Right to Rescission. If you are switching to Amigo Energy from a different REP, you may rescind this Agreement without penalty at any time before midnight of the third federal business day after receiving this Agreement. PUCT rules permit Amigo Energy to assume that you will receive this Agreement three (3) federal business days after we mail it to you. Right to Cancel Amigo Energy may cancel your Agreement if you do not pay your bills in full and on time. Customer may cancel this Agreement without penalty in the event Amigo Energy can no longer provide service. Customer may also cancel this Agreement without penalty by giving notice of a move to a different premise and providing reasonable proof of such move, including but not limited to a forwarding address. In the absence of such proof, Amigo Energy will charge an Early Termination Fee as stated in your EFL. Amounts owed by you to Amigo Energy shall become immediately due and payable. Billing & Payment FollowingtheswitchtoAmigoEnergyfromyourcurrentprovider,youmayreceiveabillforlessthanonemonth’sservice.Afterthe initial xxxx, you will receive a new xxxx from Amigo Energy each month for each ESI ID for which you are receiving service pursuant to this Agreement. If actual charges are not available to Amigo Energy at the time of preparation of your invoice, Amigo Energy reserves the right to xxxx you on good faith estimates of charges for the month. If estimated charges are included on your invoice, they shall be identified as such and shall be reconciled against actual charges once Amigo Energy has received such actual charges.
Right to Rescission. If you are switching energy providers at your existing service address, you may cancel your acceptance of the Agreement without penalty or fee by contacting us before midnight of the third federal business day after you receive your Agreement through the mail or email, as applicable. This right of rescission is not applicable to move-in requests. Cancelling your Agreement The Agreement term is stated in the EFL. At the end of your Agreement term, you may cancel or terminate your Agreement by switching to a new provider. If you cancel the Agreement before the end of your Agreement term, you agree to pay the early termination fee (“ETF”) in the amount indicated in the EFL, and you must select another REP in order to continue to receive electric service. If you move from your existing premise during the Agreement term you are under no obligation to continue the Agreement at your new location. You may be required to provide evidence that you moved. There is no ETF assessed if you relocate if you provide a forwarding address and, if requested, reasonable evidence that you no longer occupy the location specified in the Agreement. Our obligations will end after the meter read date where we are no longer designated as your REP. Your obligations under the Agreement will end, except for the provisions herein that expressly survive expiration or termination, when your account balance is paid in full. If you cancel electric service, you may continue to receive charges for any Third-Party Services until the Third-Party Services are cancelled or terminated. You will not continue to receive charges if the Third-Party Services are scheduled to cancel automatically when your electric service Agreement with us is cancelled or terminated. You may be assessed an ETF for any non-electricity services (if applicable) in addition to your ETF for your electricity services. Please refer to additional Service Agreements for more information. Right to Rescission. In the event that more than five percent (5%) of the class members opt-out of the Settlement, Defendant has the right to rescind the Settlement. The Parties agree that if ITS exercises its option to rescind the Settlement, it will be responsible for the Settlement Administrator fees. Otherwise, if the Settlement is not finally approved by the Court, the Parties will be responsible for the Settlement Administrator’s fees on a 50/50 basis.

For Account(s) located in the State of Ohio, if your Account(s) is classified by the UDC as a ''Small Commercial Customer'' (defined as a commercial or industrial customer using less than 700,000 kWh annually and not part of a national account with multiple facilities in one or more states), you will receive a confirmation notice from your UDC indicating your selection of Seller as your Competitive Retail Electric Service Supplier (''CRES Supplier''). Upon receipt of the notice, you may rescind this Agreement without penalty at any time within the 7-day rescission period by following the instructions provided by the UDC. You must write or call the UDC to submit your rescission request by following the instructions on the UDC notice.
Right to Rescission. If more than 5% of the Class Members request exclusion from the Settlement Class (i.e., opt-out), Defendants shall have the right, in their sole discretion, to rescind and void this Settlement Agreement before final approval by the Court.
