Common use of Rate and Method of Compensation Clause in Contracts

Rate and Method of Compensation. FLSA Non-Exempt Employees Compensation for overtime worked by employees in classifications listed in Appendix A , herein, shall be for all hours worked in excess of 40 hours in a workweek. Management shall have the discretion to determine whether overtime compensation shall be in cash or time-off. Overtime compensation shall be in time off at the rate of one and-one-half (1 ½) hours for each hour of overtime worked or at the rate of one and-one-half (1 ½) times the employee's regular rate of pay.
