Whenever any qualified bargaining unit employee hired before October 28, 1990 pre-bids the entry-level position vacancy, the City must select from among those bargaining unit employee pre-bidders. Whenever no qualified bargaining unit employee hired before October 28, 1990, pre-bids, the City may select any applicant to fill the entry-level position vacancy. For each even-numbered entry-level position vacancy which subsequently occurs, the City may refrain from following the procedures set forth above and may select any applicant for an entry-level position vacancy which in the judgment of the City is best qualified for said position vacancy.
(a) Pre-bids made by Regular employees who are in the Division or Department, as applicable, in which the vacancy exists who hold a classification the same or higher than that in which the job vacancy exists. The word “same” is in reference to the Lines of Progression and not wages.
(b) Pre-bids made by Regular employees who are in the Division or Department, as applicable, in which the vacancy exists who are at the top rate of pay of the next lower classification in the normal line of progression.
(c) Pre-bids made by Regular employees who hold a classification the same or higher than that in which the job vacancy exists who are assigned to any other Division or Department.
(d) Pre-bids made by Regular employees who are at the top rate of pay of the next lower classification in the normal line of progression who are assigned to any other Division or Department.
(e) Pre-bids made by Regular employees who are in the Division or Department as applicable in which the vacancy exists who hold classifications other than those listed above.
(f) Pre-bids made by Regular employees who are outside of the Division or Department as applicable in which the vacancy exists who hold any classification other than those listed above. Whenever the City is unable to fill any position vacancy covered by this Memorandum of Understanding as set forth above, the City shall give consideration to those employees who are qualified and covered by any other Memorandum of Understanding between the City and the Union, prior to the City employing any other person for a position covered by this Memorandum of Understanding.
11.2 The City shall in not more than twenty-one (21) working days from the date the position vacancy is filled, post on the designated bulletin boards a notice regarding the disposition of the position with the name of the applicant selected, and mail a copy of such notice to the Union’s Business Representative together with a list of all applicants for the position.
11.3 Any Regular employee of the City as defined in 7.2 may submit a pre-bid on any existing job classification and location or shift within the same Department or Division for which the employee desires consideration. The pre-bid must be submitted on a form provided by the City’s Personnel Department. At the time the form is delivered to the Personnel Department, it will be dated and receipted and a photocopy provided to the employee. The City shall not consider original pre-bids for any position vacancies which are submitted less than eight (8) calendar days prior to the filling of a job vacancy. Pre-bids will be valid until such time as the employee changes classifications, or until fifteen (15) calendar days have elapsed from such time as the employee rejects a permanent appointment to the classification and location on which the pre-bid is made. The City shall post, for a minimum of fifteen (15) calendar days, all newly created positions, classifications, shifts, or reclassifications of existing vacant positions.

(a) Notice of each such job vacancy or new job opportunity shall be posted on employee bulletin boards for a period of seven ten (710) calendar days working days. (b) All regular employees shall be eligible to bid on all such vacancies or new job opportunities.

Notice of such award shall be posted within ten (10) working days following the close of the posting period.

Any bidder who is determined not to be qualified by the District for any job vacancy shall be notified by the District in writing within 10 days of the awarding of the position as to why they were not qualified. And upon request the employee will be provided counseling to point out areas where improvement is possible along with a review of missed test questions.
2. The job vacated by the successful bidder shall not be filled on a permanent basis for 120 days.
(e) A bidder who is awarded and placed in a job in the classification and location of then who, within 120 days, withdraws or is unable to perform the jobjob as determined by the District's evaluation system, its duties, qualifications required and shall be returned to the rate of payposition from which he/she bid.
1. Employees shall be evaluated during the 120 day period by the immediate supervisor or Department Head. Evaluations shall be conducted as follows:
A. Every two weeks, for the first two months and at least twice more during the final two months.
B. The Supervisor and employee shall establish goals in areas where improvement is needed.

A promotion to a higher paid classification which provides a five percent (75%) calendar days and wage increase does not change the anniversary date for Wage Step increases.
