Purpose of Area. The Area is established for the purpose of the City providing the Special Services to serve the territory within the Area, in addition to services provided in the City generally. However, the owners of property in the Area (“Owners”) are obligated to form a homeowners association (“Association”) and perform the Special Services to the extent individually responsible and otherwise to cause the Special Services to be performed by the Association at the expense of the Owners. If any Owners or the Association fail to provide the Special Services, the City will have the right to give notice to the registered agent of the Association containing a specific description of the Special Services that have not been performed and any resulting code or ordinance violation. After receipt of such notice, the Owners shall have a period of thirty (30) days in which to cause the deficiency or violation to be cured (or to commence the cure of such deficiency or violation if the cure requires more than thirty (30) days, so long as the Owners actively and diligently prosecute the cure to completion), failing which the City will have the right to provide or cause to be provided some or all of the Special Services for any period of time (which period may be indefinite) as the City elects. The City will have the right to accept the cure of any deficiency or violation by the Association and to cease providing any Special Services whenever the City determines that the Owners and the Association have taken effective action to resume the timely performance of Special Services in lieu of performance by the City. Whenever the City has been or is providing Special Services or reimbursing itself for the costs and expenses of having provided or preparing to provide such Special Services, the Area shall be deemed in “active” mode and the City will have the right to levy ad valorem taxes in the manner provided in Section 6 of this Ordinance. At all other times, the Area shall be deemed in “dormant” mode.

Purpose of Area. City of Batavia Special Service Area No. (SSA number) is established to provide special municipal services to the Area in addition to services provided to the City generally. The purpose of the formation of the City of Batavia Special Service Area No. (SSA number) is to provide special municipal services to the Area in connection with the redevelopment of the property, including but not limited to a public parking facility and associated public improvements, including streetscape improvements and landscaping, all of which is pursuant to the terms of a certain Redevelopment Agreement (0 X. Xxxxxxxxxx Avenue) between the owners of the Property and the City of Batavia dated , 2016 (“Redevelopment Agreement”). Annual taxes may be levied for the special services enumerated herein, on property in said Special Service Area No. (SSA number), for said Special Service Area, in addition to all other City taxes pay the difference between in keeping with the terms of the Redevelopment Agreement the tax increment generated from the Project, as defined in the Redevelopment agreement, and the debt service payments when those payments are due; provided, that the special annual taxes shall be limited so that the total of said tax does not exceed an annual amount of 50 cents ($.50) per $100.00 of assessed value, as equalized, to be levied against the property included in Special Service Area No. (SSA number).
