Land Owner. The developer hereby declares that they are constructing the residential complex with the loan assistance of DHFL(Lender) to whom the entire project assets and receivables have been mortgaged/charged except those already have been booked/ allotted/sold and against which part payment has been received by the developer as and by way of exclusive charge and hence the rights hereby created shall be subject to prior mortgage/charge of DHFL(Lender). The final transfer of the Unit in favour of the purchaser/allottee shall be made only subject to payment of the entire balance sale consideration and other amounts for the concerned unit to DHFL(Lender) through the Project Escrow Account No.912020062492311 with Axis Bank Ltd. On deposit of entire balance sale consideration against said Unit DHFL's charge shall automatically stand released and discharged.

Interconnection Point [The outlet flange of the isolation valve designated HV-XXXXX on [ ] Flowsheet - Piping & Instrument Diagram number [XXXXXX-AAAA-NNN-TT]] Odorisation Status of First Gas’ Pipeline Odorised / Non-odorised Odorisation Fee (if any) $[ ] per Day schedule two: technical requirements The design, construction, commissioning, operation and maintenance of each Receipt Point (including any First Gas Equipment) shall conform with good gas industry engineering practice and shall comply with the requirements of recognised and applicable standards as well as all current and relevant laws, including: AS 2885.1: 2007 Pipelines - Gas and Liquid Petroleum, Part 1: Design and Construction; Gas ▇▇▇ ▇▇▇▇ and associated regulations; Health and Safety at Work ▇▇▇ ▇▇▇▇; Health and Safety in Employment (Pipelines) Regulations; Resource Management ▇▇▇ ▇▇▇▇; Electrical (Safety) Regulations; AS/NZS 3000 – Wiring Rules; AS/NZS 60079.14 - Explosive Atmospheres: Electrical Installations, Design Selection and Erection; and mandatory Codes of Practice and Standards associated with any of the above. A Receipt Point must incorporate: appropriate security fencing to reasonably prevent unauthorised access; adequate means of access and egress for vehicles and personnel; adequate space to accommodate and permit the safe operation and maintenance of all equipment and structures; Metering; clear signs indicating restricted access and Hazardous areas, supplemented by secure barriers where required; only electrical equipment that complies with the NZ Electricity Act and Regulations; an above-ground isolation valve (specified by First Gas) to allow First Gas to securely and safely isolate its Pipeline from the Interconnected Party’s Pipeline; suitable bonding of above-ground piping and associated metallic structures to ensure the electrical continuity of such piping and structures, and a suitable earth bed to which such piping and structures are connected; means to electrically isolate First Gas’ Pipeline from a Receipt Point, as well as a suitable surge diverter installed across each such isolating device; equipment to reasonably prevent any solid or liquid contaminants from reaching First Gas’ Pipeline;
Land Owner. To the best of Land owner's knowledge to date:
i) Neither Land owner nor, Land owner's former or present tenants, are subject to any investigation concerning the premises by any governmental authority under any applicable federal, state, or local codes, rules, and regulations pertaining to air and water quality, the handling, transportation, storage, treatment, usage, or disposal of toxic or hazardous substances, air emissions, other environmental matters, and all zoning and other land use matters.
ii) Any handling, transportation, storage, treatment, or use of toxic or hazardous substances that has occurred on the premises has been in compliance with all applicable federal, state, and local codes, rules, and regulations.
iii) No leak, spill release, discharge, emission, or disposal of toxic or hazardous substances has occurred on the premises.
iv) The soil, groundwater, and soil vapor on or under the premises is free of toxic or hazardous substances except for chemicals (including without limitation fertilizer, herbicides, insecticides) applied in conformance with good farming methods, applicable rules and regulations and the label directions of each chemical.
Land Owner. The Land Owner:
(a) does not warrant that the Premises are or will remain suitable or adequate for any of the Facility Owner’s purposes; and
(b) must not unreasonably interfere with any Facility, the supply of essential services to the Facilities (including electricity and water), or the use of the Facilities by the Facility Owner, located on the Land Owner’s Premises.
Land Owner. In case of Apartments provided with exclusive open terraces the calculation of super area shall be dealt with separately. Apartment Allottee(s), however, shall not be permitted to cover such terraces and shall use the same as open terrace only and in on other manner whatever.
Land Owner. If any provision of this Agreement shall be determined to be void or unenforceable under applicable law, such provisions shall be deemed amended or deleted in so far as reasonably inconsistent with the purpose of this Agreement and to the extent necessary to conform to the applicable law and the remaining provisions of this Agreement shall remain valid and enforceable as applicable at the time of execution of this Agreement.
Land Owner. The then present title owner, or owners, of the Property. Upon the Conveyance of all of the Property, or of any Lot, constituting the entire ownership interest of the transferor thereof in the Property or in said Lot, the transferor shall cease to be deemed a Land Owner hereunder with respect to the Property or Lot so transferred, and the successor in title to the Property or the Lot shall, upon the completion of the conveyance, become a Land Owner hereunder, and be bound by the terms of this agreement.
Land Owner. The Contractor acknowledges and agrees that the Land Owner:
(a) is not a party to this Agreement; and
(b) is not authorised to provide Instructions (including Variations) in relation to the Works. Each Contract will include details of the Land Owner’s Representative, whom the Contractor must liaise with in order to arrange adequate access to the Site.
