Schedule of Deliveries. (a) Buyer will order its weekly Milk requirements for the Plant from Seller on Thursday for delivery the following Sunday through Saturday. Buyer shall specify the schedule and times of delivery.
(b) The parties hereto recognize that due to normal but unanticipated business occurrences, it may be necessary from time to time for Buyer to increase or decrease the amount of Milk ordered during the week it is to be delivered. Buyer agrees to minimize these occurrences as much as possible under the circumstances, and Seller agrees on such occasions to accommodate Buyer's needs as rapidly as possible under the circumstances.
(c) Seller will make all reasonable efforts to supply Buyer's Milk every day with loads from the same producers.
Schedule of Deliveries. Buyer, on behalf of the Plant, will order the Plant’s weekly Demand Milk requirements from Seller on Thursday for delivery the following Sunday through Saturday. Buyer and Seller will mutually agree to the schedule and times of delivery. Scheduling will principally consist of weekly receipt assignments in a uniform manner throughout the seven-day week, and on occasion, receipts may be more heavily weighted on weekends and/or holidays. Seller shall use reasonable commercial efforts to meet said schedule and times of delivery.
Schedule of Deliveries. 6.1. SUPPLIER shall make available all the documentation, machinery and equipment and perform all the services under this Contract in full compliance with the Scope of Supply and the Schedule of deliveries set forth below.
Schedule of Deliveries. Vendor acknowledges that time is of the essence and therefore agrees to the following schedule:
X. Xxxxxx will set up a "demonstration site" having full internet functionality as set forth above for World Internetworks Inc. no later than March 15, 1999.
B. Vendor will make all necessary modifications, if any, that are identified and agreed upon by both parties as a result of such demonstration, for incorporation into the final product offering.
Schedule of Deliveries. Supplier shall meet the schedules set forth herein.
4.1. The Machinery shall be ready for delivery by the Supplier to the entrusted Forwarding Agent by December 23, 2013 (Machinery and Equipment Delivery Date (FCA Breton). Reasonable time before the expected delivery date of the Machinery to the Forwarding Agent (if possible no less than one month before the said date) Supplier shall notify Buyer in writing that the Machinery is ready to be delivered, in order to allow the Buyer to make the necessary arrangements for the delivery.
Schedule of Deliveries. Buyer shall attempt to schedule deliveries of the Product uniformly throughout the calendar year. Not more than [*****] percent ([*****]) of the annual Minimum quantity of the Product shall be scheduled for delivery in any calendar month, except with Seller’s prior written consent. Buyer understands that Seller’s plant is connected by pipeline with Buyer’s plant, and that Seller is not able to maintain inventories of Product in its molten form. Accordingly, Buyer agrees to provide Seller with rolling [*****] ([*****]) month forecasts at the beginning of each month.
Schedule of Deliveries. All deliveries shall be made in accordance with the delivery schedule set forth in the Order.
Schedule of Deliveries. All deliveries of Direct Purchases shall be made in accordance with the delivery schedule set forth in the applicable Order or any amendment thereto. Except for Fast Flow Orders, Seller shall be under no obligation to effect a delivery of an Order for Fine Papers originating from one of Seller's domestic Manufacturing Facilities in fewer than [******] (exclusive of Seller's non-production days) or to effect a delivery of an Order for Fine Papers originating from the Manufacturing Facilities of Seller's overseas Affiliates in fewer than [******] (exclusive of Seller's non-production days). For Fast Flow Orders, Seller shall effect delivery of the quantity so ordered within [******] of receiving such Order.
Schedule of Deliveries. Supplier shall meet the schedules set forth herein.
4.1. The Machinery and the Spare Parts shall be ready for delivery by the Supplier to the entrusted Forwarding Agent by March 14, 2014 (Machinery and Equipment Delivery Date).
4.2. Completion of Cold Test: within three calendar weeks after the Machinery have reached the Site.
4.3. Date of Plant Delivery Completion: within two calendar weeks following the completion of the above Cold Test; that is until May 5th 2014 considering that all Machineries are available on Site by March 31, 2014. *** Confidential treatment has been requested for redacted portions of this exhibit. 4.4. Notwithstanding Section 6.1(b) of the Main Agreement, Supplier shall provide the technical documentation within the following time frames:
4.4.1. The Layouts specified in Sections 6.1(b)(1)-(2) will be delivered by Supplier to Buyerwithin 14 calendar days following the Effective Date of this Addendum. The Layouts specified in Sections 6.1(b)(3)-(4) will be delivered by Supplier to Buyerwithin 30 calendar days following the Buyer’s approval of the general layout as per Section 6.1(b)(1).
4.4.2. The spare parts catalog and a List of recommended spare parts which will include the prices of each spare part, will be delivered by Supplier to Buyerwithin 15/11/2013. Supplier shall provide the spare parts catalog, in two hard copies, in English, and one copy on magnetic media.
4.4.3. The Operation and maintenance handbooks of machines and equipment and relevant electric diagrams and spare parts will be supplied by the Supplier with the Machinery. No penalties, as per article 6.3 of the Main Agreement, will be applied to this supply for any delays on either delivery of equipment or “Completion of Cold Test” or “Plant Delivery Completion”. –
