SERVICES AND INFORMATION. OWNER will provide all criteria and information pertaining to OWNER's requirements for the project, including design objectives and constraints, space, capacity and performance requirements, flexibility and expandability, and any budgetary limitations. OWNER will also provide copies of any OWNER-furnished Standard Details, Standard Specifications, or Standard Bidding Documents which are to be incorporated into the project. OWNER xxxx xxxxxxx the services of soils/geotechnical engineers or other consultants that include reports and appropriate professional recommendations when such services are deemed necessary by ENGINEER. The OWNER agrees to bear full responsibility for the technical accuracy and content of OWNER-furnished documents and services. In performing professional engineering and related services hereunder, it is understood by OWNER that ENGINEER is not engaged in rendering any type of legal, insurance or accounting services, opinions or advice. Further, it is the OWNER’s sole responsibility to obtain the advice of an attorney, insurance counselor or accountant to protect the OWNER’s legal and financial interests. To that end, the OWNER agrees that OWNER or the OWNER’s representative will examine all studies, reports, sketches, drawings, specifications, proposals and other documents, opinions or advice prepared or provided by ENGINEER, and will obtain the advice of an attorney, insurance counselor or other consultant as the OWNER deems necessary to protect the OWNER’s interests before OWNER takes action or forebears to take action based upon or relying upon the services provided by ENGINEER.

SERVICES AND INFORMATION. Apriva is not responsible for the accuracy or completeness of information sent or received by You through the Service. In certain instances, Apriva may make available through the Service certain information, data, or messages (collectively referred to as “Information”) independently obtained by Apriva from various sources, their affiliates, and others (collectively referred to as “Information Providers”). Such Information may be the subject of additional terms and conditions of the Information Providers. Your use of and access to the Information shall constitute Your acceptance of those terms and conditions. If You do not agree to the additional terms and conditions, do not use and access the Information. The accuracy, completeness, timeliness, or correct sequencing of the Information is not guaranteed by Apriva, the Information Providers, or any parties processing Information or payments (the foregoing parties are collectively referred to as the “Disseminating Parties”).

OWNER shall furnish the XXXXXXXX available studies, reports, and other data pertinent to XXXXXXXX services; obtain or authorize XXXXXXXX to obtain or provide additional reports and data as required; furnish to XXXXXXXX services of others as required for the performance of XXXXXXXX services hereunder, and XXXXXXXX shall be entitled to use and rely upon all information and services provided by OWNER or others in performing XXXXXXXX services under this AGREEMENT.

SERVICES AND INFORMATION. The Sellers covenant with the Purchaser that for a period of six months following Completion, upon request by the Purchaser from time to time, and to the extent not already required to do so pursuant to any terms of engagement or consultancy with the Companies, they shall as soon as reasonably practicable make available to the Purchaser such information relating to the business and affairs of the Companies as the Purchaser may reasonably require, subject to the Purchaser paying any reasonable costs or expenses of any such Seller requested to do so.

b. In performing professional services hereunder, it is understood by the City of Xxxxxxx that CONSULTANT is not engaged in rendering any type of legal, insurance or accounting services, opinions or advice. Further, it is the City of Xxxxxxx’s sole responsibility to obtain the advice of an attorney, insurance counselor or accountant to protect the City of Xxxxxxx’s legal and financial interests. To that end, the City of Xxxxxxx agrees to have an appropriate representative examine all studies, reports, sketches, drawings, specifications, proposals and other documents, opinions or advice prepared or provided by CONSULTANT, and will obtain the advice of an attorney, insurance counselor or other consultant as the City of Hickory deems necessary to protect the City of Xxxxxxx’s interests before the City of Hickory takes action or forebears to take action based upon or relying upon the services provided by CONSULTANT.
