REMOVAL OF LESSEE'S PROPERTY. (a) Lessee may at any time during the term of the Lease remove all or any of the property and fixtures placed by it in or upon the Lands, including the right to draw and remove all casing.
(b) Following termination of the Lease or any part thereof for any cause, and following abandonment of any well drilled pursuant to the provisions hereof, Lessee shall within six (6) months thereafter remove all personal property which Lessee shall have brought upon the Lands affected by such termination or upon the drillsite of such abandoned well; shall make reasonable efforts to fill all sumps, remove all foundations and so nearly as practicable restore the areas affected by such termination or abandonment to the condition in which they were prior to the commencement of its operations hereunder; and, in the case of termination, shall deliver to the Lessor a quitclaim deed, in recordable form, surrendering to the Lessor all right, title and interest of the Lessee in that part of the Lands as to which the Lease shall have been so terminated, saving and excepting necessary easements and rights of way on the Lands for Lessee’s further operations on any part of the Lands as to which the Lease shall not have been terminated and on Lessee’s other lands in the vicinity. The ownership of any of Lessee’s property not removed by it during the period herein provided shall, in the absence of Force Majeure, be deemed abandoned by Lessee and shall pass to Lessor without further act of the parties or either of them effective upon expiration of such period, provided however Lessee shall remain liable to Lessor for any such property which Lessee fails to remove upon notice by Lessor within said six (6) month period that such property be removed.
REMOVAL OF LESSEE'S PROPERTY. Lessor and Lessee agree that if Lessee shall fail to remove all effects from the Leased Premises upon the abandonment thereof or upon the termination of this Lease for any cause whatsoever, Lessor, at its option, may remove such effects in any manner that it shall choose, and store them without liability to Lessor for loss or damage thereof, and Lessee agrees to pay Lessor on demand any and all expenses incurred in such removal, including court costs and attorney's fees and storage charges on such effects for any length of time they shall be in Lessor's possession; or Lessor, at its option, without notice, may sell said effects, or any of them, at private sale and without legal process, for such prices as Lessor may obtain, and apply the proceeds of such sale upon any amounts due under this Lease from Lessee to Lessor and upon the expense incident to the removal and sale of said effects, rendering the surplus, if any, to Lessee.
REMOVAL OF LESSEE'S PROPERTY. At the expiration of the term of this Lease, and if Lessee is not then in breach hereof, Lessee may remove from the Premises all personal property belonging to Lessee. Lessee shall repair any damage caused by such removal and shall leave the Premises broom clean and in good condition and repair inside and out.
REMOVAL OF LESSEE'S PROPERTY. Upon the expiration of this Sublease, Lessee shall remove Lessee's articles of personal property incident to Lessee's business ("Trade Fixtures"); provided, however, to the extent Lessor is required to do so under the Prime Lease, Lessee shall repair any injury or damage to the Premises, which may result from such removal. If Lessee does not remove Lessee's Trade Fixtures from the Premises, prior to the expiration or earlier termination of the Term, Lessor may, at its option, remove the same (and repair any damage occasioned thereby) and dispose thereof or deliver the same to any other place of business of Lessee, or warehouse the same, and Lessee shall pay the reasonable cost of such removal, repair, restoration, delivery or warehousing to Lessor within ten (10) days following receipt of Lessor's documented invoice therefor. Lessee shall pay, prior to delinquency, directly to the appropriate taxing authorities, any personal property taxes levied or assessed against Lessee's Trade Fixtures.
REMOVAL OF LESSEE'S PROPERTY. Lessee hereby grants Lessor a security interest in all its inventory, equipment, furnishings, and trade fixtures located on the Premises to secure Lessee's obligations hereunder. If Lessee defaults in any payment obligation of this lease, or if Lessee fails to remove such property from the Premises within five days after termination of this lease, or if Lessee abandons the Premises as defined in Paragraph 23, then Lessor shall have the right and option to remove such property from the Premises and exercise all rights granted by Article 9 of the Colorado Uniform Commercial Code, without any liability for damage or injury caused to the property by any removal, restoration of Premises, or storage, even if Lessor is negligent. The Lessee shall be responsible for the cost incurred in said removal, storage and restoration, including any reasonable attorney's fees. The Lessor shall give notice of removal to the Lessee in the manner provided for in this agreement and the Lessee shall have three (3) days after the effective date of such notice to recover such property by paying all monies owed and fulfilling all other obligations hereunder. If the Lessee does not take such actions, Lessor may retain such property as its sole and separate property or may sell such property in any commercially reasonable fashion and apply the proceeds to Lessee's obligations hereunder.
REMOVAL OF LESSEE'S PROPERTY. If Lessee is not in default as to the payment of any rent, fee, or other charge payable to District herein, Lessee may remove its inventory, Trade Fixtures and furnishings from the Leased Premises upon expiration or sooner termination of this Agreement. If Lessee does not elect, or otherwise fails to remove the same, or any part thereof, within thirty (30) days following District's regaining possession of the Leased Premises, District may, at its option, either require such removal at Lessee's sole cost and expense, or keep such property, in which latter event, title to the same shall vest in District without any obligation to pay Lessee with respect thereto.
REMOVAL OF LESSEE'S PROPERTY. Upon the expiration or earlier termination of the Lease Term, Lessee may remove from the Property Lessee’s Property and any other personal property belonging to Lessee. Lessee shall repair any damage caused by such removal and shall leave the Property clean and in good and working condition and repair inside and out, subject to normal wear and tear, Casualty and condemnation. Any property of Lessee left on the Property on the thirtieth (30th) day following the expiration of the Lease Term shall, at Lessor’s option, automatically and immediately become the property of Lessor; provided that in no event shall Lessor have any ownership of or use rights with respect to any signage or operational property containing Lessee’s Intellectual Property.
REMOVAL OF LESSEE'S PROPERTY. The Lessee shall remove the Lessee’s Property from the Premises when the Premises are vacated under clause 10.1 and promptly make good in a proper and workmanlike manner any damage caused by that removal.
REMOVAL OF LESSEE'S PROPERTY during the term and/or Unless Lessee is in default hereunder, Lessee may remove any movable furniture, equipment, trade fixtures and signs of Lessee in or on the Premises or the Project* immediately upon the expiration or termination of this Lease, and any such property of Lessee remaining on the Premises upon such expiration or termination shall, at Lessor's option, become the property of Lessor, or Lessor may dispose of same, as attorney-in-fact for and at the expense of Lessee, as Lessor may deem appropriate in its discretion. Lessee shall promptly repair any damage to the Premises caused by the installation or removal of Lessee's movable furnituxx, xxuipment, trade fixtures and signs.
REMOVAL OF LESSEE'S PROPERTY. Lessee shall remove all furnishings, furniture and trade fixtures that remain the property of Lessee. Failure to do so shall be an abandonment of the property and Lessee shall have no further rights therein and Lessor may retain or dispose of the property as it sees fit.