11.4 All appointments filled by promotion of a City employee shall set forth be on a probationary basis for one (1) year. At any time during the date of postingprobationary period, the City may terminate the appointment. If an appointment is terminated, the employee shall be returned to either their previous classification and location of wage rate, or some other classification that is mutually satisfactory to both the job, its duties, qualifications required employee and the rate of payCity. 10.2 (a) In filling job vacancies under this Article the Company will select the senior applicant who has the skill, ability and qualifications necessary to perform the work required. The Agency assessment of skill, ability and qualifications includes consideration of the employee's performance in his/her current position.
(a) The Company shall within not less than seven be required to post a job vacancy for a material handler or where an employee with return or re-hiring rights under 12.03 and 12.04 would be affected. Employees interested in material handler positions may submit their names to the Human Resources department from which senior employees will be selected in the future.
(7b) calendar Any posted jobs may be filled on an interim basis in order to provide continuity and maintain efficiency
13.04 Temporary Assignments
(a) When an opening occurs in Class 4 or higher for the first 30 days nor the Company can assign any available operator. When it is certain the vacancy will be more than twelve 30 days the Company will offer the job to the most senior utility person on the shift where the vacancy is. If the most senior utility person on the shift does not accept then offer to the next senior utility person, and so on. If no other utility person on the shift accepts, then the junior utility person on the shift will be required to fill the vacancy. The Company will fill the utility job from existing personnel on the shift where the vacancy is.
(12b) calendar When an opening occurs in Class 3 or lower for the first 30 days from the original date of postingCompany can assign any available operator. When it is certain the vacancy will be more than 30 days the Company will offer the job to the most senior material handler on the shift where the vacancy is. If the most senior material handler on the shift does not accept then offer to next senior person, post and so on. If no other material handler on all bulletin boardsthe shift accepts, then the junior material handler on the shift will be required to fill the vacancy.
(c) When a notice regarding Utility Operator or a Material Handler has accepted or been assigned to a Temporary position which it is certain will be more than 30 days, he/she shall be considered unavailable for any other Temporary assignment.
(d) Employee who fills a temporary position will have the disposition least seniority in that position only.
(e) Upon the return of the posted vacancy with regular incumbent the name employee assigned to the Temporary position shall return to the position to which he/she is entitled under the terms of the applicant, if any, awarded the job, and mail a copy of such notice to all recognized employee organizations together with a list of all bidders on the jobthis Collective Agreement.
10.3 (f) In filling vacancies, the Agency will give preferential consideration event that his/her position is not available he/she shall be entitled to the applicant's length of service bump in accordance with Agency and will consider the applicant's knowledge, skill, efficiency, adaptability and the physical ability required for the job. Notwithstanding anything contained herein, Agency need not consider the bid of any employee who does not possess the knowledge, skill, efficiency, adaptability and physical ability required for the job on which the bid is madeArticle 12.
10.4 All positions filled by promotion of (g) When an Agency employee has been absent for one (1) year his/her job shall be subject posted as a regular job bid. The job can be posted earlier upon mutual agreement between the Company and Union. Upon the employee’s return he/she shall be entitled to a twelve (12) month probationary period, provided that any such employee who the Agency determines cannot successfully perform the duties of the new position during the probationary period will be returned return to his/her former position held prior job provided he/she has the seniority to do so. If he/she does not have the seniority then he/she would be entitled to bump.
(h) In the event a Temporary Assignment becomes available for a protected job (as identified in Article 12.03) the following selection process shall be applied:
a. For the first 30 days the Company can assign any available operator.
b. When it is known that the vacancy will be more than 30 days, the Company will post a Temporary Job Bid in accordance with the terms of Article 13.01 (a) (b).
c. Applicants to the promotionjob bid will be subject to the same testing criteria utilized for the position on a regular job bid process.
