Section 3 - Definitions. In the application and interpretation of the provisions of this Agreement, the following definitions shall apply:

Under the influence of alcohol shall mean testing positive for the presence of alcohol based upon the guidelines of Section 440.101, or 440.102, Florida Statutes, or Florida Administrative Code 38F-8 (unless a stricter standard is authorized by law for a specified job position). Under the influence of drugs shall mean testing positive for the presence of drugs based upon the standards set forth in Section 440.101 or 440.102, Florida Statutes, or Florida Administrative Code 38F-8 (unless a stricter standard is authorized by law for a specified job position); provided that any statutory standard which is more strict shall apply. Drug shall mean any controlled substance as defined in Chapter 893, Florida Statutes or any substance defined as a drug in Section 440.102, Florida Statutes.
Section 3 - Definitions. A. Distance learning is a method of teaching and learning in a virtual environment.

Section 3 - Definitions. A. Certified Teacher Salary Savings will be defined as the difference between the compensation of a certified teacher who is no longer employed with the district and that of his/her replacement. If a certified position is not being replaced in an effort to prevent deficit financing, it will not be considered as part of the funds that are available through Certified Teacher Salary Savings. If the position that was not replaced is replaced one year later, then it will have a neutral effect on the calculation of Certified Teacher Salary Savings. If a position is added to the bargaining unit, it will not be counted against the Certified Teacher Salary Savings.
Section 3 - Definitions a. The term “Artifacts” shall mean anything in physical or virtual form that provides data. Artifacts could include notes from observed practice and products or results of a classroom teacher’s work that demonstrates knowledge and skills of the educator with respect to the four-level rating system. Artifacts should not be created specifically for the evaluation system.
