Return of the House. 7.1 Return date and scope of use

Return of the House. 5.1 After the expiry of the agreement, the lessee shall return the house according to the time notified by the lessor. If the house cannot be returned on time for the reason of the lessee and there exists a new lessee, the lessor has right to request the lessee to leave the house in 3 days and deduct part of or entire guaranty money of the lessee. In case the guaranty money is not sufficient for the compensation of the losses, which the lessor has suffered, the lessor is entitled to claiming for the insufficient part. If the house has not been rented to other lessees, the lessor will deem that the lessee will renew the house. In this case, the renewal procedure shall be made by the lessee; otherwise the lessor will have right to request the lessee to leave the house and deduct part of or entire guaranty money.
Return of the House. 13.1 Before expiration or earlier termination of the lease term hereunder, Party B shall restore the House and its installations, devices and equipment items to the same status as delivered to Party B (except normal depreciation and wear) and return the House to Party A in a good and clear condition. If both Party A and Party B agree to keep any internal renovation, decoration or accessory inside the House, Party A does not have to compensate Party B for any such internal renovation, decoration or accessory.
Return of the House. 13.1 Upon expiry of the lease term or termination of this Contract (including termination due to breach of contract), Party B must evacuate from the Leased Unit and return the same to Party A within three (3) days. If Party B fails to do so on time, Party A may immediately retrieve the Leased Unit and the keys thereto, and may also change the lock, control the access of other persons and clear away all articles from the Leased Unit. In that case, Party B shall be responsible for all consequences and liabilities resulting therefrom.

Any Person purchasing or otherwise acquiring any interest in any Units shall be deemed to have notice of and consented to the provisions of this Section 8.4. Neither the alteration, amendment or repeal of this Section 8.4, nor the adoption of any provision of this Agreement inconsistent with this Section 8.4, shall eliminate or reduce the effect of this Section 8.4 in respect of any business opportunity first identified or any other matter occurring, or any cause of action, suit or claim that, but for this Section 8.4, would accrue or arise, prior to such alteration, amendment, repeal or adoption.

  • Investment Opportunities and Allocation The Advisor shall be required to use commercially reasonable efforts to present a continuing and suitable investment program to the Company that is consistent with the investment policies and objectives of the Company, but neither the Advisor nor any Affiliate of the Advisor shall be obligated generally to present any particular investment opportunity to the Company even if the opportunity is of character that, if presented to the Company, could be taken by the Company. In the event an investment opportunity is located, the allocation procedure set forth under the caption “Conflicts of Interest – Certain Conflict Resolution Measures – Allocation of Investment Opportunities” in the Registration Statement shall govern the allocation of the opportunity among the Company and Affiliates of the Advisor.

  • Formation of the Company The Company was formed as a limited liability company under the Act on April 24, 2008. The Member hereby agrees that the person executing and filing the Certificate of Formation of the Company was and is an “authorized person” within the meaning of the Act, and that the Certificate of Formation filed by such authorized person is the Certificate of Formation of the Company.
