Reduction of Payment for Non-Conforming Services. If any defined action, duty or service or part required by the Contract is not performed by the TSI Contractor in accordance with the requirements of the Contract, the value of such action, duty or service or part thereof will be determined by SRTA and deducted from any invoice claiming such items for payment. If the action, duty or service or part thereof has been completed and is not in conformance with the Contract Documents, the TSI Contractor will be notified and given the opportunity to correct any deficiencies within a time certain. Payment (for the non-conforming work) will be withheld by SRTA from any invoice until such time as the Work is corrected in accordance with the Contract Documents.
