, paternal or adoption leave will be granted in accordance with the provisions of the Employment Standards Act, except where amended .
(a) The objective of the supplementary benefit plan is to supplement Employment Insurance benefits up to 95% of the employee’s normal weekly earnings during pregnancy leave. Up to 17 weeks of pregnancy leave will be granted in this provisionaccordance with the Employment Standards Act.
(b) If possible This plan covers only temporary unemployment due to pregnancy. Employees do not have a right to SUB payments except for supplementation of E.I. benefits during the employee shall give written notification at least one (1) month unemployment period as specified in advance of the date of commencement of such leave and the expected date of returnplan.
(c) An employee must apply for and be in receipt of Employment Insurance benefits before SUB can be paid. The employee must meet the requirements of the E.I. Act concerning the period during which pregnancy benefits can be paid.
(d) The leave may commence at any time during the 11 weeks preceding the estimated date of delivery.
(e) The employee shall reconfirm make written application to the Institute at least two weeks prior to the date she intends to commence her intention leave. The application shall include a certificate from a legally qualified medical practitioner stating the estimated date of delivery.
(f) No employee shall be required to return to work on earlier than six weeks following her actual date of delivery, nor shall she be permitted to do so unless she has the date originally approved in subsection approval of a legally qualified medical practitioner.
(bg) above by written notification received by the Employer at least four (4) weeks in advance thereof. The employee shall be reinstated in her former position provided the leave taken is not longer than the leave provided by the Act and subject to her former position, unless the position has been discontinued in which case she shall be given a comparable jobstill being available.
(dh) An The employee who is on shall continue to accumulate vacation credits and seniority during her leave.
(i) During the period of pregnancy leave as provided under this Agreement, who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance pregnancy/ parental benefits pursuant to the Employment Insurance Act shall be paid a supplemental employment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance benefits and any other earnings. Such payment shall commence following receipt by the Employer shall continue to pay the employer's share of the premium billing for the health and welfare benefits in which the employee is registered at the time of the leave, provided the employee pays her share of the premiums, if any.
(j) Benefits payable under the plan are a sum, which combined with xxxxx X.X. benefits, SUB payments and other earnings equal 95% of the employee's normal weekly earnings.
(k) Payments from the SUB plan are not considered as earnings for Employment Insurance cheque stub as Insurance, but are subject to income tax.
(l) The employee must provide the Employer with proof that she is in receipt of Employment Insurance pregnancy/ parenting benefits, and shall continue while the employee is or is not receiving E.I. benefits before SUB can be paid.
(m) The employer will inform the Canada Employment and Immigration Commission of any changes in receipt of such benefits for a maximum period of seventeen (17) weeks. The employee will endeavour to provide a copy the plan within 30 days of the effective date of the change.
(n) An employee on pregnancy leave will also be eligible for SUB payments when she is not receiving Employment Insurance cheque stub within two (2) weeks of receipt of because she is serving the employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior E.I. waiting period or because she has received all the E.I. benefits payable to the commencement of the leave times her normal weekly hours. The normal weekly hours for a regular part-time and/or casual part-time nurse shall be calculated by using the same period used for calculation of the Employment Insurance benefit.
(e) An employee who becomes a parent, and who has been employed for at least thirteen (13) weeks immediately preceding the date the leave begins, shall be entitled to parental leave.
(f) Parental leave must begin no later than fifty-two (52) weeks after the day the child is born or comes into the custody, care and control of the parent for the first time. For employees on pregnancy leave, parental leave will begin immediately after pregnancy leave expires. Parental leave shall be granted for up to thirty-five (35) weeks in duration if the employee also took pregnancy leave and thirty-seven (37) weeks in duration if she did not.
(g) The employee shall give the Employer two (2) weeks’ written notice of the date the leave is to begin unless exempt under the Employment Standards Act. Parental leave ends thirty-five (35) weeks after it began if the employee also took pregnancy leave and thirty-seven (37) weeks after it began if the employee did not or on an earlier day if the employee working less than seventygives the Employer at least four (4) weeks’ written notice of that day.
(h) For the purposes of parental leave, the provisions under (a) and (c) shall also apply.
(i) The Employer will continue to pay the premiums for benefit plans for nurses for a period of up to seventeen (17) weeks while a nurse is on pregnancy leave under Article 14.04 and for a period of up to thirty-fivefive (35) weeks while a nurse is on parental leave under Article 14.04 provided the employee continues to pay his/her share of the premiums.
(j) On confirmation by the Employment Insurance Commission of the appropriateness of the Home’s Supplemental Unemployment Benefit (SUB) Plan, a nurse who is on parental leave as provided under this Agreement who has applied for and is in receipt of Employment Insurance parental benefits pursuant to Section 23 of the Employment Insurance Act shall be paid a supplemental employment benefit. That benefit will be equivalent to the difference between eighty-four percent (84%) of the nurse’s regular weekly earnings and the sum of her or his weekly Employment Insurance benefits and any other earnings. Such payment shall commence following completion of the two week Employment Insurance waiting period, and receipt by the Employer of the employee’s Employment Insurance cheque stub as proof that she or he is in receipt of Employment Insurance parental benefits and shall continue while the nurse is in receipt of such benefits for a maximum period of ten (10) weeks. The nurse’s regular weekly earnings shall be determined by multiplying her or his regular hourly rate on her or his last day worked prior to the commencement of the leave times her or his normal weekly hours. The normal weekly hours for a regular part-time and/or casual part-time nurse shall be calculated by using the same time period used for calculation of the Employment Insurance benefit (currently 28 weeks). The employee does not have any vested right except to receive payments for the covered employment period. The plan provides that payments in respect of guaranteed annual remuneration or in respect of deferred remuneration or severance pay benefits are not reduced or increased by payments received under the plan.

Pregnancy and Parental Leave. (a) Pregnancy/Parenting Pregnancy and parental leave will shall be granted in accordance with the provisions of the Employment Standards ActAmendment Act (Pregnancy and Parental Leave), 1990, as amended, except where amended in this provision.

The employee shall be reinstated to her former position, unless the position has been discontinued in which case she shall be given a comparable job.
(d) An employee who is on pregnancy leave as provided under this Agreement, set out above who has completed five (5) months of continuous service and has applied for and is in receipt of Employment Insurance pregnancy/ parental unemployment insurance pregnancy benefits pursuant to the Employment Section 18 of The Unemployment Insurance Act Act, 1971, shall be paid a supplemental employment unemployment benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings (which for part-time employees shall include percentage-in-lieu) and the sum of her weekly Employment Insurance unemployment benefits and any other earnings. Such payment shall commence following completion of the two-week unemployment insurance waiting period, and receipt by the Employer of the employee's Employment Insurance unemployment insurance cheque stub as proof that she is in receipt of Employment Insurance pregnancy/ parenting the employment insurance pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of seventeen fifteen (1715) weeks. The employee will endeavour to provide a copy of the Employment Insurance cheque stub within two (2) weeks of receipt of the employee’s EI benefit. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours. Pregnancy and Parental Leave.
