School Responsibilities. a. The School shall provide documentation that each Student assigned to the rotation is in compliance with the Participating Institution's immunization requirements and ensure that each Student has personal medical insurance coverage during their activities at the Participating Institution. b. The number of students shall be mutually agreed upon by the parties. The School shall inform the Participating Institution immediately of any changes in the schedule. The School shall advise Participating Institution if any Students have medical problems or physical disabilities requiring special accommodations. e. The School shall instruct preceptors that while they may delegate part of their teaching responsibilities to other paramedical personnel, as the clinical situations may determine, they are ultimately responsible for providing an appropriate learning experience for the Student. In no case may the Student perform procedures on patients without the direct supervision of the assigned preceptor. f. The School shall provide to the preceptor complete guidelines of behavioral and/or instructional objectives for the Student as required by the School. g. The School shall provide academic supervision of the Students and monitoring of the rotation in consultation with the preceptors. h. The School shall retain ultimate responsibility for Student grades and evaluations. i. The School shall submit proof of professional and/or malpractice liability insurance coverage for Students and faculty during the term of this Agreement with minimum policy limits in the amount of $1,000,000 per occurrence and $3,000,000 in the aggregate. The School shall provide the Participating Institution with a copy of the Certificate of Insurance. j. The School shall provide evidence of each Student’s acknowledgment of his/her obligations of compliance with Participating Institutions’ established OSHA, Privacy and Security policies and guidelines, of which the School has been informed in this Agreement. k. The School shall ensure that each Student involved in clinical experiences has received sufficient instruction in the relevant theory and has satisfactorily completed the prerequisite portion of the curriculum and to insure that: 1) Each Student complies with the Participating Institution's policies, procedures, and standards of practice. 2) The Student wears the proper attire, as defined by the Participating Institution dress code, including a name tag identifying the individual as a Student. 3) Each Student has complied with the health and immunization requirements of the Participating Institution, including but not limited to the mandatory COVID-19 vaccination. 4) Each Student is informed of and will be required to keep any scheduled appointment with the Participating Institution. l. The School shall retain responsibility for its faculty and Students for the planning, teaching, and evaluating the Student’s clinical practice. m. School shall provide to the Participating Institution a copy of a completed, negative drug screen for each Student prior to the start of the clinical rotation. The drug screen must be a 10- substance abuse panel (SAP), Urine, Non-Dot test that is administered no sooner than 30 day prior to the start date the clinical rotation at no cost to the Participating Institution.

If School provides said insurance, it may be provided through a program of qualified self-insurance. The School and Encompass Health agree that such insurance policies maintained by the School or Student: (i) shall provide be primary and that any insurance maintained by Encompass Health or its parent company shall be non•contributing; (ii) must cover any claims made against the Participating Institution with School, Hospital or Encompass Health relating to this Agreement, unless loss or claim is due to Hospital’s sole negligence; and (iii) shall be in full force and effect for a copy period of three (3) years after termination or expiration of the Certificate of InsuranceStudent’s clinical rotation at the Hospital unless such coverage is occurrence-based coverage. The School agrees that such insurance maintained by the School or Student may not be cancelled or materially changed without at least a thirty (30) day written notice to the Hospital. j. (e) The School agrees that and shall inform Students that it is the Students’ responsibility for arranging their: (i) transportation needed to fulfill their responsibilities at the Hospital: (ii) room and board during their participation in the Program; and (iii) arrival and departure dates with the Hospital. (f) The School shall provide evidence of each Student’s acknowledgment of hisadvise the Student that he/her obligations of compliance with Participating Institutions’ established OSHA, Privacy and Security policies and guidelines, of which the School has been informed in this Agreement. k. The School shall will retain ultimate responsibility for Student grades and evaluationsthe education of its students. i. (b) Faculty provided by the School, if any, shall be duly licensed, certified or otherwise qualified to participate in the Program. The School will provide proof of licensure, certification or other qualifications to Hospital upon request. (c) The School shall submit proof select Students without regard to race, creed, sex, national origin, age, handicap or other prohibited basis. The School will assess or verify a Student's health prior to the clinical experience and require that each Student pass a medical examination acceptable to the Hospital prior to his or her participation in the Program, and at such times during his or her participation in the Program as required by law. Prior to the Students’ clinical experience, the School shall provide written verification to the Hospital that each Student participating in the Program is free of communicable diseases, such as tuberculosis. (d) The School shall (or require that each Student to) carry appropriate professional and/or malpractice liability insurance coverage for Students and faculty during the term each student of this Agreement with minimum policy limits in the amount of at least $1,000,000 per occurrence and $3,000,000 in the aggregateannual aggregate and provide proof of such coverage to the Hospital. The School and HealthSouth agree that such insurance policies maintained by the School or Student: (i) shall provide be primary and that any insurance maintained by HealthSouth shall be non-contributing; (ii) must cover any claims made against the Participating Institution with School, Hospital and HealthSouth relating to this Agreement; and (iii) shall be in full force and effect for a copy period of three (3) years after termination or expiration of the Certificate of InsuranceStudent's clinical rotation at the Hospital. The School agrees that such insurance maintained by the School or Student may not be cancelled or materially changed without at least a thirty (30) day written notice to the Hospital. j. (e) The School agrees that and shall inform Students that it is the Students’ responsibility for arranging their: (i) transportation needed to fulfill their responsibilities at the Hospital: (ii) room and board during their participation in the Program; and (iii) arrival and departure dates with the Hospital. (f) The School shall provide evidence of each Student’s acknowledgment of hisadvise the Student that he/her obligations of compliance with Participating Institutions’ established OSHA, Privacy and Security policies and guidelines, of which the School has been informed in this Agreement. k. The School shall ensure that each Student involved in clinical experiences has received sufficient instruction in the relevant theory and has satisfactorily completed the prerequisite portion of the curriculum and to insure that: 1) Each Student complies with the Participating Institution's policies, procedures, and standards of practice. 2) The Student wears the proper attire, as defined by the Participating Institution dress code, including a name tag identifying the individual as a Student. 3) Each Student has complied with the health and immunization requirements of the Participating Institution, including but not limited to the mandatory COVID-19 vaccination. 4) Each Student is informed of and she will be required to keep any scheduled appointment with sign a Statement of Confidentiality in the Participating Institution.form attached hereto as Exhibit A. l. (g) The School shall retain responsibility for its faculty advise the Student that he/she will be required to sign an Acknowledgement Form regarding HealthSouth’s Drug and Students for Alcohol Policy in the planning, teaching, and evaluating the Student’s clinical practice.form attached hereto as Exhibit B. m. (h) The School shall provide advise the Student that he/she will be required to sign a Release Statement Certification regarding certain investigative background checks in the Participating Institution form attached hereto as Exhibit C. (i) The School shall advise the Student that he/she will be required to sign a copy Health Insurance Portability and Accountability Act (HIPAA) Student Training Documentation form regarding the confidentiality and privacy of a completed, negative drug screen for each Student prior to patient protected health information in the start of the clinical rotation. The drug screen must be a 10- substance abuse panel (SAP), Urine, Non-Dot test that is administered no sooner than 30 day prior to the start date the clinical rotation at no cost to the Participating Institutionform attached hereto as Exhibit D .
