Connection of Public Facilities. Grantee shall, at no cost to the City, provide one outlet of Basic Service and Digital Starter Service to all City owned and occupied buildings, schools and public libraries located in areas where Grantee provides Cable Service, so long as these facilities are already served or are located within 150 feet of its Cable System. For purposes of this subsection, “school” means all State-accredited K-12 public and private schools. Such obligation to provide free Cable Service shall not extend to areas of City buildings where the Grantee would normally enter into a commercial contract to provide such Cable Service (e.g., golf courses, airport restaurants and concourses, and recreation center work out facilities). Outlets of Basic and Digital Starter Service provided in accordance with this subsection may be used to distribute Cable Services throughout such buildings, provided such distribution can be accomplished without causing Cable System disruption and general technical standards are maintained. Such outlets may only be used for lawful purposes. The Cable Service provided shall not be distributed beyond the originally installed outlets without authorization from Grantee, which shall not be unreasonably withheld.

Such Cable Service shall not be located in public waiting areas or used to entertain the public nor shall they be used in a way that might violate copyright laws. The outlets may only be used for lawful purposes. The Cable Service provided shall not be distributed beyond the originally installed outlets without authorization from Grantee, which shall not be unreasonably withheld. Grantee is not required to provide free reception equipment for any complimentary account provided pursuant to this subsection. Grantee does not waive any rights under applicable law regarding complimentary service. Should Grantee elect to begin offsetting the value of complimentary service against franchise fees, Grantee shall first provide Franchise Authority with ninety (90) days prior written notice.

In addition, Grantee agrees to provide, at no cost, one outlet of Basic and expanded basic programming to all such future public buildings if the drop line to such building does not exceed 125 cable feet or if City agrees to pay the incremental cost of such drop line in excess of 125 feet, including the cost of such excess labor and materials. Outlets of Basic and expanded basic programming provided in accordance with this subsection may be used to distribute Cable Service throughout such buildings, provided such distribution can be accomplished without causing Cable System disruption and general technical standards are maintained. Cost for any additional outlets shall be the responsibility of City.
Connection of Public Facilities. As voluntary initiative, Grantee shall, at no cost to Grantor, provide at least one (1) outlet of Basic and expanded basic programming or its equivalent to all Grantor’s buildings, as designated by the Grantor, and all libraries and Schools passed by the Cable System within the Franchise Area, except for home schools and buildings or facilities housing jail populations. In addition, Grantee shall provide, at no cost to the Grantor or other agency, one (1) outlet of Basic and expanded basic programming or its equivalent to all future public buildings passed by the Cable System within the Franchise Area if the drop line to such building does not exceed one- hundred twenty-five (125) cable feet or if Grantor or other agency agrees to pay the incremental cost of such drop line in excess of one-hundred twenty-five (125) cable feet, including the cost of such excess labor and materials. Outlets of Basic and expanded basic programming provided in accordance with this subsection may be used to distribute Cable Service throughout such buildings at the cost of Grantor or agency, provided such distribution can be accomplished without causing Cable System disruption and general technical standards are maintained. The Cable Service provided in this Section shall not be used for commercial purposes, and such outlets shall not be located in areas open to the public. The Grantor shall take reasonable precautions to prevent any use of the Grantee's Cable System in any manner that results in the inappropriate use thereof or any loss or damage to the Cable System. The Grantor shall hold the Grantee harmless from any and all liability or claims arising out of the provision and use of Cable Service required by this Section. If additional outlets of Basic Cable and expanded basic service and other services are provided to such buildings, the building owner/occupant shall pay Grantee’s usual installation and service fees.
Connection of Public Facilities. The free basic, video programming (expanded basic) service provided herein shall include two (2) outlets and free service, for all accredited primary and secondary public Schools, residential and other facilities for The School for The Deaf and The Blind, the Pikes Peak Library District (including all branches), Pikes Peak Community College and CU-Colorado Springs (excluding residential living facilities) if such service is requested by the public facility and if the public facility is located within one hundred fifty feet (150') of Operator's distribution plant. The Operator will provide additional service outlets in each room or area where television reception is desired and the entity using the additional outlets shall reimburse the Operator for its actual cost basis for labor and material required in the installation of each outlet and for the receipt of service to those outlets (except there shall not be a monthly charge where the public entities have provided distribution to other outlets) which are additional to the main outlet. In addition, the Operator shall provide, at no cost, outlets of basic and expanded basic programming to all other public and educational buildings if requested by the public facility if the drop line is less than one hundred fifty feet (150') of Operator's distribution plant or if the City or other agency agrees to pay the incremental cost of such drop line in excess of one hundred and fifty cable feet (150'), including the cost of such excess labor and materials. Such outlets shall not be located in public waiting areas, break rooms, nor used to entertain public groups, nor shall the outlets be used in any way that might violate copyright laws.

Grantee shall provide without charge two (2) additional set-top boxes to City Hall, located at 000 Xxxxx Xxxxxx Xxxxxx, Xxxxxxxx Xxxxxxx, Xxxxxxxx, and two (2) additional set-top boxes to City Administration Building, located at 00 Xxxxx Xxxxxx Xxxxxx, Xxxxxxxx Xxxxxxx, Xxxxxxxx. Grantee shall also, at no cost, provide a Standard Installation, one (1) outlet of Basic and Digital Starter Cable Service and one (1) set-top box in addition to those set forth herein, to all future City building, including fire and police facilities, and all accredited elementary, middle and secondary public Schools, residential and other facilities for The Colorado School for the Deaf and the Blind, the Pikes Peak Library District (including all branches), Pikes Peak Community College (including all branches) and University of Colorado at Colorado Springs (excluding residential living facilities), whether such buildings or facilities are now existing or hereafter constructed, provided that the buildings and facilities are either owned and occupied or leased and occupied by the City, an enterprise of City, or a Designated Access Provider, for any of its services or programs, fire stations, police stations, and libraries and, provided further, that they are already served or are located within one hundred twenty five (125) aerial feet or sixty

In areas where and when the Operator provides Internet access, the Operator, upon written request of the City, will provide use of one (1) cable modem and maintain one (1) connection for Internet access to one (1) computer terminal in each primary and secondary public school, library and City building within the geographic limits of the City and which is located within one hundred fifty feet (150') of Operator's distribution plant. Any additional costs will be borne by the requesting school or library on a time and materials basis. In addition, Grantee shall provide, at no cost to the Town or other entity, one outlet of Basic and Expanded Basic Service to additional owned or leased and occupied Town buildings, schools and libraries where service is not being provided as of the Effective Date of this Franchise upon request and if it is a Standard Drop or if the Town or other entity agrees to pay the incremental cost of such drop line, including the cost of such excess labor and materials. Such obligation to provide free Cable Service shall not extend to areas of Town buildings where the Grantee would normally enter into a commercial contract to provide such Cable Service (e.g., golf courses, airport restaurants and concourses, and recreation center work out facilities).