10.5 Employees d. In filling the Temporary vacancy, the Company will select the senior applicant who complete an Agency apprenticeship program has the skill, ability and qualifications necessary to perform the work required. The assessment of skill, ability and qualifications includes consideration of the employee’s performance in his/her current position.
e. An employee who has accepted or been assigned to a Temporary position which it is certain will not be more than 30 days, shall be considered unavailable for any other Temporary position.
f. The terms of Article 13.04 (d), (e), (f), and (g) shall also apply
(a) When a position for days becomes available or is created, the Company will bid the position. All employees, including those who currently hold the same position, will be eligible to bid. The vacancy will be filled in accordance with Article 13.01. This will not apply for another apprenticeship program until they have completed to vacancies created through layoff or shift reduction.
(b) When a time equal position becomes available on a preferential shift (any shift other than straight days), it will be offered to the length of the apprenticeship senior employee in the journeyman position subsequent required in the order of seniority.
(c) For the purpose of article 13.05 shift changes of less than fifteen (15) days are not deemed to their trainingcreate an available position.
(a) When an operation runs, or is expected to run, an average of 24 hours per week in an 8 week period the senior person in the job will be offered a shift preference if there is one.
(b) The Company and the Union agree to review all positions pertaining to this Article on a monthly basis to determine whether the position should be bid or otherwise filled. The Apprenticeship Committee This determination would be based principally upon known or anticipated order intake.
13.07 Where employees involved in rotating shifts can mutually agree among themselves, on a shift preference, the Company will allow this exception. This agreement shall make recommendation be in writing and submitted to the Labor Committee where Company and the Union. If an employee leaves the shift arrangement a natural line of progression would supersede new arrangement must be agreed to. Failing a new agreement the proceeding provisionshift rotation as per collective agreement shall be enforced.

Should the employee fulfill the requirements of the job, its duties, qualifications required and the rate of pay. Employees may submit bids on such vacancies by United States mail new position to the Office satisfaction of the Agency Employer, she shall be declared permanent in the new position. If the employee fails to meet the requirements of the new position or if the employee requests to be returned to her former position at any time before she is declared permanent in the new position, she shall be returned to her former position and the Agency shall not consider any bids postmarked more than wage rate.
(d) Within seven (7) calendar days from of the date of posting.

The temporary vacancy then becomes a permanent vacancy and (a), if any(c) and (d) would then apply.
12.04 When a new classification (which is covered by the terms of this Collective Agreement) is established by the Employer, awarded the jobEmployer shall determine the rate of pay for such new classification and notify the Local Union of the same. If the Local Union challenges the rate, and mail it shall have the right to request a copy meeting with the Employer to endeavour to negotiate a mutually satisfactory rate. Such request will be made within ten (10) days after the receipt of notice from the Employer of such notice to all recognized employee organizations together with a list of all bidders on the job.
10.3 In filling vacancies, the Agency will give preferential consideration new occupational classification and rate. Any change mutually agreed upon resulting from such meeting shall be retroactive to the applicant's length of service with Agency and will consider the applicant's knowledge, skill, efficiency, adaptability and the physical ability required for the job. Notwithstanding anything contained herein, Agency need not consider the bid of any employee who does not possess the knowledge, skill, efficiency, adaptability and physical ability required for the job on which the bid is made.
10.4 All positions filled by promotion of an Agency employee shall be subject to a twelve (12) month probationary period, provided date that any such employee who the Agency determines cannot successfully perform the duties notice of the new rate was given by the Employer. If the parties are unable to agree, the dispute concerning the new rate may be submitted to arbitration as provided in the Agreement within fifteen (15) days of such meeting. 12.05 For purposes of application of seniority under this Agreement but not for purposes of service, benefits or pay (save as expressly provided in this Agreement):
(a) An employee whose status is changed from part-time to full-time will receive a seniority position during on the probationary period basis of 1,650 hours worked equals one
(1) year.
