Project Ownership. OSMB acknowledges and agrees that the Project is the exclusive property of the Recipient. OSMB is neither responsible nor liable in any manner for the construction, operation or maintenance of the Project.
Project Ownership. Except as provided in Section 9, Provider (including any successors or assigns) or Financing Party shall be the legal and beneficial owner of the Project at all times. The Project is personal property and shall not attach to or be deemed a part of, or fixture to, the Site. The Project shall at all times retain the legal status of personal property as defined under Article 9 of the Uniform Commercial Code. Host covenants that it will place all persons having an interest in or lien upon the real property comprising the Premises, on notice of the ownership of the Project and the legal status or classification of the Project as personal property. Host and/or Provider shall make any necessary filings to disclaim the Project as a fixture of its respective Premises and Site in the appropriate Land Registry to place all interested parties on notice of the ownership of the Project by Provider.
Project Ownership. Any tangible asset created through a Community Development Project will be owned and operated by the Project Sponsor.
Project Ownership. LTC shall have sole ownership of the Project and shall be solely responsible for the construction, operation, and maintenance of the Project.

Project Ownership. You understand and agree that this Agreement is for the Services and is not a contract to sell or lease the Project to You or a contract to sell energy to You. Provider (or its designee) owns the Project and the energy produced by it for all purposes.
Project Ownership. The County will be the owner of the Project during construction. After the County’s final acceptance of the Project as complete, the County shall convey the portions of the Project to the City of Katy, the City of Fulshear and Waller County, within each entity’s jurisdiction. Such conveyance shall be subject to, and the County shall require all such entities to agree to honor in all respects, the curb cuts and access arrangements and facilities included within the Plans. The Parties agree to negotiate in good faith to establish a common maintenance authority and schedule for the entire corridor.
Project Ownership. 15. It is agreed that the intersection streetlights at the intersection of Xxxxx Road 20 and Xxxxxxx Drive shall be under the jurisdiction of the County and that the County shall be responsible for the hydro, operating and maintenance costs of the intersection streetlights.
Project Ownership. (1) Unless expressly provided to the contrary in a PROGRAM SUPPLEMENT, subject to the terms and provisions of this AGREEMENT, ADMINISTERING AGENCY, or a designated subrecipient acceptable to STATE, as applicable, shall be the sole owner of all improvements and property included in the PROJECT constructed, installed or acquired by ADMINISTERING AGENCY or subrecipient with funding provided to ADMINISTERING AGENCY under this AGREEMENT. ADMINISTERING AGENCY, or subrecipient, as applicable, is obligated to continue operation and maintenance of the physical aspects of the PROJECT dedicated to the public transportation purposes for which PROJECT was initially approved unless ADMINISTERING AGENCY, or subrecipient, as applicable, ceases ownership of such PROJECT property; ceases to utilize the PROJECT property for the intended public transportation purposes; or sells or transfers title to or control over PROJECT and STATE is refunded the Credits due STATE as provided in paragraph (4) herein below.
