PUBLICATION OF CONTRACTS. 3.18.1 The Authority is obligated to publish certain contracts within a defined period of time following the contract being entered into. Typically this period is between 90-180 days. 3.18.2 The Authority is also obligated to disclose contracts under Freedom of Information requests. 3.18.3 Consequently, a redacted copy of contracts should be produced and retained alongside the original copy of the contract. 3.18.4 Either through the tender process, or whilst agreeing contract terms with a supplier, it should be established whether there is any commercially sensitive information that should be redacted. 3.18.5 From the Authority’s perspective, if there is any operationally sensitive material in the contract, this must also be identified and redacted. The Budget Holder is accountable for identification of operationally sensitive material. 3.18.6 Whilst material may be identified as sensitive, the Authority must satisfy itself that it is not the case that it is just preferable to redact this information, but that it is permissible to do so also. If there is any uncertainty as to what may or may not be redacted, the Procurement Lead can advise in respect of Procurement Legislation requirements, and the Freedom of Information team can advise in respect of FoI requirements.

Grantee will ensure that all written agreements with subcontractors incorporate the terms of this Contract so that all terms, conditions, provisions, requirements, duties and liabilities under this Contract applicable to the services provided or activities conducted by a subcontractor are passed down to that subcontractor. c. No provision of this Contract creates privity of contract between the System Agency and any subcontractor of Grantee.

  • MODIFICATION OF CONTRACT This Contract may be supplemented, amended or modified only by a writing signed by both Parties. No oral conversation, promise or representation by or between any officer or employee of the Parties shall modify any of the terms or conditions of this Contract. COMMISSION shall not be deemed to have approved or consented to any alteration of the terms of this Contract, including its Exhibits, by virtue of COMMISSION’s review and approval of, or failure to object to, contracts or other business transactions entered into by CONTRACTOR.

  • Grouping of contracts To the extent practicable, contracts for goods shall be grouped in bid packages estimated to cost $100,000 equivalent or more each.

  • MODIFICATION OF CONTRACT TERMS The terms and conditions set forth in the Contract shall govern all transactions by Authorized User(s) under this Contract. The Contract may only be modified or amended upon mutual written agreement of the Commissioner and Contractor. The Contractor may, however, offer Authorized User(s) more advantageous pricing, payment, or other terms and conditions than those set forth in the Contract. In such event, a copy of such terms shall be furnished to the Authorized User(s) and Commissioner by the Contractor at the time of such offer. Other than where such terms are more advantageous for the Authorized User(s) than those set forth in the Contract, no alteration or modification of the terms of the Contract, including substitution of Product, shall be valid or binding against Authorized User(s) unless authorized by the Commissioner or specified in the Contract Award Notification. No such alteration or modification shall be made by unilaterally affixing such terms to Product upon delivery (including, but not limited to, attachment or inclusion of standard pre-printed order forms, product literature, “shrink wrap” terms accompanying software upon delivery, or other documents) or by incorporating such terms onto order forms, purchase orders or other documents forwarded by the Contractor for payment, notwithstanding Authorized User’s subsequent acceptance of Product, or that Authorized User has subsequently processed such document for approval or payment.

  • EXECUTION OF CONTRACT 20.1 Depending on the type of service provided, one of the following methods will be employed. The method applicable to this contract will be checked below: _ a.
