Common use of Release for Incapacity or Incompetence Clause in Contracts

Release for Incapacity or Incompetence. (a) When an employee has completed more than one (1) year of continuous employment and ceases to be employed by reason of release for incapacity pursuant to the provisions of section 12.(2)(d) of the Financial Administration Act, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks. (b) When an employee has completed more than ten (10) years of continuous employment and ceases to be employed by reason of termination for cause for reasons of incompetence pursuant to section 12.(2)(d) of the Financial Administration Act, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks.

(b) When an employee has completed more than ten (10) years of continuous employment and ceases to be employed by reason of termination for cause for reasons of incompetence pursuant to section 12.(2)(dSection 11(2)(g) of the Financial Administration Act, one (1) week’s pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks.

(ai) When The employer agrees that an employee has completed more than one (1) year released from employment under Section 31 of continuous employment and ceases to be employed by reason of release the Public Service Employment Act for incapacity pursuant shall, on termination of his employment, be entitled to severance pay on the provisions basis of section 12.(2)(d) of the Financial Administration Act, one (1) week’s 's pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeksweeks pay. (bii) When an employee has completed more than ten (10) years of continuous employment and ceases to be employed by reason of termination release for cause for reasons of incompetence pursuant to section 12.(2)(d) the provisions of Section 31 of the Financial Administration Public Service Employment Act, one (1) week’s 's pay for each complete year of continuous employment with a maximum benefit of twenty-eight (28) weeks.
