Resolution by Senior Officers. Any dispute or difference of any kind whatsoever arising between the parties out of or in connection with this Agreement shall first be discussed by the Chairman of the BID Company and the Council’s Strategic Director of Economy - Major Programmes (or their respective nominated representatives).
Resolution by Senior Officers. If the Representatives are unable to resolve the dispute within the timeframe stated in Section 15.1, then each Party shall appoint a senior officer in their organization, or that person’s designate, to resolve the dispute. The senior officer shall arrange a suitable schedule of meetings to discuss the dispute and shall attempt to resolve it, in good faith, in as timely a fashion as possible, but in any event, in not more than twenty (20) Business Days.
Resolution by Senior Officers. Any Dispute shall be initially referred to the Parties' respective senior officer responsible for this Agreement ("Senior Officers"), who shall meet or communicate as soon as reasonably possible after a Dispute is referred to it, giving due regard to the nature and impact of the issue under consideration. If the Senior Officers cannot resolve a Dispute referred to it within five (5) days, the Dispute shall be referred to the Executives (as defined herein). In the event that the Senior Officers believe, acting reasonably, that there is no reasonable likelihood that the Dispute will be resolved by them the Dispute shall be immediately escalated to the Executives, even if the time period specified herein has not yet expired.
Resolution by Senior Officers. If a dispute arises between the Parties in connection with or relating to this Agreement or any document or instrument delivered in connection herewith (a “Dispute”), then either Party may refer such Dispute to the Senior Officers for attempted resolution by good faith negotiations during a period of [*] Business Days. Any final decision mutually agreed to by the Senior Officers in writing is conclusive and binding on the Parties. If such Senior Officers are unable to resolve any such Dispute within such [*]-Business Day period, either Party may institute binding arbitration in accordance with Section 17.3 upon written notice to the other Party (an “Arbitration Notice”) and seek such remedies as may be available.
Resolution by Senior Officers. Except as otherwise provided in this Agreement, in the event of any Dispute between the Parties in connection with this Agreement, the construction hereof, or the rights, duties, or liabilities of either Party hereunder, the Parties shall first attempt in good faith to resolve such Dispute by negotiation and consultation between themselves. If such Dispute is not resolved on an informal basis within ten (10) Business Days, either Party may, by written notice to the other Party, refer the Dispute to the Senior Officer of the other Party (or a designee of such Senior Officer) for attempted resolution by good faith negotiation within thirty (30) days after such notice is received. Such officers, or their designees, shall attempt in good faith to promptly resolve such Dispute.
