Seniority Rights on Reinstatement. An employee who returns to work after the expiration of Maternity, Parental or Child Care leave shall retain the seniority he had accrued immediately prior to commencing the leave and shall be credited with seniority for the period of time covered by the approved leave. The employee shall be deemed to have resigned on the date upon which his leave commenced if an application for re-employment is not made one (1) month prior to the expiration of the leave or if he does not return to work after having applied for employment.
