Common use of Release for Incapacity or Incompetence Clause in Contracts

Release for Incapacity or Incompetence. (i) When an employee has completed more than one (1) year of continuous employment and ceases to be employed by reason of release for incapacity, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks. (ii) When an employee has completed more than ten (10) years of continuous employment and ceases to be employed by reason of release for incompetence, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks.

(ia) When an employee has completed more than one (1) year of continuous employment and ceases to be employed by reason of release termination for incapacitycause for reasons of incapacity pursuant to the provisions of section 12.(2)(d) of the Financial Administration Act, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks. (ii) When an employee has completed more than ten (10) years of continuous employment and ceases to be employed by reason of release for incompetence, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks.

(ia) When an An employee who is released for incapacity who has completed more than one (1) year of continuous employment and ceases who ceased to be employed by reason of following his/her release for incapacity, incapacity is entitled to receive one (1) week’s week pay for each complete year of continuous employment with up to a maximum benefit of twenty-eight (28) 28 weeks, less any period in respect of which he/she was granted severance pay, retirement leave or a cash gratuity in lieu of retiring leave by the Employer. (iib) When an An employee released for incompetence who has completed more than ten (10) years of continuous employment and ceases to be employed by reason of release for incompetence, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks.ten

(i) When an 56.5.1 An employee has completed more than one (1) year who is released for incapacity shall on termination of continuous employment and ceases be entitled to be employed by reason severance pay on the basis of release for incapacity, one (1) week’s pay for each complete completed year of continuous employment with a maximum benefit of twenty-twenty- eight (28) weeks.. ** (ii) When an 56.5.2 An employee who has completed more than ten (10) years of continuous employment and ceases to be employed by reason of release for incompetence, one shall be entitled to one (1) week’s pay for each complete completed year of continuous employment with a maximum benefit of twenty-eight (28) weeks.
