RELATIONSHIP WITH NATIONAL EMPLOYMENT STANDARDS. This Agreement shall be read and interpreted in conjunction with the National Employment Standards (NES) provided that where there is any inconsistency between this Agreement and the NES, the more beneficial provision to an employee shall take precedence.

RELATIONSHIP WITH NATIONAL EMPLOYMENT STANDARDS. ‌ This Agreement will be read and interpreted in conjunction with the National Employment Standards (NES). Where there is an inconsistency between this agreement and the NES, and the NES provides a greater benefit, the NES provision will apply to the extent of the inconsistency. The NES and this Agreement will be posted on the noticeboards and lunchrooms at all sites where Team Members for whom the classifications, rates of pay and conditions of employment in this Agreement are engaged.

Where there is an inconsistency between the NES and a clause of this Agreement, the NES will apply and the clause of the Agreement will not apply, except to the extent that the clause of the Agreement provides for a more beneficial outcome for employees than the NES.
RELATIONSHIP WITH NATIONAL EMPLOYMENT STANDARDS. No term of this Agreement will operate to exclude the NES or any provision of the NES or be detrimental to a Match Official in any respect when compared to the NES. For the avoidance of doubt, the NES (and associated definitions) are not incorporated into this Agreement and where this Agreement provides a superior entitlement to the NES, the Agreement entitlement will apply in satisfaction of, and not in addition to, the corresponding NES entitlement.

(b) Where this Agreement refers to a condition of employment provided for in the NES, the NES definition applies (c) The parties agree that if any clause in this Agreement is not equivalent to or more beneficial than the NES, the NES will prevail to the extent of any inconsistency.
