Common use of Seniority Rights Upon Re-employment Clause in Contracts

Seniority Rights Upon Re-employment. a) An employee on leave under Article 15 shall earn seniority during the period of such leave. b) An employee shall be deemed to have resigned on the date upon which leave under Article 15 commenced if an application for re-employment is not made four (4) weeks prior to the expiration of the leave or if he/she does not return after having applied for re-employment. c) On return from leave granted under this Article, an employee shall be placed in his/her former position or in a position of equal rank and salary.
