Revocation of License Agreement. A. University may revoke Agreement upon the following condition: 1. Licensee’s breach of any term or condition of this License Agreement, including failure to abide by Student Housing and Residential Education Policies as outlined in 2021-2022 Code of Student Conduct. 2. Violation of State or Federal Law 3. Failure of Licensee to maintain status as a full-time student at University 4. Licensee’s breach of any term or condition of this License Agreement, including failure to pay required fees in a timely manner. 5. Administrative necessity of University. B. University shall provide Licensee no less than three (3) days notice in the event of an occurrence described in subsections (IXA1), (IXA2), (IXA3), or (IXA4) and no less than fourteen (14) days written notice in the event of an occurrence described in subsection (IXA5) except in cases of emergency. C. Licensees who have agreement revoke may be held to fee equivalent to 30-days of occupancy based on their assigned space plus a pro-rated amount based on their specified move-out day. Pro-rated amounts shall be equivalent to amounts outlined in section VIII.D.1 and VIII.D.2. Licensees who upon notice of revocation continue to engage in behaviors that constitute a breach of license agreement in sections IX.A.1 – IX.A.4 may be held for full term of the agreement.

Revocation of License Agreement. A. University may revoke this License Agreement upon the following conditions: ▪ In the event of misconduct listed in Section 41301, Title 5, California Code of Regulations. ▪ Administrative necessity of University; this includes University receiving notice of Admissions Denial or Withdrawal of Licensee. ▪ Failure of Licensee to maintain status as a student at University. ▪ Licensee's breach of any term or condition of this License Agreement or regulations outlined in the ResLife & You Handbook, including failure to pay required fees. B. University shall provide Licensee not less than three (3) days' notice in the event of an occurrence described in subsections (1), (3) or (4) and not less than fourteen (14) days' written notice in the event of an occurrence described in subsection (2) except in cases of emergency. C. It is critical that the Licensee recognize that revocation of the Housing License as a result of disciplinary action does not release the Licensee from his/her financial obligation to Housing & Residence Life and Dining Services for the full license period. Disciplinary action may be taken when violations of any of the parameters outlined in the License or ResLife & You Handbook occur. When revoking a Housing License, the President or his/her designee will determine what disciplinary action and fees will be assessed and will so notify the Licensee.

Student Conduct Violation(s), as listed in Title V, California Code of Regulations, Article 2, Section 41301. 2. Reasonable cause to protect personal safety or property and to insure the maintenance of order. 3. In the event that Licensee’s behavior on or off campus results in legal action and creates a perception that disruption or danger may be associated with the Licensee’s continued occupancy. 4. Failure of Licensee to maintain status as a student at the University. 5. Licensee's breach of any term or condition of this License Agreement, including failure to pay required fees. 6. Administrative necessity of the University. B. The University shall provide Licensee not fewer than three (3) days’ notice to vacate in the event of an occurrence described in Section VIII, subsections (1), (2) or (3) and not less than fourteen (14) days’ written notice to vacate in the event of an occurrence described in Subsections (4), (5) or (6) except in cases of emergency. In exceptional circumstances, the Director of Housing and Residential Life may issue an immediate Notice to Evict. C. Disciplinary revocation of theStudent Housing License Agreement” is not considered a standard for cancellation and thus will not release the Licensee from paying any outstanding housing or related fees. D. Licensees who have had a previous license agreement revoked due to conduct violations may be denied future occupancy.

The Licensee is convicted of any misdemeanor or felony committed on university property, or involving any member of the university community (e.g., students, staff, faculty) whether on or off university property, or that is otherwise university related. 2. Breach of any term of this License Agreement, specifically including, but not limited to, breach of any of the Policies & Regulations referenced in this License Agreement and found at: xxxxx://xxxxxxx.xxxx.xxx/campus_living/policies.aspx.

C) In the event of occurrence as described in Subsection (2) or (4) above, the Licensee shall owe an amount equal to the prorated charge for each day from the beginning of the License Term through the last day of occupancy, plus any damages to the property as described in 42019, Title V, California Code of Regulations. D) In the event of occurrence as described in Subsection (1) or (3) above, except as noted in 42019, Title V, California Code of Regulations, the Licensee may be determined to owe the amount due under the full License Term plus any damages to the property as described in 42021, Title V, California Code of Regulations.

In the event of University administrative necessity for license revocation (i.e. in rare cases of destruction or unavailability). In the event of an occurrence described in subsections (1), (2), or (3), the University shall give Licensees not less than three (3) days written notice; in the event of an occurrence described in subsection (4) the University shall grant licensees not less than fourteen (14) day notice except in cases of emergency.

Revocation of License Agreement. University may revoke this License Agreement for any of the following reasons: a. Conduct by the Licensee, which, in the determination by the Director or designee, constitutes or would constitute misconduct within the meaning of section 41301 of Title V, California Code of Regulations. No disciplinary proceedings need be commenced against the Licensee by the University under section 41301 for purposes of revocation of the License Agreement under this section; furthermore, the License Agreement may be revoked under this section regardless of whether disciplinary proceedings are commenced against the Licensee by the University under section 41301, and regardless of the outcome of those disciplinary proceedings. b. If the Licensee is convicted of any misdemeanor or felony committed on University property, or involving any member of the University community (e.g. students, staff, or faculty) whether on or off University property or that is otherwise University-related. c. Breach of any term of this License Agreement, specifically including, but not limited to, breach of any of the Policies and Regulations contained in this License Agreement.
