Shift Penalties. (1) In addition to an employee’s ordinary salary (including higher duties allowance), the employee is entitled to the highest penalty rate for shiftwork that applies to the performance of shiftwork set out in the following table: Ordinary duty, any part being between 6:00 pm and 6:30 am 15% Ordinary hours worked continuously for a period exceeding 4 weeks on a shift falling wholly within the period from 6:00 pm to 8:00 am 30% Ordinary duty, Saturday 50% Ordinary duty, Sunday 100% Ordinary duty, public holiday 150% (2) However, a part‑time employee is entitled to the 30% penalty rate mentioned in subclause (1) only if: (a) the employee’s rostered ordinary duty involves working no fewer shifts each week, or no fewer shifts a week on average over the shift cycle, than an equivalent full‑time employee; and (b) the shift is part of a full‑time shift that is wholly between 6:00 pm and 8:00 am. (3) Payments for shift penalty rates must not be taken into account in working out overtime or any allowance based on salary. (4) Shift penalty rates will not be paid for a shift for which another penalty payment is made. (5) An employee who regularly performs shiftwork is entitled, when the employee is on annual leave, to 50% of the penalties that would be attracted by working the employee’s regular shift pattern over the period of the leave.

Shift Penalties. (a) Where an employee works a rostered afternoon shift between Monday and Friday, the employee will be paid a loading of 12.5% of their ordinary rate of pay. (b) Where an employee works a rostered night shift between Monday and Friday, the employee will be paid a loading of 15% of their ordinary rate of pay. (c) The provisions of this clause do not apply where an employee commences their ordinary hours of work after 12.00 noon and completes those hours at or before 6.00 pm on that day. (d) For the purposes of this clause: (i) Afternoon shift means any shift commencing not earlier than 12.00 noon and finishing after 6.00 pm on the same day; and (ii) Night shift means any shift commencing on or after 6.00 pm and finishing before 7.30 am on the following day. (e) The shift penalties prescribed in this clause will not apply to shiftwork performed by an employee on Saturday, Sunday or public holiday where the extra payment prescribed by clause 25—Saturday and Sunday work and clause 33Public holidays applies. (f) The provisions of this clause will not apply to Registered Nurse level 4.

Provided that Employees who work less than 38 hours per week will only be entitled to the additional rates where their shifts commence prior to 6.00am or finish subsequent to 6.00pm. (c) The rates for casual Employees in clause 25.1(a) are in substitution for and not cumulative upon the casual loading prescribed in clause 10.6. (d) The provisions of this clause 25.1 will not apply to Registered Nurse Levels 4 and 5.

Shift Penalties. (a) Shift penalties payable under this Agreement are set out in Schedule 7. (b) During the life of this Agreement, nothing will prevent the University and an employee agreeing to the payment of annualised shift loadings in lieu of the loadings described in this clause provided that the annualised loading is no less than the value of the shift loadings over the course of the year. (c) The shift loadings payable under (a), (b) and (c) of Schedule 7 will be paid in addition to the base rate of pay for that part of the shift which is within the defined span, and will not be paid for the part of the shift (if any) which falls outside the defined span. (d) The shift loadings prescribed in (c) in Schedule 7 will be cumulative upon any other shift loading also payable under (c) in Schedule 7. (e) The shift loadings payable under (d) in Schedule 7 will be paid in addition to the base rate of pay to all employees except those employees whose shift loadings are provided for in (a), (b) or (c) in Schedule 7.
Shift Penalties. (a) Where an Employer requires a School Services Officer to work ordinary time on Monday to Friday, any part of which falls between the hours of 6.00 pm and 7.00 am, a penalty of 15% shall apply for the whole shift, additional to the ordinary rate of pay.
