SHA Authority. Sections 2, 7, and 10 of the ESA allow USFWS to approve SHAs. Section 10(a)(1)(A) of the ESA allows USFWS to issue Permits for listed species, such as the marbled murrelet. This SHA is prepared pursuant to USFWS regulations for issuance of enhancement of survival permits through Safe Harbor Agreements (50 C.F.R. § 17.22 (c)(1)); and the USFWS’s Final Safe Harbor Policy, 64 FR 32717. Applicant developed this SHA with technical assistance from the USFWS to address the conservation benefit to marbled murrelets that is the result of implementing the Forest Practices Program in Washington in addition to the net conservation benefit derived from setting aside “Presumed Habitat”. This SHA is intended to comply with the requirements of 50 C.F.R. § 17.22(c)(1)(i)–(iii). Issuance of a SHA requires that USFWS comply with Federal regulatory requirements. Issuance of a SHA is a “federal action” subject to compliance with the National Environmental Policy Act (“NEPA”). Permit issuance requires a determination that the criteria for issuance of a SHA in 50 C.F.R. § 17.22(c)(2) has been satisfied.

  • Developer Authority Consistent with Good Utility Practice and this Agreement, the Developer may take whatever actions or inactions with regard to the Large Generating Facility or the Developer Attachment Facilities during an Emergency State in order to (i) preserve public health and safety, (ii) preserve the reliability of the Large Generating Facility or the Developer Attachment Facilities, (iii) limit or prevent damage, and (iv) expedite restoration of service. Developer shall use Reasonable Efforts to minimize the effect of such actions or inactions on the New York State Transmission System and the Connecting Transmission Owner’s Attachment Facilities. NYISO and Connecting Transmission Owner shall use Reasonable Efforts to assist Developer in such actions.

  • Legal Authority The Contractor warrants and assures H-GAC that it possesses adequate legal authority to enter into this Agreement. The Contractor's governing body, where applicable, has authorized the signatory official(s) to enter into this Agreement and bind the Contractor to the terms of this Agreement and any subsequent amendments hereto.

  • General Authority The Owner Trustee is authorized and directed to execute and deliver the Basic Documents to which the Trust is to be a party and each certificate or other document attached as an exhibit to or contemplated by the Basic Documents to which the Trust is to be a party and any amendment or other agreement or instrument described herein, as evidenced conclusively by the Owner Trustee's execution thereof.
