Restriction on the issue of Certificates. In accordance with section 6.8 of the Act and any associated regulations, any obligations to: (a) carry out the Works; and (b) dedicate the Dedication Land, must be satisfied prior to the issue of a Construction Certificate for the Development or any part of the Development.
Restriction on the issue of Certificates. ‌ (a) In accordance with section 6.8 of the Act and clause 146A of the Regulation the following obligations under this agreement must be satisfied before a Construction Certificate is issued for the Development or any part of the Development: (i) Payment of the Monetary Contribution in accordance with clause 6.1; (ii) Registration of the covenant required under clause 6.5(a)(i); and (iii) Provision of Securities required under clause 11.2. (b) In accordance with section 6.10 of the Act and clause 154E of the Regulation, the following obligations under this agreement must be satisfied before an Occupation Certificate is issued for the Development or any part of the Development: (i) Payment of the Monetary Contribution in accordance with clause 6.1; (ii) Delivery of the Works in accordance with clause 6.2; (iii) Dedication of the Dedication Land in accordance with clause 6.3; (iv) Registration of the easement in gross required under clause 6.5(a)(ii); and (v) Provision of a Bank Guarantee or Bond for any item of the Works for defects liability and maintenance under the Construction Terms. (c) In accordance with section 6.14 of the Act and clause 148G of the Regulation the following obligations under this agreement must be satisfied before a Subdivision Works Certificate is issued for the Development or any part of the Development: (i) Payment of the Monetary Contribution in accordance with clause 6.1; (ii) Registration of the covenant required under clause 6.5(a)(i); and (iii) Provision of Securities required under clause 11.2. (d) In accordance with section 6.15(1)(d) of the Act, the following obligations under this agreement must be satisfied before a Subdivision Certificate is issued for the Development or any part of the Development: (i) Payment of the Monetary Contribution in accordance with clause 6.1; (ii) Delivery of the Works in accordance with clause 6.2; (iii) Dedication of the Dedication Land in accordance with clause 6.3; (iv) Registration of the easement in gross required under clause 6.5(a)(ii); and (v) Provision of a Bank Guarantee or Bond for any item of the Works for defects liability and maintenance under the Construction Terms

(b) For the purposes of this clause 11.2, “Former Building and Subdivision Provisions” has the same meaning as in clause 18 of the Environmental Planning and Assessment (Savings, Transitional and Other provisions) Regulation 2017.

(b) In accordance with section 6.10 of the Act and any associated regulations (or if the Former Building and Subdivision Provisions apply, section 109H(2) of the Act), the obligation to have paid the full amount of the Monetary Contribution under clause 6.1 must be satisfied prior to the issue of an Occupation Certificate for the Development or any part of the Development.

(c) For the purposes of this clause 11.3, “Former Building and Subdivision Provisions” has the same meaning as in clause 18 of the Environmental Planning and Assessment (Savings, Transitional and Other Provisions) Regulation 2017.
Restriction on the issue of Certificates. (a) Subject to clause 11.2(b), if the Contributions Schedule specifies that a Contribution Item must be delivered prior to the issue of a Certificate, in accordance with provisions of the Act and Regulation (Certification), the relevant Certificate must not be issued unless that Contribution Item has been delivered. (b) Clause 11.2(a) will not apply if: (i) the Developer is unable to complete the Contribution Item due to circumstances beyond its control; (ii) Council has accepted a Bond; and (iii) Council has agreed to defer delivery of the Contribution Item for a reasonable period to allow the relevant circumstances to be resolved and the Certificate to be issued.
