Common use of Referrals Clause in Contracts

Referrals. Nothing in this Agreement shall be construed as an offer or payment to the other party or any affiliate of the other party of any cash or other remuneration whether directly or indirectly, overtly or covertly, specifically for patient referrals or for recommending or arranging the purchase, lease or order of any item or service. The Consideration to be received upon the Closing represents the fair market value of the Assets and is not in any way related to or dependent upon referrals by and between OMEGA and Dr.
