Common use of Primary Responsibility Clause in Contracts

Primary Responsibility. The Employer has, under the OHSA, the primary responsibility for ensuring that safe conditions prevail within the workplace, and to take appropriate and effective measures, both preventative and corrective, to protect the health and safety of employees. The parties furthermore agree that all employees have duties to adhere to under the OHSA and shall be guided by all rules, policies and training related to health and safety adopted by the JHSC. Furthermore, the Union acknowledges its responsibilities under the OHSA and shall be guided accordingly.
