Lease Term Extension. The term of the Lease is hereby extended for a period of 65 months, commencing on March 1, 2009 (the “Commencement Date”), and expiring on July 31, 2014 (the “Extended Term”).
Lease Term Extension. Provided Tenant is not in default under the terms and conditions of the Lease, Tenant may negotiate an extension of the Lease for five (5) additional years. The rental rate and other material terms and conditions are subject to renegotiations under the then prevailing market. Tenant shall notify Landlord in writing, not more than six (6) months nor less than four (4) months prior to the lease expiration of its desire to extend the Lease. If Landlord and Tenant are unable to agree on the final lease extension rental rate, or other material terms and conditions of the lease extension, then the Lease shall terminate as scheduled, and Tenant shall have no further right to the Leased Premises.
Lease Term Extension. The Lease Term is hereby extended for approximately thirty-six (36) months and the Expiration Date is hereby amended to mean December 31, 2017. The period from December 28, 2014 through the new Expiration Date is referred to herein as the “Extension Term.”
Lease Term Extension. This Lease Extension shall extend the Lease such that it terminates at noon April 30, 2023. The provisions of this Lease Extension shall supersede any conflicting provisions of the Lease and shall not affect any other provisions.
Lease Term Extension. The initial term of this Lease (“Initial Term”) shall commence as of the Effective Date and shall expire at midnight on January 31, 2026 (“Expiration Date”), unless terminated sooner as provided in this Lease and as may be extended as provided herein. The time period during which this Lease shall actually be in effect, including any Extension Term, is referred to herein as the “Lease Term.” Unless this Lease has expired or has been sooner terminated, or an Event of Default has occurred and is continuing at the time any extension option is exercised, Lessee shall have the right and option (each, an “Extension Option”) to extend the Initial Term for the Property for six (6) additional successive periods of five (5) years each (each, an “Extension Term”), pursuant to the terms and conditions of this Lease then in effect. Lessee may only exercise the Extension Options by giving written notice thereof to Lessor of its election to do so first, no later than one hundred twenty (120) days prior to the Expiration Date and one hundred twenty (120) days prior to the immediately preceding Extension Term, as the case may be. If written notice of the exercise of any Extension Option is not received by Lessor by the applicable dates described above, then this Lease shall terminate on the last day of the Initial Term or, if applicable, the last day of the Extension Term then in effect. Upon the request of Lessor or Lessee, the parties hereto will, at the expense of Lessee, execute and exchange an instrument in recordable form setting forth the extension of the Lease Term in accordance with this Section 3.
Lease Term Extension. The Landlord and Tenant hereby agree to extend the term of the Lease for an additional extension term of thirty-six months, commencing October 1, 2007, and ending September 30, 2010 (the “Lease Term Extension”). Lease Term Extension. The five (5) year Lease Term established in Paragraph 4 of this Lease may be extended, at option of Lessee, for one additional term of five (5) years, provided Lessee exercises such option at least four (4) months prior to the then current expiration date established per terms of provisions of Lease Paragraph 4 and this Paragraph 1 of this First Lease Addition, further provided Lessee is then occupying said demised premises and is not then in default in the performance of any of the provisions of this Lease.
Lease Term Extension. Landlord and Tenant hereby acknowledge and agree that, pursuant to the Original Lease, the Lease Term (also referred to in the Original Lease as “Term”) expires on August 31, 2011. Provided that, as of the Extension Commencement Date (hereinafter defined), no default under the Lease has occurred (beyond any applicable notice, cure, and or grace period), the Lease Term is hereby extended for a period of forty eight (48) months (the “Extension Term”), commencing on September 1, 2011 (the “Extension Commencement Date”) and expiring at 11:59 PM EST on August 31, 2015 (the “Expiration Date”), and the Monthly Base Rent (also referred to in the Original Lease as “fixed base rent”) payable from January 1, 2011 through the Expiration Date shall be as follows: 1/1/2011-12/31/2011 $ 4.95 $ 81,881.25 1/1/2012- 8/31/2012 $ 5.15 $ 85,189.58 9/1/2012- 8/31/2013 $ 5.35 $ 88,497.92 9/1/2013- 8/31/2014 $ 5.45 $ 90,152.08 9/1/2014- 8/31/2015 $ 5.65 $ 93,460.42 On the Expiration Date (or earlier termination of the Lease), Tenant shall surrender the Leased Premises to Landlord pursuant to the terms of the Lease, including Paragraph 27 of the Original Lease. Except as otherwise expressly set forth in the Original Lease, Tenant accepts the Leased Premises, the Building and the common areas in their AS IS, WHERE IS condition and state of repair existing as of the Extension Commencement Date, and Tenant agrees that Landlord shall not be required to perform any work, supply any materials, or incur any expense to prepare the Leased Premises for Tenant’s occupancy. Lease Term Extension. Provided Landlord does not and/or will not have an internal requirement for the Premises, Tenant shall have an opportunity to extend this Lease for an additional one (1) year period ( "Extended Term") on the following terms and conditions:
(a) Tenant and Landlord sign an amendment extending the Lease Term, and such amendment shall specify the Rent for the Extended Term as provided for in 3,4 below, and such other terms as the parties may agree to,
(b) The Lease Term may not be extended pursuant to this Section 3.3 if Tenant is in default in the performance of any of the terms and conditions of this Lease.
(c) Except as otherwise modified by the amendment entered into in accordance with the terms set forth herein, all terms and conditions of this Lease shall apply during each Extended Term.
(d) Upon the extension of the Lease Term pursuant to this Section 3.3, the term "Lease Term" as used in this Lease shall thereafter include the applicable Extended Term and the Lease Termination date shall be the expiration date of the Extended Term.
Lease Term Extension. The term of the Lease, which is scheduled to expire on December 31, 1997, is hereby extended for a period of one (1) year, which term shall end on December 31, 1998, both inclusive. The word "term" where used in the Lease shall mean the duration of the Lease, as extended by this Agreement.
