Recording of Memorandum of Lease. This Lease or a certificate or memorandum thereof prepared by Landlord may at the option of Landlord be recorded. Tenant shall execute any such certificate, short form lease or memorandum upon demand by Landlord.
Recording of Memorandum of Lease. At the request of Tenant, Landlord shall execute and Tenant may record a Memorandum of Lease referencing the Lease in the Official Records of the County Recorder for the County in which the Property is located.

However, either party shall have the right to record a memorandum of Lease of the form attached as Exhibit E, at its expense, at any time during the Term hereof and, if requested, the other party agrees (without charge) to join in the execution thereof.

Upon the Lease Expiration Date, Tenant shall execute such instruments reasonably requested by Landlord in recordable form which are sufficient to release of record any rights or interests of Tenant in and to the Leased Premises or the Leasehold Estate. In this connection, Tenant irrevocably and unconditionally appoints Landlord as its attorney-in-fact, coupled with an interest, which appointment shall survive the bankruptcy, insolvency or other legal disability of Tenant, solely to take all actions necessary to perform Tenant’s obligations under this Section 26.4.
Recording of Memorandum of Lease. The parties may cause a Memorandum of Lease to be filed with the appropriate recording office in the County of St. Xxxxxxxx. Such Memorandum of Lease shall be in form and substance reasonably satisfactory to the Authority and to the BOCES, and otherwise in accordance with applicable legal requirements.
