Selection of the period of investigation Sample Clauses

Selection of the period of investigation. 6. The Panel in Mexico – Olive Oil examined Article 15.1 in the context of claims regarding the investigating authority's definition of the period of investigation. The Panel made the following statements regarding this matter: "In our view, the selection by an investigating authority of the period of investigation is a critical element in the countervailing duty investigative process. It determines the data that will form the basis for the assessment of subsidization, injury and the causal relationship between subsidized imports and the injury to the domestic industry. Although the SCM Agreement does not set forth an express requirement regarding the selection of the period of investigation for the purpose of conducting an injury analysis, this does not mean that an investigating authority's discretion in this respect is unlimited. In our view, the requirements in Article 15.1 to base a determination of injury on positive evidence and pursuant to an objective examination impose certain constraints on an investigating authority's discretion in selecting the period of investigation necessary to ensure the comprehensiveness and reliability of the data used as the basis for an injury determination."8
