Royalty Payment and Reports. Within the Reporting Period after the end of each Calendar Quarter after the First Commercial Sale of a Licensed Product, Licensee will deliver to Licensor a report containing the following information for the prior Calendar Quarter:

Royalty Payment and Reports. Within forty-five (45) days after the end of each calendar quarter, Somaxon shall submit to ProCom One a written report setting forth for such preceding calendar quarter, the Net Sales and the calculation of the Royalty payable to ProCom One pursuant to Section 4.2. Such royalty report shall be accompanied by the total Royalty due to ProCom One. All payments shall be made in U.S. Dollars.
Royalty Payment and Reports. Upon execution of this Agreement and any renewal of this Agreement, Licensee shall pay to UA an annual royalty fee in the amount of one hundred dollars ($100.00). Licensee can purchase 500 “Officially Licensed Collegiate Product” labels, which are required to be on each item sold, for thirty dollars ($30.00). Licensee shall provide UA a complete sales report for each Licensed Article sold during the Term or renewal period, including total units of Licensed Articles sold, the gross amount received, and the specific location where such sales were made. Royalty Payment and Reports. Within [*] after the end of each calendar quarter after the Commercial Launch, Portola shall deliver to Millennium a report containing the following information for the prior calendar quarter:
Royalty Payment and Reports. 3.1 In consideration of the rights and licenses herein granted in the Licensed Patents and Technical Information, Licensee shall pay Licensor: a non-refundable payment of $200,000 (“License Fee”), payable upon the effective date of this agreement through the forgiveness of certain debts as described in the attached “Agreement to Convert Debt dated March 29, 2011”. In addition there shall be a payment of three percent (3%) of the Gross Sales of all Licensed Products made, used, sold, offered for sale, imported, leased, or otherwise transferred by or on behalf of Licensee (“Royalty Payment”) during the first year following sales of Licensed Product. Such Royalty Payment shall be 4% of the Gross Sales of all Licensed Products during the second year of sales of Licensed Product. Such Royalty Payment shall be 4.5 % of the Gross Sales of all Licensed Products during the third year of product sales and shall remain at this level throughout the remaining term of the agreement . Gross sales shall be adjusted appropriately for refunds and volume discounts offered by the Licensee to its customers..
Royalty Payment and Reports. The royalties payable pursuant to Section 3.3 shall be paid within sixty (60) days after the last day of each Calendar Quarter with respect to Net Sales occurring during such Calendar Quarter. Each such payment shall be accompanied by a statement, in sufficient detail describing the Licensed Products sold, the country of sale, the amount of Licensed Product sold and the basis for calculating the accrued royalties. After the First Commercial Sale, such statement shall be prepared whether or not Abbott has recorded any sales in such Calendar Quarter. All information provided by Abbott pursuant to this Section shall be deemed Confidential Information.
Royalty Payment and Reports. (a) Royalty amounts payable to RiboGene under Section 5.2 shall be paid in U.S. Dollars within [ * ] of the end of each calendar quarter. Each payment of royalties shall be accompanied by a statement of the amount of Net Sales during such period, the amount of aggregate Net Sales to date as of the end of such period, and the amount of royalties due on such Net Sales.

Royalty Payment and Reports. Royalty payments under this Agreement shall be made to Scriptgen within ninety (90) days following the end of each calendar quarter for which royalties are due. Each royalty payment shall be accompanied by a statement summarizing the Net Sales and royalty by United States and outside the United States showing: (i) the Net Sales of the Products sold by Lilly, its Affiliates, and its sublicensees during the reporting period; (ii) the royalty due thereon; and (iii) withholding taxes, if any, required by law to be deducted in respect of such royalties. If no royalty is due for any royalty period hereunder, Lilly shall so report. Lilly shall keep complete and accurate records in sufficient detail to properly reflect all gross sales and Net Sales and to enable the royalties payable hereunder to be determined.
