PROPERTY SUBJECT TO LEASE. Lessor, hereby leases unto Lessee for the term and upon the rental conditions described herein, for the exclusive and non-exclusive use, by Lessee, together with Lessee's Affiliates and Ground Handling Contractor as designated in Exhibit B Affiliates & Ground Handling Contractors, incorporated herein by this reference and made a part of this Agreement, whose operations also shall be considered that of "Lessee" hereunder, for the purpose described in paragraph 2 below, certain real property located within the Airport Terminal, referred to as Airline Space #1 and more specifically described in Paragraph 3 below, and further delineated in Exhibit A JetBlue Airways Corporation 2020-21 Operating Season, incorporated herein by this reference ("Premises" or "Exclusive Space").
PROPERTY SUBJECT TO LEASE. Collectively, the Premises and the Non-Exclusive Use Areas constitute the “Property”. Tenant desires to utilize the Property for the Business Objective and for vehicular and pedestrian movements, employee parking, lunchroom, and restroom use, and to work compatibly with the District’s obligations to manage the Property, all in support of Tenant’s Business Objective. The term “Site” as used in this Lease includes the Property and all other portions of the PHMRF that Tenant may not access or utilize.
PROPERTY SUBJECT TO LEASE. Notwithstanding provisions to the contrary in this agreement, to the extent that obligations, indemnities or liabilities that an owner of real property would ordinarily bear have become obligations of the tenant under the Price Lease, such obligations, indemnities and liabilities shall herein be the obligations of the tenant under the Price Lease, and Good News Salisbury, Inc. hereby covenants that if the tenant under the Price Lease fails to perform any of such obligations, honor such indemnities, or discharge such liabilities, Good News Salisbury, Inc. shall perform any of such obligations, honor each of such indemnities, and discharge all of such liabilities, and this covenant shall survive the Closing of the transactions contemplated herein and continue for the remainder of the term of the Price Lease. The Seller hereby agrees to take all steps necessary to present this Agreement to the tenant under the Price Lease, in conformity therewith, and to notify the Partnership promptly if (a) the tenant under the Price Lease exercises its right to purchase the Property and if such tenant in fact purchases the Property, then all of the Partnership's obligations hereunder shall cease and determine, or (b) if the tenant under the Price Lease fails to exercise its right of first refusal, then Seller shall (i) notify the partnership, and (ii) ...
