Service Outside the Bargaining Unit. (a) Service with the Employer outside the bargaining unit shall not count for seniority purposes under this Article, save and except as expressly provided otherwise by this Agreement. (b) Upon a decision by the Parties or the Labour Relations Board of British Columbia, or any of its predecessors or successors, that a person and a job previously excluded from the bargaining unit shall henceforth be included in the bargaining unit, the person involved shall be granted seniority for the entire period of employment with the Employer outside the bargaining unit since his or her last date of hire by the Employer. However, seniority achieved under this Clause 11.06(b) shall not be used to secure any promotion in accordance with Article 14 during the first six (6) months from the date of entry into the bargaining unit or to exercise any bumping rights under Article 39 during the first twelve (12) months from the date of entry into the bargaining unit. (c) An Employee who accepts a position with the Employer outside of the bargaining unit shall accrue seniority for a period not to exceed ninety (90) consecutive calendar days from the date of commencement of such work, providing the Employee continues to pay the Union dues prescribed by Article 26. Upon expiry of this time limit, and continuation in the position outside of the bargaining unit, the Employee shall lose all seniority accumulated under this Agreement. Service Outside the Bargaining Unit. (ai) Service An employee who works in one or more positions outside of the bargaining unit with the Employer same employer shall have service in that position credited to the employee based on actual hours worked, excluding overtime, up to a lifetime maximum of thirty-nine hundred (3900) hours.
(ii) Individuals who do not return to their bargaining unit position immediately following the end of the work in a position in which a consecutive twenty-four (24) month period outside the bargaining unit have elapsed shall not count be credited with any seniority for seniority purposes under this Article, save time worked in that position and except as expressly provided otherwise by this Agreementshall forfeit all rights to the bargaining unit position.
(biii) Upon a decision by For the Parties or the Labour Relations Board purposes of British Columbiathis article, or any of its predecessors or successors, that a person and a job previously excluded from “return to his/her bargaining unit position” means returning to work in the bargaining unit shall henceforth be included in for at least thirty (30) calendar days.
(iv) Upon independent return to the bargaining unit, the person involved he/she shall be granted seniority for the entire period of employment credited with the Employer outside the bargaining unit since his or her last date seniority he/she held as of hire by the Employer. However, seniority achieved under this Clause 11.06(b) shall not be used to secure any promotion in accordance with Article 14 during the first six (6) months from the date of entry into the bargaining unit or to exercise any bumping rights under Article 39 during the first twelve (12) months from the date of entry into day outside the bargaining unit.
(cv) An Employee Independent return to the bargaining unit indicates that the employee has obtained a bargaining unit position through competition as an external applicant and therefore has obtained the position without seniority.
(vi) Subject to Article 24.10(a)(ii), an employee who accepts applies for and is accepted for a position with the Employer outside of the bargaining unit shall accrue seniority for a period not may revert to exceed ninety (90) consecutive calendar days from his/her former position upon completion of the date of commencement of such work, providing subject to the Employee continues to pay approval of the Union dues prescribed by Article 26Employer. Upon expiry Such approval shall not be unreasonably denied. The employer shall notify the employee of this time limit, its decision before the employee commences the temporary work. If the employer does not approve such a request and continuation in the employee accepts the temporary position outside of the bargaining unit, the Employee he/she shall lose all seniority accumulated under this Agreement. An Employee shall only have the forfeit his/her right to accrue seniority under this Clause 11.06both the permanent position and permanent status.

An Employee shall only have the right to accrue seniority under this Clause 11.0615.08(c) while working outside the bargaining unit one (1) time in any twenty-four (24) consecutive month period.
