Right of Access to PHI. Business Associate hereby agrees to allow an individual who is the subject of PHI maintained in a designated record set, to have access to and copy that individual’s PHI within five (5) business days of receiving a written request from the Covered Entity. Business Associate shall provide PHI in the format requested, unless it cannot readily be produced in such format, in which case it shall be provided in standard hard copy. If any individual requests from Business Associate or its agents or subcontractors access to PHI, Business Associate shall notify Covered Entity of same within five (5) business days. Business associate shall further conform with and meet all of the requirements of 45 C.F.R. §164.524 and other applicable laws.

Right of Access to PHI. Business Associate shall allow, for any PHI maintained in a designated record set, Covered Entity to have access to and copy an individual’s PHI within five (5) business days of receiving a written request from the Covered Entity. Business Associate shall provide PHI in the format requested, if it is readily producible in such form and format; or if not, in a readable hard copy form or such other form and format as agreed to by Business Associate and the individual. If the request is for information maintained in one or more designated record sets electronically and if the individual requests an electronic copy of such information, Business Associate must provide Covered Entity with access to the PHI in the electronic form and format requested by the individual, if it is readily producible in such form and format; or, if not, in a readable electronic form and format as agreed to by the Business Associate and Covered Entity. If any individual requests from Business Associate or its agents or subcontractors access to PHI, Business Associate shall notify Covered Entity within five (5) business days. Business Associate shall further conform with all of the requirements of 45 C.F.R. § 164.524 and other applicable laws, including the HITECH Act, as amended, related regulations and agency guidance. Business Associate shall indemnify Covered Entity for costs/damages associated with Business Associate’s failure to respond within the time frames set forth in this subsection 3(f).
Right of Access to PHI. The Business Associate agrees to make available PHI in a designated record set maintained by the Business Associate or its agents or subcontractors to the Covered Entity as necessary to satisfy the covered entity’s obligations under 45 CFR 164.524 within ten days (10) days of the date of any such request. Business Associates agrees to forward all requests made directly to the Business Associate from individuals seeking access to PHI.

Business associate shall further conform with and meet all of the requirements of 45 C.F.R. § 164.524 and other applicable laws, including the HITECH Act and related regulations, and agency guidance.
Right of Access to PHI. SutureHealth hereby agrees to allow an individual who is the subject of PHI maintained in a designated record set, to have access to and a copy of, in electronic format if requested, that individual’s PHI within five (5) business days or such other reasonable time period as provided for by law of receiving a written request from Covered Entity. However, if Covered Entity is able to provide the PHI for the individual making the request, Covered Entity shall provide such PHI and release SutureHealth from this obligation unless it pertains to a particular service provided by SutureHealth. SutureHealth shall provide PHI to the extent and in the manner required by 45 C.F.R. § 164.524 and other applicable federal and state law and agency guidance. If any individual requests from SutureHealth or its agents or subcontractors access to PHI, SutureHealth shall notify Covered Entity of same within five (5) business days or such other reasonable time period under the circumstances. SutureHealth shall further conform with and meet all of the requirements of 45 C.F.R. §164.524 and other applicable laws, including the HITECH Act and related regulations, and agency guidance.

Business Associate shall provide PHI in the format requested, if it is readily producible in such form and format; or if not, in a readable hard copy form or such other form and format as agreed to by Business Associate and the individual. If the request is for information maintained in one or more designated record sets electronically and if the individual requests an electronic copy of such information, Business Associate must provide the DOC with access to the PHI in the electronic form and format requested by the individual, if it is readily producible in such form and format; or, if not, in a readable electronic form and format as agreed to by the Business Associate and the DOC. If any individual requests from Business Associate or its agents or subcontractors access to PHI, Business Associate shall notify the DOC within five (5) business days. Right of Access to PHI. At the request of and in the time and manner directed by Covered Entity but no later than two (2) business days after any such request, Business Associate will provide access to and a right to copy PHI in a Designated Record Set, to Covered Entity or, as directed by Covered Entity, to the Individual, in conformance with the requirements of 45 CFR §164.524. In the event an Individual requests access to PHI directly from Business Associate, Business Associate will confirm with Covered Entity in writing that the Individual is entitled to receive such access prior to making the records available.
