Required Extensions of Service. Whenever the Grantee receives a request for Cable Service from at least ten (10) Dwelling Units within 1320 cable-bearing strand feet (one- quarter cable mile) of its existing trunk or distribution cable for areas within the jurisdictional limits of the City as of the Effective Date of this Franchise, it shall extend its Cable System within ninety (90) days to such potential Subscribers at no cost for Cable System extension other than the usual connection fees for all Subscribers; provided that such extension is technically feasible, all proper authorizations and/or permits can be obtained and the extension will not adversely affect the operation, financial condition or market development of the Cable System.

Required Extensions of Service. Whenever the Grantee shall receive a request for service from at least ten (10) residences within 1320 cable-bearing strand feet (one-quarter cable mile) of its trunk or distribution cable, it shall extend its Cable System to such potential Subscribers at no cost to said Subscribers for Cable System extension, other than the usual connection fees for all Subscribers within ninety (90) days, provided that such extension is technically feasible, and if it will not adversely affect the operation of the Cable System.
Required Extensions of Service. The Cable System, as constructed as of the date of the passage and final adoption of this Franchise, substantially complies with the material provisions hereof. Whenever the Grantee shall receive a request for service from a potential customer where there are at least five (5) residences within 1,056 aerial cable-bearing strand feet (one-fifth cable mile) or twenty (25) residences within a mile of its trunk or distribution cable capable of supporting the additional distance, or at least eight (8) residences within 1,056 underground trench feet (one-fifth mile) of trunk or distribution cable or forty (40) residences within a mile of its trunk or distribution cable capable of supporting the additional distance it shall extend its Cable System to such customers at no cost to said customers for Cable System extension, other than the usual connection fees for all customers within ninety (90) days except for circumstances beyond Xxxxxxx’s control.

Whenever the Grantee shall receive a written request for Cable Service from a Person in the Service Area between such Person's location and a then-existing portion of Grantee's Cable System (other than a subscriber drop line) where there are Public Ways, then the Grantee shall, within ninety (90) days of receipt of such request(s), extend its Cable System to such Person(s).

Required Extensions of Service. Whenever the Grantee shall receive a request for service from at least ten residences within 1320 cable-bearing strand feet (one-quarter cable mile) of its trunk or distribution cable, it shall extend its Cable System to such Customers at no cost to the Customers for Cable System extension, other than the usual connection fees for all 11.3.1. No Customer shall be refused service arbitrarily. However, for unusual circumstances, such as a Customer=s request to locate a cable drop underground, existence of more than 125 feet of distance from distribution cable to connection of service to Customers, or a density of less than ten residences per 1320 cable-bearing strand feet of trunk or distribution cable, service may be made available on the basis of a capital contribution in aid of construction, including cost of material, labor, and easements. For the purpose of determining the amount of capital contribution in aid of construction to be borne by the Grantee and Customers in the area in which service may be expanded, the Grantee will contribute an amount equal to the construction and other costs per mile, multiplied by a fraction whose numerator equals the actual number of residences per 1320 cable-bearing strand feet of its trunks or distribution cable and whose denominator equals ten residences. Customers who request such service will bear the remainder of the construction and other costs on a pro rata basis. The Grantee may require that the payment of the capital contribution in aid of construction borne by such potential Customers be paid in advance. 11.3.2. Failure to meet these standards shall subject grantee to enforcement actions on a per Subscriber basis in section 13.
