Reinstatement Rights. Reinstatement rights shall automatically cease five (5) years from the date ULA was commenced, and no further rights to reinstatement shall exist unless extended by written mutual consent of the School Board, the licensed teacher, and the union.
Reinstatement Rights a. The employee shall be entitled to reinstatement, at the expiration of leave of absence, to the same or similar assignment by forwarding a letter to the Superintendent of intent to return at least thirty (30) calendar days prior to returning.
Reinstatement Rights. An employee shall return immediately following the expiration of the leave and shall be reinstated to the same position and rate of pay as held prior to the leave unless the leave extends beyond one (1) calendar year. For leave extending beyond one (1) year, reinstatement shall be to the same or similar position. A person hired as a replacement for the person on leave shall be laid off when the employee returns from the parental leave and shall have no rights under the reduction in force provision.
Reinstatement Rights. Employees that have been permanently laid off or displaced shall have reinstatement rights, pursuant to the Civil Service Commission rules.
Reinstatement Rights. Upon returning to service at the expiration of a leave of absence, the employee resumes the position which he/she held prior to the leave. When an individual who is on an authorized leave of absence with a time-certain, determines that he/she wishes to return to active employee status prior to the expiration of the full term of said leave of absence, the Board, through its authorized representative, shall make every effort to return the individual to the same position that the individual had prior to leaving, subject however, to the current needs of the school district.
Reinstatement Rights. On the termination of a leave, excluding teachers as defined in Article 2,A(p), the non-teaching Employee shall be returned to the job which he held prior to such leave or, if the job has been eliminated, to a similar job, provided that he is still qualified, subject to the rights of other Employees pursuant to this Agreement.
Reinstatement Rights. Upon return from leave, the individual/small group instruction teacher shall be reinstated to a position and shall assume the same position on the salary schedule held prior to the leave.
A. The individual/small group instruction teacher's assignment, insofar as practicable, shall be comparable to that held prior to the leave.
B. Nothing in this section shall abridge the rights of any employee as defined in Ohio Revised Code 3317.13.
Reinstatement Rights. Upon return from approved maternity/paternity/adoption leave at the time set forth in the application for leave, the teacher shall be entitled to reinstatement to the same position which he/she held prior to the leave or to the substantially equivalent position for which the teacher holds valid, unexpired certification/licensure. If the teacher desires to return to active service prior to the stated date of the application for leave, the teacher shall notify the Superintendent in writing that an early return to service is requested, and the date upon which the teacher wishes to return. Upon recommendation of the Superintendent, the Board may authorize the early return of such teacher. If the early return is so authorized, the teacher shall be assigned to the same or substantially equivalent position for which he/she is qualified not later than the commencement of the next grading period.
Reinstatement Rights. Time spent on any unpaid leave shall not be credited for service time for salary index, seniority purposes, or RIF purposes, except as modified herein, but bargaining unit members shall retain all seniority accumulated prior to the leave. Persons taking such leaves are assured reinstatement only if years of service/seniority for which they were credited prior to the leave warrant reinstatement as provided in the Master Agreement.
Reinstatement Rights. 4.12.6.1 Upon return from an approved family or medical care leave, the Unit Member shall return to the same bargaining unit position unless mutually agreed upon otherwise.
