Product Warranty Limitations. The Séura Limited Warranty is valid only with respect to Products sold in the U.S. or Canada, and extends only to the original purchaser of the Product. The Séura Limited Warranty does not apply to any Product that:
Product Warranty Limitations. All Nokia warranties exclude the following: (a) Maintenance, repair or replacement necessitated by loss or damage resulting from any cause other than normal use and operation of the product in accordance with the Nokia’s specifications and product manual, including but not limited to: theft, exposure to weather conditions, use of the product underwater or in wet environments, operator negligence, misuse, abuse, improper electrical/power supply; (b) Failure due to computer viruses, malware, or any other malicious software programs that harm or disrupt normal operation of the product; (c) Alterations, modifications or repairs by Buyer or unauthorized third parties; (d) Accident, disaster, improper handling or storage, droppage, modification to the camera, opening the camera body, use of third party accessories or acts of nature or any other peril originating from outside the product; (e) Transportation damage (except for transportation damaged in delivery of the products to Buyer from Nokia), lack of maintenance, defective batteries, battery leakage; (f) Cosmetic damage or other non-operating parts; (g) Using a product in a manner other than intended usage for that product; and (h) Charges related toNo Trouble Found” diagnosis. The Nokia Extended Warranty Plan also excludes coverage of accessories that came with the Nokia OZO camera.
Product Warranty Limitations. The Product Warranty does not apply to any Product that: (a) has been subjected to use contrary to any instructions issued by Seller, including, without limitation, any of the following to the extent specifically defined in such instructions: abuse, misuse, neglect, negligence, accident, improper testing, improper installation, improper storage, improper handling, abnormal physical stress or abnormal environmental conditions; NOTE: PORTIONS OF THIS EXHIBIT INDICATED BY [****] ARE SUBJECT TO A CONFIDENTIAL TREATMENT REQUEST, AND HAVE BEEN OMITTED FROM THIS EXHIBIT. (b) has not been used, stored and maintained in accordance with the documentation therefor; or (c) has been reconstructed, repaired or altered by Persons other than Seller or its authorized Representative. Buyer shall notify Seller of any changes to the documentation for any Product relating to the use, storage or maintenance thereof and shall make commercially reasonable efforts to address any concerns expressed by Seller that such changes would impair the reliability or durability of such Products.

Product Warranty Limitations. Notwithstanding Sections 8.2 or 8.5(a), Seller and Parent shall only be required to indemnify Buyer with respect to Losses relating to Product Warranty Claims to the extent such Losses exceed $20,000. Losses with respect to Product Warranty Claims shall not be considered in determining whether the $20,000 threshold set forth in Section 8.5(a) shall have been exceeded. In connection with Product Warranty Claims, Buyer shall use its best efforts to mitigate the costs incurred in connection with effectively remedying customer complaints. If Buyer has incurred or reasonably anticipates incurring Losses in excess of $40,000 with respect to any specific contract or order for which Seller is required to indemnify Buyer (a "Large Warranty Claim"), Buyer shall notify Seller of such Large Warranty Claim. Within 10 days of such notice, Seller may request that Buyer provide Seller with all information that Seller shall reasonably request with respect to the Large Warranty Claim. Seller shall have 10 days after receipt of such information to notify Buyer that Seller wishes to assume control of the Large Warranty Claim at Seller's sole cost and expense. Buyer agrees that it will allow Seller to have reasonable access to the drawings, plans and other technical data with respect to the Large Warranty Claim in the event that Seller assumes control of such claim.
Product Warranty Limitations. Seller acknowledges that the Product Warranty does not apply to any Battery that: (a) has been subjected to abuse, misuse, neglect, negligence, accident, improper testing, improper installation, improper storage, improper handling, abnormal physical stress, abnormal environmental conditions or use contrary to any instructions issued by Seller; (b) has been reconstructed, repaired or altered by Persons other than Seller or its authorized Representative; or (c) has been used with any hardware or product that has not been previously approved in writing by Seller.
