Provisions Controlling. Xxxxxx further agrees that in the event of conflicting language between this “Equipment Lease Attachment” and Xxxxxx's printed form, this “Equipment Lease Attachment” shall take precedence.
Provisions Controlling. Contractor further agrees that in the event of conflicting language between this Agreement and Contractor’s printed form, the provisions of this Agreement shall take precedence.
Provisions Controlling. Sub-Contractor agrees that in the event of conflicting language between this Attachment and the agreement between the Prime Contractor and Sub-Contractor, the provisions of this Attachment shall take precedence.
Provisions Controlling. Contractor further agrees that in the event of conflicting language between this “Equipment Maintenance Attachment” and Contractor's printed form, the provisions of this “Equipment Maintenance Attachment” shall take precedence.
Provisions Controlling. Lessor further agrees that in the event of conflicting language between this “Equipment Lease” and Lessor's printed form, this “Equipment Lease” shall take precedence.
Provisions Controlling. Subject to the survival of the Sections identified in Section 10.5.1, above, if this Agreement is terminated prior to expiration of the term specified in Article 2, this Agreement shall be of no further force or effect. Contractor shall transfer title to City of any deliverables created for City pursuant to this Agreement, and deliver in the manner, at the times, and to the extent, if any, directed by City, any work in progress, completed work, supplies, equipment, and other materials produced as a part of, or acquired in connection with the performance of this Agreement, and any completed or partially completed work which, if this Agreement had been completed, would have been required to be furnished to City. This subsection shall survive termination of this Maintenance Agreement.
Provisions Controlling. Contractor agrees that in the event of conflicting language between this “Software Maintenance Agreement” and Contractor's printed form, the provisions of this “Software Maintenance Agreement” shall take precedence.
Provisions Controlling. To the extent that the provisions of this Article XX conflict with any other provisions of the Agreement, the provisions of this Article XX shall control."
Provisions Controlling. Xxxxxx further agrees that in the event of conflicting language between this "Equipment Attachment" and Lessor's form, this "Equipment Lease Attachment" shall take precedence.
Provisions Controlling. As between the Obligors, on the one hand, and the Agent, the LC Issuer and the Lenders, on the other, the provisions of this Agreement, to the extent in conflict with any provision of any Letter of Credit Documents, shall control. Without limiting the generality of the foregoing, (a) notwithstanding the terms of Section 2(a) of the application for the Physician Letters of Credit, the rate of interest applicable to amounts drawn on the letters of credit shall be as set forth in Section 4.1 hereof; (b) the Events of Default applicable to such Letter of Credit Obligations shall be those set forth in Section 10 hereof and not those set forth in Section 5 of the application for the Physician Letters of Credit; and (c) Section 8 of the application for the Physician Letters of Credit shall not be applicable.