(b) An employee whose status is changed from full-time to part-time shall transfer her full seniority to the part-time position and will continue to accumulate seniority in accordance with Article 11.01 b).
12.06 An employee may make a written request indicating her interest in working elsewhere in the Home, and her application shall be considered when a permanent vacancy occurs. The request will be returned to his/her former position held prior to the promotionvalid for a period of six (6) months.
10.5 Employees who complete an Agency apprenticeship program will not be eligible to apply for another apprenticeship program until they have completed a time equal to the length of the apprenticeship in the journeyman position subsequent to their training. The Apprenticeship Committee shall make recommendation to the Labor Committee where a natural line of progression would supersede the proceeding provision.

PROMOTION AND TRANSFER. 10.1 When new jobs 12.1 Employees shall be encouraged to learn the duties of other positions and every opportunity shall be afforded to learn the work of such positions in their own time, and during regular working hours when it will not unduly interfere with the performance of their assigned duties. An employee who has been provided training that was paid for by the Company shall be required to work the following minimum hours in the classification for which Agency intends trained: 48 hours to fill60 hours 1440 hours 61 - 120 hours of paid training 2160 hours 120 hours or more of paid training 4320 hours Life Raft Maintainers being trained for certification through the Company shall be required to work a minimum of four years inclusive of the training period. In filling vacancies in accordance with Article 13.5, the Agency shall post junior qualified employee who has not fulfilled their commitment as per the above, will be required to accept assignment. In the event that all qualified employees have fulfilled their commitment, the junior qualified immediately available will be required to fill the vacancy.
12.4 Should the senior eligible employee be unavailable for initial assignment at the time the vacancy notices on all bulletin boards and a copy occurs, they shall be mailed required to displace the junior employee assigned in their place immediately upon their availability. If the vacancy no longer exists at that time, the senior employee must accept assignment at the first opportunity for which they are available in order to be awarded a seniority date immediately senior to the recognized junior employee organizationfirst assigned. Vacancy notices shall be posted for a period of seven (7) calendar days and shall set forth the date of posting, the classification and location of the job, its duties, qualifications required and the rate of pay. (e) The position of an Employee appointed to fill a permanent vacancy described in (a) above would remain as a temporary vacancy until the successful candidate for the first vacant position has been declared permanent in her new position as described in (c) above. The temporary vacancy then becomes a permanent vacancy and (a), if any(c) and (d) would then apply.
12.04 When a new classification (which is covered by the terms of this Collective Agreement) is established by the Employer, awarded the jobEmployer shall determine the rate of pay for such new classification and notify the Local Union of the same. If the Local Union challenges the rate, and mail it shall have the right to request a copy meeting with the Employer to endeavour to negotiate a mutually satisfactory rate. Such request will be made within ten (10) days after the receipt of notice from the Employer of such notice to all recognized employee organizations together with a list of all bidders on the job.
10.3 In filling vacancies, the Agency will give preferential consideration new occupational classification and rate. Any change mutually agreed upon resulting from such meeting shall be retroactive to the applicant's length of service with Agency and will consider the applicant's knowledge, skill, efficiency, adaptability and the physical ability required for the job. If the parties are unable to agree, the dispute concerning the new rate may be submitted to arbitration as provided in the Agreement within fifteen (15) days of such meeting. 12.05 For purposes of application of seniority under this Agreement but not for purposes of service, benefits or pay (save as expressly provided in this Agreement):
(a) An Employee whose status is changed from part-time to full-time will receive a seniority position during on the probationary period basis of 1,650 hours worked equals one (1) year.
(b) An Employee whose status is changed from full-time to part-time shall transfer her full seniority to the part-time position and will continue to accumulate seniority in accordance with Article 11.01 b).
12.06 An Employee may make a written request indicating her interest in working elsewhere in the Home,and her application shall be considered when a permanent vacancy occurs. The request will be returned to his/her former position held prior to the promotionvalid for a period of six(6)months.
