Return of PHI upon Termination. At termination of the Agreement, Business Associate shall return or destroy all PHI received from Covered Entity, or created by or received by Business Associate on behalf of Covered Entity, that Business Associate maintains in any form such that it shall retain no copies of such PHI. Upon request of Covered Entity, Business Associate shall provide a written certification of the return and/or destruction of PHI. If the Parties concur that the return or destruction of such PHI by Business Associate is not feasible, then Business Associate shall continue to extend the protections required hereunder to the PHI for as long as it maintains the PHI. Further, Business Associate shall limit any further use or disclosure of the PHI to those purposes that make its return or destruction unfeasible. This provision shall survive the termination of this Agreement.
Return of PHI upon Termination. Upon termination of the Agreement for any reason, Crown shall return to Constar all PHI received from Constar or created or received by Crown on behalf of Constar and which Crown still maintains in any form. Prior to doing so, Crown further agrees to recover any PHI in the possession of its subcontractors or agents. Crown shall not retain any copies of such PHI. If it is not feasible to return such PHI as determined by Constar, Crown agrees to extend any and all protections, limitations, and restrictions in this Section 4.9 to Crown’s use and disclosure of any PHI retained after the termination of the Agreement, and to limit any further uses and disclosures to the purpose or purposes that make the return of PHI infeasible. If it is not feasible for Crown to obtain from a subcontractor or agent any PHI in the possession of the subcontractor or agent, Crown will require the subcontractor and/or agent to agree to extend any and all protections, limitations, and restrictions in this Section 4.9 to the subcontractors’ and/or agents’ use and disclosure of any PHI retained after the termination of the Agreement, and to limit any further uses and disclosures to the purposes that make the return of the PHI infeasible.

If it is not feasible for Business Associate to obtain from a subcontractor or agent any PHI in the possession of the subcontractor or agent, Business Associate must require the subcontractor and/or agent to agree in writing to extend any and all protections, limitations, and restrictions in this BAA to the subcontractors’ and/or agents’ use and disclosure of any PHI retained after the termination of the BAA, and to limit any further uses and disclosures to the purposes that make the return of the PHI infeasible.

If it is not feasible for Supplier to obtain from a subcontractor or agent any PHI in the possession of the subcontractor or agent, Supplier will require the subcontractor and/or agent to agree to extend any and all protections, limitations, and restrictions in this Section 4.7 to the subcontractors’ and/or agents’ use and disclosure of any PHI retained after the termination of the Agreement, and to limit any further uses and disclosures to the purposes that make the return of the PHI infeasible.

Upon request of Delta Dental, BA shall provide a written certification of the return and/or destruction of PHI. If the parties concur that the return or destruction of such PHI by BA is not feasible, then BA shall continue to extend the protections required hereunder to the PHI for as long as BA maintains the PHI. Further, BA shall limit any further use or disclosure of the PHI to those purposes that make its return or destruction infeasible. This provision shall survive the termination of this Agreement. Delta Dental may terminate the Agreement immediately upon written notice to BA without damages or liability to Delta Dental if Delta Dental determines that BA has violated a material term of this Agreement. Notwithstanding the foregoing, Delta Dental, at its option and within its sole discretion, may (a) take steps to cure or cause BA to cure the breach; and (b) in the event of such a cure, elect to keep the Agreement in force.
Return of PHI upon Termination. Upon termination as provided for in Section 13 of this Agreement, CCNC shall return or destroy all PHI received from or created or received by CCNC on behalf of Covered Entity that CCNC still maintains in any form and retain no copies of such information. In the event that CCNC determines that returning or destroying the PHI is infeasible, CCNC shall provide to Covered Entity notification of the conditions that make return or destruction infeasible, and CCNC shall extend the protections of this Agreement to such PHI and limit further uses and Disclosures of such PHI to those purposes that make the return or destruction infeasible, for so long as CCNC maintains such PHI.
Return of PHI upon Termination. Upon termination of this Agreement for any reason, Subcontractor agrees either to return all PHI or to destroy all PHI received from TokenEx or otherwise through the performance of services under the Business Arrangements that is in the possession or control of Subcontractor or its Subcontractors. In the case of PHI for which it is not feasible to return or destroy, Subcontractor shall extend the protections of this Agreement to such PHI and limit further uses and disclosures of such PHI to those purposes that make the return or destruction infeasible, for so long as Subcontractor maintains such PHI. Subcontractor shall comply with other applicable state or federal law, which may require a specific period of retention, redaction, or other treatment of such PHI. This Section 10.6 shall survive the expiration or termination of this Agreement and shall remain in effect for so long as Subcontractor maintains PHI.
Return of PHI upon Termination. Upon termination of this Agreement, HealthierHere shall return or destroy all PHI received from, or created or received by the CIE on behalf of, Participant that the CIE still maintains in any form and retain no copies of such PHI. If return or destruction of PHI is not feasible, HealthierHere agrees to continue to extend the protections of this Agreement to such information, and limit further use of Participant's PHI to those purposes that make the return or destruction of such PHI infeasible. The Parties acknowledge and agree that it would be infeasible for HealthierHere to return or destroy PHI that Participant has disclosed to HealthierHere for purposes of the CIE under Participation Agreement.
