Section 10.5.1. 34 Seniority rights shall not be lost, but shall not accrue for the following reasons, without 35 limitation; 37 A. Time spent in layoff status, per Article X, Section 10.9. 38 B. Time spent on unpaid Leave of Absences. 40 Section 10.6. 41 Seniority rights shall be effective within the general job classification. As used in this Agreement, 42 general job classifications are those set forth in Article I, Section 1.4.
Section 10.5.1. An employee will retain accrued sick leave, vested vacation rights, and seniority rights earned 3 prior to the occurrence of any of the events described in Section 10.5. However, vacation credits, 4 sick leave, seniority, and other benefits shall not accrue during their absence.
Section 10.5.1. 26 Employees with the earliest hire date shall have preferential rights regarding shift selection, 27 vacation periods, overtime opportunities, promotions, assignment to new or open jobs or 28 positions, and layoffs when the ability and performance are substantially equal with junior 29 employees and/or other candidates. Overtime in the transportation classification is subject to the 30 terms of Article VII, Section 7.7.2.1.
Section 10.5.1. 6 Seniority rights shall not be lost for time on leave of absence granted for the purpose of serving 7 in the Armed Forces of the United States, to a maximum of two (2) years of such absence.
Section 10.5.1. Should the District decide to discharge any continuing part-time employee, the employee shall 33 be so notified in writing prior to the expiration of the school year.
Section 10.5.1. 11 Employees who change job classifications within the bargaining unit shall retain their hire 12 dates in the previous classification for a period of one (1) year, notwithstanding that they have 13 acquired a new hire date and a new classification.
Section 10.5.1. Any qualified employee, who makes application to fill a vacancy in another classification, shall 7 have seniority rights over any applicant outside the bargaining unit who applies for the vacancy.
Section 10.5.1. 18 Any qualified employee, who makes application to fill a vacancy in another classification, shall 19 have seniority rights over any applicant outside the bargaining unit who applies for the 20 vacancy.
Section 10.5.1. 44 In the event an employee works an assignment within the District which is not covered by this 45 Agreement, seniority shall not be lost; however, seniority shall not accrue during the period 46 while in said assignment.
