Processor and Controller Responsibilities. If European Data Protection Law applies to the processing of Customer Personal Data: a. the subject matter and details of the processing are described in Appendix 1; b. Google is a processor of that Customer Personal Data under European Data Protection Law; c. Customer is a controller or processor, as applicable, of that Customer Personal Data under European Data Protection Law; and d. each party will comply with the obligations applicable to it under European Data Protection Law with respect to the processing of that Customer Personal Data.

Processor and Controller Responsibilities. The parties acknowledge and agree that: (a) Appendix 1 describes the subject matter and details of the processing of Customer Personal Data; (b) Google is a processor of Customer Personal Data under the Data Protection Legislation; (c) Customer is a controller or processor, as applicable, of Customer Personal Data under the Data Protection Legislation; and (d) each party will comply with the obligations applicable to it under the Data Protection Legislation with respect to the processing of Customer Personal Data.

Processor and Controller Responsibilities. If the European Data Protection Legislation applies to the processing of Customer Personal Data, the parties acknowledge and agree that: the subject matter and details of the processing are described in Appendix 1;

Processor and Controller Responsibilities. If the European Data Protection Legislation applies to the processing of Customer Personal Data, the parties acknowledge and agree that: a. Customer is a controller (or processor, as applicable), of the Customer Personal Data under European Data Protection Legislation; b. Upwork is a processor (or subprocessor, as applicable) of the Customer Personal Data under the European Data Protection Legislation; and c. each party will comply with the obligations applicable to it under the European Data Protection Legislation with respect to the processing of that Customer Personal Data.

Processor and Controller Responsibilities. If the European Union Data Protection Legislation applies to the processing of Customer Personal Data, the parties acknowledge and agree that: 5.6.1 The subject matter and details of the processing are described in Appendix A 5.6.2 IRIS Connect is a processor of that Customer Personal Data under the European Union Data Protection Legislation; 5.6.3 The Customer is a controller or processor, as applicable, of that Customer Personal Data under the European Union Data Protection Legislation; and 5.6.4 Each party will comply with the obligations applicable to it under the European Union Data Protection Legislation with respect to the processing of that Customer Personal Data.

Processor and Controller Responsibilities. The parties acknowledge and agree that, except in circumstances where Section 2.10 applies, between TD and Company: (a) TD is a Processor or the equivalent of Company Personal Data under Applicable Privacy Law; (b) Company is a Controller or the equivalent of Company Personal Data under Applicable Privacy Law; and (c) each party will comply with the obligations applicable to it under Applicable Privacy Law with respect to the Processing of Company Personal Data.

Processor and Controller Responsibilities. The parties acknowledge and agree that: (a) Appendix 1 to the Agreement describes the subject matter and details of the processing of User Personal Data; (b) Bitrix24 is a processor (service provider under California Consumer Privacy Act of 2018) of User Personal Data under the Data Protection Legislation; (c) User is a controller or processor, as applicable, of User Personal Data under the Data Protection Legislation; and (d) each party will comply with the obligations applicable to it under the Data Protection Legislation with respect to the processing of User Personal Data; (e) User shall, in its use or receipt of the Services, Process Personal Data in accordance with the requirements of Data Protection Legislation and User will ensure that its instructions for the Processing of Personal Data shall comply with Data Protection Legislation. User shall have sole responsibility for the accuracy, quality, and legality of Personal Data and the means by which User acquired Personal Data.

Processor and Controller Responsibilities. The parties acknowledge and agree that: (a) SmugMug is a processor (or equivalent) of Photographer Personal Data under the Data Protection Legislation; (b) Photographer is a controller (or equivalent) of Photographer Personal Data under the Data Protection Legislation; and (c) each party will comply with the obligations applicable to it under the Data Protection Legislation with respect to the Processing of Photographer Personal Data. For example, under the CCPA, SmugMug is Photographer’s “service provider” with respect to the Photographer Personal Data.

Processor and Controller Responsibilities. The parties acknowledge and agree that: (a) Xxxxxxxxxxxxxxxxxx.xxx is a processor of User Personal Data under the Data Protection Legislation; (b) User is a controller of User Personal Data under the Data Protection Legislation; and (c) each party will comply with the obligations applicable to it under the Data Protection Legislation with respect to the Processing of User Personal Data.

Processor and Controller Responsibilities. The parties acknowledge and agree that: 3.1.1. The subject matter and details of the Processing are described in Appendix 1a and/or Appendix 1b, depending on the Gigamon Offerings at issue; and 3.1.2. Gigamon is a Processor of that Personal Data under Data Protection Legislation, in each case regardless of whether Customer acts as a Controller or as a Processor on behalf of a third-Third-Party Controller. To the extent any Event/Usage Data (as defined in the Agreement) is considered Personal Data under applicable Data Protection Legislation, Gigamon is the Data Controller of such data and shall Process such data in accordance with the Agreement and applicable Data Protection Legislation; and 3.1.3. Customer is a Controller of that Personal Data under Data Protection Legislation; and 3.1.4. Gigamon will inform Customer if it believes that Customer’s instructions with respect to the Processing of Personal Data violate the EU GDPR, UK GDPR or Member State provisions; and 3.1.5. Each party will comply with the obligations applicable to it in such role under the Data Protection Legislation with respect to that Personal Data.
