Reasonable Service Award to the Representative Plaintiff. 3 Subject to Court approval, the Representative Plaintiff shall make a separate 4 application for up to Seven Thousand Five Hundred Dollars ($7,500.00) as a Service Award. 5 The Service Award shall be paid by check made payable to the Representative Plaintiff, 6 which shall be delivered by the Claims Administrator to Class Counsel within thirty (30) 7 calendar days after the Final Effective Date. The Service Award shall be paid out of the 8 Gross Fund Value Amount and shall not constitute payment(s) to any Participating Class 10 It is the intent of the Parties that the Service Award represent payment to 11 Representative Plaintiff for the additional risks undertaken in prosecuting this action and her 12 service to the Class Members, and not wages, thus, the Claims Administrator shall not 13 withhold any taxes from the Service Award. The Service Award shall be reported on a Form 14 1099, which shall be provided by the Claims Administrator to the Representative Plaintiff 15 and to the pertinent taxing authorities as required by law. Although it is the contemplation of 16 the Parties that the Service Award does not represent wages, the Internal Revenue Service, 17 the California Franchise Tax Board, or some other taxing authority may take the position that 18 some or all of the Service Award constitutes wages for income tax and withholding 19 purposes. The Representative Plaintiff agrees to assume the responsibility of remitting to the 20 Internal Revenue Service, the California Franchise Tax Board, and any other relevant taxing 21 authority the amounts required by law, if any, to be withheld by Defendant from the Service 22 Award paid under this Agreement and any liability assessed against Defendant for failure to 23 withhold the required amount, if any.
