Referral Package. 9.1 Once the Joint Review Panel Report has been made public, a Steering Committee will be established consisting of senior representatives of EAO, Responsible Authorities for the Project, and the Agency in its role as federal Crown consultation coordinator. 9.2 The Steering Committee will discuss elements of the proposed provincial and federal responses to the Joint Review Panel Report, the recommendations and conclusions contained in the Joint Review Panel Report, and key issues and responsibilities respecting these recommendations and conclusions in order for EAO and federal government to prepare and finalize their respective key documents. 9.3 Finalization of key documents is not expected to exceed 60 days from the day the Joint Review Panel Report is made public. During this approximately 60 day period, Aboriginal groups will be consulted on the Joint Review Panel Report and the draft federal report on consultation and accommodation. Comments will be considered by the federal government and EAO and revisions will be made to the draft reports on consultation and accommodation where appropriate. 9.4 If Aboriginal groups do not agree with the conclusions of the Joint Review Panel Report or the sections of the provincial report on consultation and accommodation that relate to their interests, they may provide a separate submission to be included in the Referral Package for the provincial Minister of Environment and the other responsible provincial Minister. 9.5 The Executive Director of EAO will finalize the Referral Package.

Referral Package. The Corps referral package sent to Region 8 will include a copy of the administrative record and the Lead Enforcement Agency Identification form, attached hereto as appendix A. The referral package sent to Region 8 also will include a jurisdictional determination (JD), consistent with national guidance in effect at the time of referral, with supporting hydrologic, vegetation, and soils information.2 The referral package also will include the initial investigation report, the results of an applicable OMBIL3 Regulatory Module (ORM) search,4 color copies or color scans of pictures in the record, and other items identified in the Section 404 Enforcement Case Referral Checklist, attached hereto as appendix B. Within 45 days of its receipt of a referral package, Region 8 will provide written notification to the Corps of its decision to accept or decline the lead enforcement agency role in the matter. In some instances, EPA may request additional information or time to review the referral package, in which case the total review time should not exceed 2 The JD will establish that a discharge of dredged or fill material occurred in a water of the United States, but may not necessarily establish the limits of the water of the United States. A JD prepared by the Corps for an enforcement action may not be appealed by the land owner/violator under the Corps’ administrative appeals regulations (33 CFR Part 331).
Referral Package. The PRRO will provide a Notice of Publication to the Provincial Agency or Delegate within 3 Business Days of receiving a complete Referral Package.

  • Salary Packaging (1) For the purposes of this Agreement, salary packaging shall mean an arrangement whereby the wage or salary benefit arising under a contract of employment is reduced, with another or other benefits to the value of the replaced salary being substituted and due to the practitioner. (2) A practitioner may, by agreement with the employer, enter into a salary packaging arrangement. (3) The employer shall not unreasonably withhold agreement to salary packaging on request from a practitioner. (4) The employer shall not require a practitioner to enter into a salary packaging arrangement, provided that this clause will not impinge on any additional employer provided benefits. (5) A salary packaging arrangement shall be formulated and operate on the basis that, on balance, there shall be no material disadvantage to the practitioner concerned, and shall be cost neutral in relation to the total employment cost to the employer. (6) A salary packaging arrangement must comply with relevant taxation laws and the employer shall not be liable for additional tax, penalties or other costs payable or which may become payable by the practitioner. (7) In the event of any increase or additional payments of tax or penalties associated with the employment of the practitioner, or the provision of employer benefits under the salary packaging agreement, such tax, penalties and any other costs shall be borne by the practitioner. (8) A practitioner may elect to cancel any salary packaging arrangement by giving a minimum of four weeks notice. (9) The employer may elect to cancel any salary packaging arrangement by giving a minimum of four weeks notice if the employer incurs a liability to pay fringe benefits tax or any other tax in respect of the non-cash benefits provided, provided that the employer cannot retrospectively cancel any salary packaging arrangement. (10) Notwithstanding subclauses (8) and (9) of this clause, the employer and the Practitioner may agree to forgo the notice period. (11) The cancellation of salary packaging will not cancel or otherwise effect the operation of this Agreement. (12) For the purposes of this provision, any penalty rate, loading or other salary related allowances which would ordinarily be calculated on the basis of the salary rates expressed in Schedule 1 Full Time Annual Base Salary Rates shall continue to be so calculated despite an election to participate in any salary packaging arrangement. (13) For the purposes of this provision, statutory 9% employer superannuation contributions shall be made on the basis of pre-packaging salary rates. To avoid doubt, employer contributions shall not be reduced as a result of a practitioner participating in salary packaging pursuant to this provision. (14) The employer may at any time vary the range of benefits provided or the conditions under which benefits are provided however the employer shall not differentiate between different class of practitioners across WA Health in terms or range of benefits or the conditions under which benefits are provided. (15) If a practitioner is found to have committed misconduct in the claiming a salary packaging benefit the employer is entitled to prospectively cease to provide some or all salary packing benefits either indefinitely or for any period determined by the employer.

  • Updating HHSC A. To disclose information on ownership and control, information related to business transactions and information on persons convicted of crimes in accordance with 42 CFR, Part 455, Subpart B, and to submit updated ownership and control disclosures within 10 business days of a change in ownership or control interest and at any time within 35 business days of a written request by HHSC or the U.S. Department of Health and Human Services ("HHS"). B. To keep its application for participation in the contracted program current by informing HHSC in writing of: 1. a change of ownership or a change in the Contract's legal entity that directly or indirectly changes the legal entity responsible for fulfilling this Contract at least 60 calendar days prior to the date of the change; 2. a change in the name of the person authorized to negotiate, execute, amend or terminate this Contract on behalf of the Contractor within 30 calendar days of the date of the change; and
