SITE-BASED DECISION MAKING. A. The District and the Council agree that programs which provide increased opportunities for teacher involvement in building level Site Council decision making can xxxxxx the collegial exchange of ideas and information so necessary for effective professional practice, and can improve the educational process. Site Councils will operate in accordance with District policy IFCA, section titled Duties as Adopted 2/24/04 and State law. The duties of the Site Council are defined in ORS 329.704(1). Site based decision making shall be limited to site specific issues raised by the site council related to site council duties and (except as provided below or otherwise by this agreement) shall not interfere with the duties, responsibilities and rights of the Board including (but not limited to) the Board’s right to establish and revise the school calendar and schedule classes as set out in Article 3. The Site Council may expend this money for its own operating expenses and/or to fund site-based decision- making arrangements at individual schools. C. To facilitate the activities of the Site Council, each Site Council shall receive thirty (30) days of teacher release time to be used at the discretion of the Site Council. D. The Collective Bargaining Agreement will remain in full force and effect and have full application to the employees who are affected by a site-based decision making program, except as modified by mutual agreement by GPEA, the Council and the District. E. In the case of a secondary schedule change (other than a schedule change that places teacher preparation outside of the instructional day)1, the school recommending a change will develop a schedule change committee that is comprised of no less than 60% certified staff. The committee representatives will be comprised of: i. Administration; and ii. Association departmental and grade-level members who are mutually agreed upon by the association and administration. The committee will work collaboratively with all association members at the school to develop a schedule. Committee representative roles will include gathering input from staff, sharing committee work, and administering votes by secret ballot. The committee will determine operational ground rules to include a consensus model and timeline for developing schedule changes. When developed, proposed schedule changes will be reviewed by the school staff and a vote will be taken. If the schedule recommendation does not result in at least 60% approval (site-based staff only with abstentions not being considered as approval or disapproval votes), the proposed schedule will go back to the committee for review and adjustment. In the event that 60% approval is not met following the same criteria as noted above, one additional certified staff vote will take place. In the event that 60% approval is not met after the second vote, following the same criteria as noted above, the committee will decide to continue to review and adjust the schedule, or make a recommendation to the superintendent, who will verify the proposed schedule meets all state laws and instructional minute guidelines. A proposed schedule that meets all conditions may be enacted.

Site level responsibility for effective making decisions improves professional practice, inspires commitment, and can improve uses the educational processcollective vision of a school to address ways of meeting the particular needs of that school's students and staff. Site Councils Individual school certificated staff are encouraged to explore options that conform to state law, federal law, and district policy, but address the needs of students and faculty in ways that better fulfill that site's professional vision while considering the :financial impact. For site proposals that seek to modify the collective bargaining agreement between the District and LVEA, a school certificated staff may vote on the proposal. LVEA and the District will operate analyze the changes to see if they would involve changes in accordance with District policy IFCAthe collective bargaining agreement before any vote. 21.2 The District and LVEA agree that the provisions of a Memorandum of Understanding shall not be interpreted or considered as establishing any precedent or practice, nor as a violation of any agreement, condition or practice.
21.3 The District and LVEA agree that such Memorandum of Understanding may be initiated for a defined period of time, and following that time, twenty-five (25) percent of the Site Council, each Site Council eligible voters at that site may initiate a renewal vote on the existing or a replacement Memorandum of Understanding. The request for a renewal vote shall receive thirty (30) days be in the form of teacher release time to be used a petition signed by at the discretion least twenty-five percent of the Site Council.
D. The Collective Bargaining Agreement will remain in full force and effect and have full application to eligible certificated voters. 21.4 When a department or group of employees is specifically impacted by a proposed modification to the collective bargaining agreement, the District and LVEA strongly encourage a decision making process that considers the impact on those employees. INTEREST BASED DECISION MAKING (IBDM)
21.5 The District and LVEA will supply trained IBDM facilitators at least 60% approval (sitethe request of any school site that desires a collegial way of reaching agreement. Interest-based staff only with abstentions not being considered as approval decision-making is a defined model for joint planning and problem solving that seeks to improve the learning environment by allowing for organizational change and educational reform. Examples of past successful site modifications include block schedules, configuration of Open House or disapproval votes)Back-to-School Night, the proposed schedule kindergarten extended days; and banked time for modified days. Existing Memoranda will go back be subject to the committee renewal process set out above.
22.1 This contract shall expire June 30, 2022. The Association and the District agree that there shall be no re-openers other than those provided in Article 19 for review and adjustmentthe length of this contract unless mutually agreed.