10.5 Employees who complete an Agency apprenticeship program will not be eligible to apply for another apprenticeship program until they have completed a time equal to the length of the apprenticeship in the journeyman position subsequent to their training. b. Among the applicants who meet the above requirements, the most senior applicant shall be interviewed.
Section 5. Upon accepting the awarded position, the successful applicant may elect to return to his/her former position if vacant within fourteen (14) calendar days from the first day in the new position. Such employee shall not be permitted to bid on another position within twenty-four (24) months of such self- terminated bid.
Section 6. Employees may not bid to transfer to another position before working six (6) months in their current position or if the employee has received a written warning or above within twelve (12) months of the job bid opportunity, except in the case where an employee has accepted a part time position and a full time position becomes available in the same department. An employee who has been provided training that was paid for by the Company shall be required to work the following minimum hours in the classification for which Agency intends trained: 12 - 47 hours of paid training 720 hours 48 - 60 hours of paid training 1440 hours 61 - 120 hours of paid training 2160 hours 121 hours or more of paid training 4320 hours Life Raft Maintainers being trained for certification through the Company shall be required to fillwork a minimum of the duration of that certification. In filling vacancies in accordance with Article 13.21, the Agency shall post junior qualified employee who has not fulfilled their commitment as per the above, will be required to accept assignment. In the event that all qualified employees have fulfilled their commitment, the junior qualified immediately available will be required to fill the vacancy.
12.4 Should the senior eligible employee be unavailable for initial assignment at the time the vacancy notices on all bulletin boards and a copy occurs, they shall be mailed required to displace the junior employee assigned in their place immediately upon their availability. If the vacancy no longer exists at that time, the senior employee must accept assignment at the first opportunity for which they are available in order to be awarded a seniority date immediately senior to the recognized junior employee organizationfirst assigned. Vacancy notices shall be posted for a period of seven (7) calendar days and shall set forth the date of posting, the classification and location of the job, its duties, qualifications required and the rate of pay. The vacancy will be filled in accordance with the provisions of seven Article In filling job vacancies under this Article the Company will select the senior applicant who has the skill, ability and qualifica- tions necessary to perform the work required. The assessment of skill, ability and qualifications includes consideration of the em- ployee's performance in his current position. The Company shall not be required to post a job vacancy for a material handler or where an employee with return or rights under and would be affected. If a new ma- terial handler position for days becomes available, the Company would bid the position. Employees interested in other material handler positions may submit their names to the Human Re- sources department from which senior employees will be selected in the future. A posted job may be filled on an interim basis in order to provide continuity and maintain efficiency. Temporary job vacancies (7in excess of thirty (30) calendar days days) will be posted and shall set forth the date of posting, the classification filled in accordance with Sections and location of the jobCollective Agreement. The employee who fills the vacancy will return to his previous job upon the return of the regular incumbent. This procedure will continue as necessary until such time as an employee is returned to a job in Classification following which the employee whom he displaces will be trans- ferred to any position which is at that time vacant in Classification or to a job in Classification (plant wide). Where a regular day shift job becomes available it will nor- mally be offered to the senior employee in the position required who is working on shift. It is recognized that in some cases cause of production needs or training requirements it will be nec- xxxxxx to retain senior on shift and/or junior employees on days. The Company agrees to its best efforts to allow se- nior employees in n position to advantage of opportunities for regular day shift jobs in their position. It is recognized provisions of this article do not affect the selection of employees for lead hand positions. Where an employee is selected to fill a vacancy em- ployee, its dutiesunless there are extenuating circumstances, qualifications required will be trans- ferred to the position within thirty (30) days of selection. the transfer is to be delayed beyond thirty (30) days the Company will advise the affected employee when the transfer will take place and allow the employee the option of declining the transfer. If after days the transfer has not the em- ployee will of the rate of pay. Employees may submit bids on such vacancies by United States mail to the Office of the Agency and the Agency shall not consider any bids postmarked more than seven (7) calendar days from the date of posting.
