Seller’s Title Evidence. Within ten (10) days of the Effective Date, Seller shall furnish to Buyer (a) a current commitment (the “Commitment”) for an ALTA Owner’s Policy of Title Insurance (“Title Policy”) committing to insure title to the Real Property, in the amount of the Purchase Price, issued by Chicago Title Insurance Company (“Title Company”).
Seller’s Title Evidence. Buyer shall, no later than thirty (30) days after the Effective Date obtain, at Buyer’s cost and expense, the following: A commitment (“Title Commitment”) for the most current ALTA Form B Owner’s Policy of Title Insurance insuring title to the Real Property in the amount of the Purchase Price, issued by the Title Company. The Title Commitment will commit Title Company to insure title to the Real Property subject only to the Permitted Encumbrances (“Title Policy”).
Seller’s Title Evidence. Buyer acknowledges receipt of a title commitment File Xx. XXXX000000 with an effective date of December 17, 2017 (“Title -2- Commitment”) for an owner’s policy of title insurance, issued by the Title Company, and (ii) an “as built” survey of the Property dated January 3, 2018 prepared by Xxxxxx X Xxxxxxxxx (Westwood Professional Services, Inc.) (the “Survey”) (collectively, the Survey and Title Commitment are referred to herein as the “Title Evidence”).

Seller shall request the Title Company to issue endorsements to the Title Commitments deleting any general exceptions from coverage based on mechanics or materialmen's liens, matters affecting title that may be disclosed by an accurate survey, the rights of parties in possession, and affirmatively guaranteeing (i) access to the Real Estate from a public road and/or across any appurtenant easements and (ii) that Purchaser's use and enjoyment of the improvements on the Real Estate shall not be disturbed or interfered with by reason of any easements or reservations of record.

Seller’s Title Evidence. Seller shall, within fifteen (15) days after the date of this Agreement, furnish to Buyer, at Seller’s cost and expense, a Title Commitment (defined below). The following documents are collectively the “Title Evidence:”
Seller’s Title Evidence. Seller has furnished the following (collectively, "TITLE EVIDENCE") to Buyer: (a) an Abstract of Title to the Real Property certified to a current date to include all appropriate judgment and bankruptcy searches; (b) a commitment ("TITLE COMMITMENT") for an ALTA Owner's Policy of Title Insurance insuring title to the Real Property, in the amount of the Purchase Price, issued by Chicago Title Insurance Company ("TITLE"); (c) legible copies of all documents affecting the Real Property which are referred to in the Title Commitment; (d) a copy of all existing land surveys in Seller's possession related to the Property; (e) the Estoppels, and (f) a UCC search showing no UCC filings regarding any of the Property. Buyer may also obtain such title endorsements and other evidence of title as it may elect, such as a survey, reports of liens for unpaid sales or withholding taxes on file against Seller or its predecessors in title (or against any trade name or business name used by Seller or its predecessors in title) which are on file in the office of the Minnesota Secretary of State or any applicable County Recorder, all of which shall be part of the Title Evidence. Buyer understands and agrees that Seller may elect to keep certain retainages under its construction contract and Buyer consent thereto so long as Title will insure Buyer against mechanics liens.
Seller’s Title Evidence. Sellers shall, within 10 days after the date of this Agreement, furnish the following (collectively the "Title Evidence") to Buyers: (a) a commitment ("Title Commitment") for an ALTA Form B Owner's Policy of Title Insurance from the Title Company committing to insure title to the Real Property in the amount of the Purchase Price allocated to each Motel as set forth on Schedule 2, issued by a Title Company; and (b) if the Real Property is abstract property, Sellers shall also deliver to Buyers an Abstract of Title to the Real Property certified to a current date to include all appropriate judgment and bankruptcy searches (Seller shall execute at closing customary affidavits to allow the Title Company to delete standard exceptions).
