Shipping/Export. (a) Vendor shall ship Product pursuant to Ingram purchase order(s) ("P.O."). Product shall be shipped F.O.B. Ingrxx'x xxxignated warehouse with risk of loss or damage to pass to Ingram upon delivery to the warehouse specified in Ingrxx'x X.X.

Shipping/Export. (a) Vendor shall ship Product pursuant to Ingram purchase order(s) ("P.O."). The terms and conditions of this Agreement shall apply to each order accepted or shipped by Vendor hereunder. The provisions of Xxxxxx'x form of purchase order or other business form shall not apply to any order notwithstanding Vendor's acknowledgment or acceptance of such order except for the following terms which Vendor shall accept with respect to each order pursuant and subject to the provisions of this Agreement: (i) quantity and type of Xxxxxx Products ordered; (ii) requested delivery dates and (iii) freight terms. Product shall be shipped F.O.B. Xxxxxx'x designated warehouse with risk of loss or damage to pass to Ingram upon delivery to the warehouse specified in Xxxxxx'x P.O.
Shipping/Export. (a) Vendor shall ship Product pursuant to Xxxxxx purchase order(s) ("P.O."). Product shall be shipped F.O.B. Vendor's shipping deck with risk of loss or damage to pass to Xxxxxx upon delivery to the carrier specified in Xxxxxx'x P.O. Vendor shall ship all Products in accordance with the instructions specified in the Vendor Routing Guide, attached hereto as Exhibit A.
Shipping/Export. (a) Vendor shall ship Products pursuant to Wintec P.O.s. Products shall be shipped FOB Wintec’s US Continental warehouse only with all costs of freight covered by Vendor, unless otherwise agreed upon by both parties.

  • Shipping Shipping shall be by UPS ground unless Customer requests and -------- pays for overnight shipping by UPS. Grantor will post shipping and handling fees for overnight shipping on the Web Site. The price posted at the time of order shall obtain. All orders from supplier's stock shall be shipped within seventy-two (72) hours of receipt of the order. Items not in stock (back orders) shall be shipped on a timely basis, but not later than four to six weeks from time of order.

  • Export I agree not to export, reexport, or transfer, directly or indirectly, any U.S. technical data acquired from Company or any products utilizing such data, in violation of the United States export laws or regulations.

  • Packing All Spare Parts ordered shall receive standard commercial packing suitable for export shipment via air freight. Such standard packing will generally be to ATA 300 standards as amended from time to time. All AOG orders will be handled, processed, packed and shipped separately.

  • Exports The parties acknowledge that the export of technical data, materials or products is subject to the exporting party receiving any necessary export licenses and that the parties cannot be responsible for any delays attributable to export controls which are beyond the reasonable control of either party. Lexicon and BMS agree not to export or re-export, directly or indirectly, any information, technical data, the direct product of such data, samples or equipment received or generated under this Agreement in violation of any applicable export control Laws. Lexicon and BMS agree to obtain similar covenants from their Sublicensees and contractors with respect to the subject matter of this Section 12.11.

  • Capital Equipment Collaborator’s commitment, if any, to provide ICD with capital equipment to enable the research and development activities under the Research Plan appears in Appendix B. If Collaborator transfers to ICD the capital equipment or provides funds for ICD to purchase it, then ICD will own the equipment. If Collaborator loans capital equipment to ICD for use during the CRADA, Collaborator will be responsible for paying all costs and fees associated with the transport, installation, maintenance, repair, removal, or disposal of the equipment, and ICD will not be liable for any damage to the equipment.

  • Packaging and Labeling 11.1 Company shall provide packaging and labeling specifications that call out clear labeling requirements.

  • Product Marking LICENSEE agrees to xxxx the LICENSED PRODUCTs sold in the United States with all applicable United States patent numbers. All LICENSED PRODUCTs shipped to or sold in other countries shall be marked in such a manner as to conform with the patent laws and practices of the country of manufacture or sale.

  • Defective Products None of the Group Companies has manufactured, sold or supplied products which are, or were, in any material respect, faulty or defective, or which do not comply in any material respect with any representations or warranties expressly made by such Group Company, or with all applicable regulations, standards and requirements.

  • Packaging All Material shall be packaged in accordance with ATA 300 Specification, Category III for consumable/expendable material and Category II for rotables. Category I containers shall be used if requested by the Buyer and the difference between Category I and Category II packaging costs shall be paid by the Buyer together with payment for the respective Material.
