Railroad Coordination and Correspondence. Coordinate with BNSF to gain approval for constructing the proposed at-grade crossing. Railroad track design, if required, is not a part of this task. Obtain necessary rights of entry or access permits required to complete design stage work. Coordinate and meet with BNSF staff and representatives Xxxxx Xxxxx LaSalle Brokerage, Inc. (JLL) to gather feedback, incorporate modifications, and gain concurrence on the design. Coordinate and gain approval on necessary ROW acquisition. In addition to telephone and email correspondence, the team shall coordinate up to four (4) onsite meetings with BNSF, ODOT rail safety section, and the City with up to four (4) team staff members attending this meeting. Consultant shall assist the City with the preparation and negotiation of a new or revised construction and maintenance ("C&M") agreement between the City and BNSF. Consultant shall provide drawings in format acceptable to the railroad consisting of final at grade crossing plans, roadway profile, drainage plans, and other supporting materials required for the City to execute the agreement with BNSF. The City will be responsible for paying all BNSF fees associated with said agreement. Assumption: • City will be responsible for payment of any associated fees. Deliverables/Schedule: • Meeting summaries are due within seven (7) calendar days following any meeting. • Concept engineering plans for railroad approval submitted to BNSF for review within four (8) weeks of submitting deliverables for task 4.1.4. • 30% engineering plans for railroad approval submitted to BNSF for review within eight (8) weeks of receiving BNSF comments on concept plans. • Final, stamped/signed engineering plans for railroad approval submitted to BNSF for review within four (4) weeks of submitting deliverables for task 11.3.
