Scheduled Completion Date. 12.4.1 On or after the Appointed Date, the Concessionaire shall undertake construction of Project and Project Facilities as specified in Schedule-B, and in conformity with the Specifications and Standards set forth in Schedule-C. The 1460th (Fourteen hundred and sixtieth day) from the Appointed Date shall be the scheduled date for completion of the Project (the "Scheduled Completion Date") and the Concessionaire agrees and undertakes that Mandatory Project and Mandatory Project Facilities shall be completed on or before the Scheduled Completion Date .
12.4.2 The Concessionaire shall construct the Mandatory Project and Mandatory Project Facilities in accordance with the Project Completion Schedule set forth in Schedule-G. In the event that the Concessionaire fails to achieve any Project Milestone within a period of 90 (ninety) days from the date set forth for such Milestone in Schedule-G, unless such failure has occurred due to Force Majeure or for reasons solely attributable to the Authority, it shall pay Damages to the Authority to the extent of Rs. 35,000 (Rupees thirty five thousand) for delay of each day until such Milestone is achieved; provided that if any or all project milestones or the Scheduled Completion Date are extended in accordance with the provisions of this agreement, the dates set forth in Schedule G shall be deemed to be modified accordingly and the provisions of this agreement shall apply as if Schedule G has been amended as above; provided further that in the event Project Completion Date is achieved, the damages paid under this Clause
Scheduled Completion Date.
12.4.1 The Mine Operator agrees and undertakes that development of Mines for excavation and Delivery of Coal shall be undertaken in a manner such that (i) the Commercial Operations Date occurs on or prior to [****] days from the Appointed Date (“Scheduled COD”); and (ii) the Completion occurs on or prior to [****] days from the Appointed Date (“Scheduled Completion Date”).
12.4.2 In the event that the Mine Operator fails to achieve any Project Milestone within a period of 60 (sixty) days from the date set forth for such Project Milestone in Schedule-G, unless such failure has occurred due to Force Majeure or for reasons solely attributable to the Authority, it shall pay Damages to the Authority in a sum calculated at the rate of 0.5% (zero point five per cent) of the amount of Performance Security for delay of each day until such Project Milestone is achieved; provided that if any or all Project Milestones, or the Scheduled COD, or the Scheduled Completion Date are extended in accordance with the provisions of this Agreement, the dates set forth in Schedule-G shall be deemed to be modified accordingly and the provisions of this Agreement shall apply as if Schedule-G has been amended as above. For the avoidance of doubt, it is agreed that recovery of Damages under this Clause 12.4.2 shall be without prejudice to the rights of the Authority under this Agreement, including the right of Termination thereof.
Scheduled Completion Date. 5.1 The Scheduled Completion Date shall occur on the ( ) day from the Appointed Date.
5.2 On or before the Scheduled Completion Date, the Developer shall have completed Construction and Development of the Project Assets in accordance with this Agreement.
Scheduled Completion Date.
12.4.1 The Mine Operator agrees and undertakes that development of Mines for excavation and Delivery of Coal shall be undertaken in a manner such that the Commercial Operations Date occurs on or prior to the Scheduled COD6; and the Completion occurs on or prior to the Scheduled Completion Date
12.4.2 On or before Appointed Date, the Mine Operator shall have to submit a Project Completion Schedule in accordance with the approved Mining Plan and Schedule-G. For proper monitoring of the project schedule, the Project Completion Schedule shall be submitted in Microsoft-Project. Each Project Milestone in the Project Completion Schedule shall have completion date and all the Project Milestone of the Project Completion Schedule should have been completed within a specified date (the “Scheduled Completion Date”). In the event that the Mine Operator fails to achieve any Project Milestone within a period of 60 (sixty) days from the date set forth for such Project Milestone , unless such failure has occurred due to Force Majeure or for reasons solely attributable to the Authority, it shall pay Damages to the Authority in a sum calculated at the rate of 0.1% (zero point one per cent) of the amount of Performance Security for delay of each week, or part of the week, beyond such period of 60 (sixty) days until such Project Milestone is achieved; provided that if any or all Project Milestones, or the Scheduled COD, or the Scheduled Completion Date are extended in accordance with the provisions of this Agreement, Project Completion Schedule shall be deemed to be modified accordingly and the provisions of this Agreement shall apply as if Project Completion Schedule has been amended as above. For the avoidance of doubt, it is agreed that recovery of Damages under this Clause 6 “Scheduled COD” shall be the first day of the succeeding Accounting Year of the year in which at least 50% of the Contracted Capacity is scheduled in Annual Production Programme.
Scheduled Completion Date. 5.1 The Scheduled Completion Date shall be the 730th (seven hundred and thirtieth) day from the Appointed Date.
5.2 On or before the Scheduled Completion Date, the Concessionaire shall have completed the Project in accordance with this Agreement.
Scheduled Completion Date. 12.1.1 On or after the Appointed Date, the Company/Consortium shall start procurement and deployment in accordance with Schedule H. The 150th ( one hundred fiftieth) day from the Appointed Date shall be the scheduled date for completion of providing Project Facilities (the “Scheduled Completion Date”) and the Company/Consortium agrees and undertakes that the procurement and deployment of the Project Facilities shall be completed on or before the Scheduled Completion Date.
12.1.2 In the event that the Project Facilities for the Project are not completed by the Scheduled Completion Date, unless the delay is on account of reasons solely attributable to CPI or due to Force Majeure, it shall pay Damages to CPI in a sum calculated at the rate of 0.1% (zero point one percent) of the amount of Performance Security for delay of each day until the Project Facilities are completed. In the event, the Project Facilities are not completed within 60 (sixty) days of the Scheduled Completion Date, CPI shall be entitled to terminate this Agreement, blacklist the Company/Consortium and appropriate the entire Performance Security.
Scheduled Completion Date. 12.4.1 On or after the Appointed Date, the Concessionaire shall undertake construction of the Project Facilities as specified in Schedule B. The 730th (Seven Hundred and Thirtieth) day from the Appointed Date shall be the scheduled date for completion of the Project Facilities (the “Scheduled Completion Date”) and the Concessionaire agrees and undertakes that the construction of the MLCP and its components shall be completed on or before the Scheduled Completion Date.
Scheduled Completion Date. 19.4.1 The Mine Developer and Operator agrees and undertakes that development of Mines for excavation and Delivery of Coal shall be undertaken in a manner that the Completion and Commercial Operations Date occurs as per the timelines mentioned in Project Completion Schedule and the peak rated capacity occurs as per the approved Mining Plan (“Scheduled Rated Capacity Date”)
19.4.2 In the event that the Mine Developer and Operator fails to achieve Scheduled COD, or the Scheduled Completion Date or Scheduled Rated Capacity Date, or any or all of the Project Milestones as set forth in Schedule G, within the period specified in respect thereof unless due to Force Majeure, TANGEDCO may, in its discretion either terminate this Agreement in accordance with Article 44 or grant extension of time for fulfilment. However, in the event TANGEDCO grants any such extension, then it shall deduct from the Performance Security an amount equivalent to (0.5% zero point five percent) of the Performance Security for each week of such extension granted in respect of fulfilment of Scheduled COD, or the Scheduled Completion Date or Scheduled Rated Capacity Date or any or all of the Project Milestones as set forth in Schedule G as applicable.
