PROGRAMMING/NUMBER OF EXHIBITIONS. Notwithstanding anything contained herein to the contrary, Licensee agrees that (i) no more than 20% of the programming available on the Licensed Service shall be Adult Programs during the term hereof, (ii) no Adult Program shall be exhibited, promoted or listed on the same or previous screen (other than the home page of the Licensed Service, which may contain a textual link with a section of the user interface exhibiting, promoting or listing Adult Programs) as a screen on the Licensed Service on which an Included Program is promoted or listed, (iii) no Adult Program will be classified within the same genre/category as any Included Program. If Licensee violates the terms of this Section 5.2 with respect to the Licensed Service, then Licensor shall have the right to cause Licensee to immediately cease exploiting any or all Included Programs. PROGRAMMING/NUMBER OF EXHIBITIONS. 5.1 All Included Programs shall be made available to Subscribers on the Licensed Service during their License Periods in Licensee’s sole discretion.
PROGRAMMING/NUMBER OF EXHIBITIONS. 5.1 Each Licensed Film is licensed for an unlimited number of exhibitions. Each of the Licensed Films shall be made available continuously on the Licensed Service for the minimum time period specified below, subject to the relevant Licensed Film’s License Period and any earlier termination of the relevant Licensed Film’s License Period, (“Minimum Exhibition Commitment”) and shall be made available in the percentage of the Roombase specified below.
PROGRAMMING/NUMBER OF EXHIBITIONS. All Included Programs shall be made continuously available to Subscribers on the Licensed Service during their respective License Periods.
PROGRAMMING/NUMBER OF EXHIBITIONS. 4.1 All Included Programs shall be made continuously available to Subscribers on the VOD Service during their License Periods, it being understood that if Licensor withdraws an Included Program pursuant to Section 5 below, Licensee shall not be in breach of this Section 4.1 with respect to such withdrawn Included Program.
PROGRAMMING/NUMBER OF EXHIBITIONS. 4.1 All Included Programs shall be made available to Subscribers on the Licensed Service during their License Periods at Licensee’s sole discretion. Licensee shall be entitled to notify Licensor of the various genres/categories (e.g., drama, comedy, horror, suspense, romance, etc.), in which programs will generally be classified on the Licensed Service. Licensee shall have the right if it so wishes to put the content in other appropriate genres for repurposing the content, to deliver optimal returns for Licensor
PROGRAMMING/NUMBER OF EXHIBITIONS. Each Licensed Program is licensed for an unlimited number of exhibitions during its respective License Period. Each Licensed Program shall be exhibited in its entirety and shall not be divided in any way into segments of any kind for the exhibition in segments. No programming shall be exhibited within a period of at least five (5) seconds of any Licensed Program (a “Delay Period”). In addition, nothing other than “black” or graphics shall be exhibited during any Delay Period, and in such event solely in a manner which clearly distinguishes the Licensed Program from such other programming.
PROGRAMMING/NUMBER OF EXHIBITIONS. 4.1 All FVOD Included Programs shall be made continuously available to Subscribers on the FVOD Service during their License Periods, it being understood that if Licensor withdraws an FVOD Included Program pursuant to Section 5 below, Licensee shall not be in breach of this Section 4.1 with respect to such withdrawn FVOD Included Program.