10.2 The Agency shall within not less than seven (7) calendar days nor more than twelve (12) calendar days from the original date of posting, post on all bulletin boards, a notice regarding the disposition of the posted vacancy with the name of the applicant, if any, awarded the job, and mail a copy of such notice to all recognized employee organizations together with a list of all bidders on the job.
10.3 In filling vacancies, the Agency will give preferential consideration to the applicant's length of service with Agency and will consider the applicant's knowledge, skill, efficiency, adaptability and the physical ability required for the job. Notwithstanding anything contained herein, Agency need not consider the bid of any employee who does not possess the knowledge, skill, efficiency, adaptability and physical ability required for the job on which the bid he is madeperform- ing or job has applied to.
10.4 All positions filled by promotion of an Agency employee shall be subject to a twelve (12) month probationary period, provided that any such employee who the Agency determines cannot successfully perform the duties of the new position during the probationary period will be returned to his/her former position held prior to the promotion.
10.5 Employees who complete an Agency apprenticeship program will not be eligible to apply for another apprenticeship program until they have completed a time equal to the length of the apprenticeship in the journeyman position subsequent to their training. The Apprenticeship Committee shall make recommendation to the Labor Committee where a natural line of progression would supersede the proceeding provision.

PROMOTION AND TRANSFER. 10.1 When All vacancies or new jobs job opportunities resulting from new or additional jobs are createdjobs, voluntary resignations, terminations, death, retirement, bidding out from the classification, or vacancies other than temporary occur within a permanent increase in the Agencywork force, regardless of bargaining unitupon determination by the District that such vacancy need be filled, which Agency intends to fill, the Agency shall post vacancy notices on all bulletin boards and a copy shall be mailed to filled in accordance with the recognized employee organization. Vacancy notices following procedure:
(a) Notice of each such job vacancy or new job opportunity shall be posted on employee bulletin boards for a period of seven ten (710) calendar days working days. The notice shall be communicated to all work groups and shall set forth the job classification and location and the estimated report date and any required qualifications and testing.
(b) All regular employees shall be eligible to bid on all such vacancies or new job opportunities.
(c) Only bids received during the posting periods set forth above shall be considered by the District.
(d) The bidder having the highest seniority and who is qualified to perform the job, as determined by the District, shall be awarded such job vacancy posted for bid pursuant to the provisions of posting, this Section. Notice of such award shall be posted within ten (10) working days following the close of the posting period.
1. Any bidder who is determined not to be qualified by the District for any job vacancy shall be notified by the District in writing within 10 days of the awarding of the position as to why they were not qualified. And upon request the employee will be provided counseling to point out areas where improvement is possible along with a review of missed test questions.
2. The job vacated by the successful bidder shall not be filled on a permanent basis for 120 days.
(e) A bidder who is awarded and placed in a job in the classification and location of then who, within 120 days, withdraws or is unable to perform the jobjob as determined by the District's evaluation system, its duties, qualifications required and shall be returned to the rate of payposition from which he/she bid.
1. Employees shall be evaluated during the 120 day period by the immediate supervisor or Department Head. Evaluations shall be conducted as follows:
A. Every two weeks, for the first two months and at least twice more during the final two months.
B. The Supervisor and employee shall establish goals in areas where improvement is needed.
(f) In the event there are no bidders or no successful bidders, the District may submit bids on such vacancies fill the vacancy by United States mail assignment of a new employee hired to fill the Office of vacancy or by filling the Agency and vacancy with a non- bargaining unit employee found, by the Agency shall not consider any bids postmarked more than seven (7) calendar days from District, to be the date of postingmost qualified applicant.

10.5 Employees who complete an Agency apprenticeship program will not be eligible to apply for another apprenticeship program until they have completed a time equal to the length of the apprenticeship classification in the journeyman position subsequent to past two (2) years shall retain their training. The Apprenticeship Committee shall make recommendation to the Labor Committee where a natural line of progression would supersede the proceeding provisionpreviously held step within said classification.
